"contents": "<span style=\"font-weight: 400;\">The suspension and potential discharge of Peter Becker, the civil society representative on the National Nuclear Regulator (NNR) board, by Minister Gwede Mantashe of the Department of Mineral Resources and Energy (DMRE), is inconsistent with transparency and the need for community interests to be represented on the board.</span>\r\n\r\n<span style=\"font-weight: 400;\">This was according to a memorandum of demands read out by Francesca de Gasparis, executive director of the Southern African Faith Communities’ Environment Institute (Safcei), at a protest outside the NNR office in Table View, Cape Town, on Thursday.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1179573\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/02/OD-tamsin-Nuke-protest4.jpg\" alt=\"\" width=\"720\" height=\"422\" /> Protesters gather outside the National Nuclear Regulator office in Table View, Cape Town, on 17 February 2022, to demand transparency regarding the suspension of civil society NNR board representative Peter Becker. (Photo: Tamsin Metelerkamp)</p>\r\n\r\n<span style=\"font-weight: 400;\">“Accountability, responsiveness and openness are foundational principles of our constitutional democratic state,” read De Gasparis. “The NNR Act is the enabling legislation that stipulates that the NNR board consists of various directors appointed by the Minister [of the DMRE], including ‘one person representing communities, which may be affected by nuclear activities.’”</span>\r\n\r\n<span style=\"font-weight: 400;\">About 25 protesters representing Safcei, Project 90 by 2030, 350Africa.org, Koeberg Alert Alliance and the Federation for a Sustainable Environment gathered outside the NNR office to protest Becker’s suspension. They demanded Becker’s immediate reinstatement to the board by Mantashe.</span>\r\n\r\n<span style=\"font-weight: 400;\">Other demands detailed in the memorandum, directed to Dr Thapelo Motshudi, chairperson of the NNR board, and Dr Bismark Tyobeka, CEO of the board, were:</span>\r\n<ul>\r\n \t<li>Transparency and accountability from the NNR in its role as the regulator of nuclear energy;</li>\r\n \t<li>Access to information and supporting evidence regarding the allegations made about Becker’s conduct;</li>\r\n \t<li>A suspension of all NNR board decision-making while there is no community representative present;</li>\r\n \t<li>A suspension of all NNR processes relating to the life-extension project for Koeberg Nuclear Power Station until there is an active civil society representative on the board.</li>\r\n</ul>\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1179570\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/02/OD-tamsin-Nuke-protest1.jpg\" alt=\"\" width=\"720\" height=\"514\" /> Gabriel Klaasen, communications officer and advocate at Project 90 by 2030, at the protest outside the National Nuclear Regulator office in Table View, Cape Town, on 17 February 2022. (Photo: Tamsin Metelerkamp)</p>\r\n\r\n<span style=\"font-weight: 400;\">“We are here today because regardless of what our energy future looks like, despite what I want it to be, despite what ten other people here want it to be, it has to be made together,” said Gabriel Klaasen, communications officer and advocate at Project 90 by 2030. “We have to imagine [...] and create our energy future together. If we don’t do that, and only one section of our society creates that — a section that’s oftentimes viewed as non-transparent, as secretive — we are not going to achieve the world that we want.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Lorna Fuller, director of Project 90 by 2030, echoed this sentiment, explaining that without Becker present on the board as a voice for civil society, her organisation has very little faith in the decisions the NNR makes.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Peter [Becker] was chosen as our representative because he has such an interest in nuclear,” said Fuller. “He’s travelled, he’s seen nuclear sites, he’s seen where the accidents have happened. He’s the person we trust the most. [H]e really best speaks to our interests and understanding the things that they [the NNR] talk about.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The protesters’ memorandum was handed over to Peter Bester, Programme Manager: Nuclear Power Plants, during the course of the demonstration. </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> approached Bester for comment after the handing over of the memorandum, but he declined to speak on the matter.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1179571\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/02/OD-tamsin-Nuke-protest2.jpg\" alt=\"\" width=\"720\" height=\"457\" /> Francesca de Gasparis, executive director of Safcei, hands over protesters' demands to Peter Bester, programme manager for nuclear power plants, at a protest outside the NNR office in Table View, Cape Town, on 17 February 2022. (Photo: Tamsin Metelerkamp)</p>\r\n\r\n<b>Ongoing suspension</b>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe was due to deliver his decision as to whether Becker would be discharged by 15 February 2022. According to Becker, this came after he sued both Mantashe and the NNR board on 28 January 2022, resulting in an urgent court date set down for 8 February 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The biggest concern, and that’s why we were approaching the court on the urgent basis, the biggest concern was the suspension could drag on forever,” said Becker.</span>\r\n\r\n<span style=\"font-weight: 400;\">The matter was settled out of court, with Mantashe agreeing to give his decision by the aforementioned date, and the NNR agreeing to suspend all board and subcommittee meetings, as well as all board and subcommittee decisions, until Mantashe made his decision, according to a press release by nonprofit organisation Save Bantamsklip from 9 February 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, the minister failed to give his decision by 15 February, instead issuing Becker with a letter offering additional time for him to respond to specific allegations of misconduct.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the letter, Mantashe notes Becker’s assertion that the minister failed to identify the grounds on which he intends to discharge Becker. This in turn had made it difficult for Becker to contest the allegations.</span>\r\n\r\n<span style=\"font-weight: 400;\">The specific allegations against Becker, as laid out in Mantashe’s letter from 15 February 2022, include:</span>\r\n<ul>\r\n \t<li>Potentially causing reputational harm to the NNR and South African government through implying, in an article for <i>Energize </i>magazine on 10 June 2021, that safety concerns may have been ignored in the restarting of reactor 1 at Koeberg Nuclear Power Station;</li>\r\n \t<li>Implying that members of the NNR board would ignore their fiduciary and statutory obligations, by suggesting in an email to the chairperson of the NNR on 27 July 2021 that the board’s approval of the replacement of the steam generators at Koeberg could mean that the board is not able to make an unbiased decision on whether the life of the power station should be extended;</li>\r\n \t<li>Potentially causing reputational harm to the NNR and the government by publicly speaking out against the extension of Koeberg’s lifespan, in such a way that implies the board and government will not properly carry out their obligations.</li>\r\n</ul>\r\n<p style=\"margin: 12px auto 6px auto; font-family: Helvetica,Arial,Sans-serif; font-style: normal; font-variant: normal; font-weight: normal; font-size: 14px; line-height: normal; font-size-adjust: none; font-stretch: normal; -x-system-font: none; display: block;\"> <a style=\"text-decoration: underline;\" title=\"View 2022 02 15 - Letter From the Minister to Mr P Becker (Co Chennells Albertyn)-OCR (1) on Scribd\" href=\"https://www.scribd.com/document/559514941/2022-02-15-Letter-From-the-Minister-to-Mr-P-Becker-Co-Chennells-Albertyn-OCR-1#from_embed\">2022 02 15 - Letter From the Minister to Mr P Becker (Co Chennells Albertyn)-OCR (1)</a> by <a style=\"text-decoration: underline;\" title=\"View janet's profile on Scribd\" href=\"https://www.scribd.com/user/389811916/janet#from_embed\">janet</a> on Scribd</p>\r\n<iframe id=\"doc_39759\" class=\"scribd_iframe_embed\" title=\"2022 02 15 - Letter From the Minister to Mr P Becker (Co Chennells Albertyn)-OCR (1)\" src=\"https://www.scribd.com/embeds/559514941/content?start_page=1&view_mode=scroll&access_key=key-jY3WF9dCGomJCuCwZxqm\" width=\"100%\" height=\"600\" frameborder=\"0\" scrolling=\"no\" data-auto-height=\"false\" data-aspect-ratio=\"0.75\"></iframe>\r\n\r\n<span style=\"font-weight: 400;\">In detailing these allegations, Mantashe mentioned Becker’s role as spokesperson of the Koeberg Alert Alliance, an anti-nuclear organisation. </span>\r\n\r\n<span style=\"font-weight: 400;\">“It appears to me that you may be impossibly conflicted in your respective roles, as an anti-nuclear activist, and as a member of the Board,” said Mantashe.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker, however, contended that having a variety of opinions on the NNR board is a source of strength. He pointed out that the board includes a representative of the DMRE, which is known to be pro-nuclear.</span>\r\n\r\n<span style=\"font-weight: 400;\">“At least I was the voice there to put an alternative view forward, […] not about whether nuclear is good or bad, but about how cautious we should be,” said Becker.</span>\r\n\r\n<span style=\"font-weight: 400;\">Speaking at Thursday’s protest, De Gasparis said, “We’re really concerned [about] this idea that if you’re anti-nuclear energy, and you’re representing community voices, that the National Nuclear Regulator wouldn’t want you on the board, and that the Minister has said that’s one of the key reasons why he doesn’t want the current community representative on the board.”</span>\r\n\r\n<span style=\"font-weight: 400;\">“Surely, the issue that we’re faced with is you want someone who is critical and concerned about the impact of nuclear energy on communities on the board,” she continued. “And what we’re seeing is an actual removal of that person.” </span><b>DM</b>",

"description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",

They demanded Becker’s immediate reinstatement to the board by Mantashe.</span>\r\n\r\n<span style=\"font-weight: 400;\">Other demands detailed in the memorandum, directed to Dr Thapelo Motshudi, chairperson of the NNR board, and Dr Bismark Tyobeka, CEO of the board, were:</span>\r\n<ul>\r\n \t<li>Transparency and accountability from the NNR in its role as the regulator of nuclear energy;</li>\r\n \t<li>Access to information and supporting evidence regarding the allegations made about Becker’s conduct;</li>\r\n \t<li>A suspension of all NNR board decision-making while there is no community representative present;</li>\r\n \t<li>A suspension of all NNR processes relating to the life-extension project for Koeberg Nuclear Power Station until there is an active civil society representative on the board.</li>\r\n</ul>\r\n[caption id=\"attachment_1179570\" align=\"aligncenter\" width=\"720\"]<img class=\"size-full wp-image-1179570\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/02/OD-tamsin-Nuke-protest1.jpg\" alt=\"\" width=\"720\" height=\"514\" /> Gabriel Klaasen, communications officer and advocate at Project 90 by 2030, at the protest outside the National Nuclear Regulator office in Table View, Cape Town, on 17 February 2022. (Photo: Tamsin Metelerkamp)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">“We are here today because regardless of what our energy future looks like, despite what I want it to be, despite what ten other people here want it to be, it has to be made together,” said Gabriel Klaasen, communications officer and advocate at Project 90 by 2030. “We have to imagine [...] and create our energy future together. If we don’t do that, and only one section of our society creates that — a section that’s oftentimes viewed as non-transparent, as secretive — we are not going to achieve the world that we want.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Lorna Fuller, director of Project 90 by 2030, echoed this sentiment, explaining that without Becker present on the board as a voice for civil society, her organisation has very little faith in the decisions the NNR makes.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Peter [Becker] was chosen as our representative because he has such an interest in nuclear,” said Fuller. “He’s travelled, he’s seen nuclear sites, he’s seen where the accidents have happened. He’s the person we trust the most. [H]e really best speaks to our interests and understanding the things that they [the NNR] talk about.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The protesters’ memorandum was handed over to Peter Bester, Programme Manager: Nuclear Power Plants, during the course of the demonstration. </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> approached Bester for comment after the handing over of the memorandum, but he declined to speak on the matter.</span>\r\n\r\n[caption id=\"attachment_1179571\" align=\"aligncenter\" width=\"720\"]<img class=\"size-full wp-image-1179571\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/02/OD-tamsin-Nuke-protest2.jpg\" alt=\"\" width=\"720\" height=\"457\" /> Francesca de Gasparis, executive director of Safcei, hands over protesters' demands to Peter Bester, programme manager for nuclear power plants, at a protest outside the NNR office in Table View, Cape Town, on 17 February 2022. (Photo: Tamsin Metelerkamp)[/caption]\r\n\r\n<b>Ongoing suspension</b>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe was due to deliver his decision as to whether Becker would be discharged by 15 February 2022. According to Becker, this came after he sued both Mantashe and the NNR board on 28 January 2022, resulting in an urgent court date set down for 8 February 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The biggest concern, and that’s why we were approaching the court on the urgent basis, the biggest concern was the suspension could drag on forever,” said Becker.</span>\r\n\r\n<span style=\"font-weight: 400;\">The matter was settled out of court, with Mantashe agreeing to give his decision by the aforementioned date, and the NNR agreeing to suspend all board and subcommittee meetings, as well as all board and subcommittee decisions, until Mantashe made his decision, according to a press release by nonprofit organisation Save Bantamsklip from 9 February 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, the minister failed to give his decision by 15 February, instead issuing Becker with a letter offering additional time for him to respond to specific allegations of misconduct.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the letter, Mantashe notes Becker’s assertion that the minister failed to identify the grounds on which he intends to discharge Becker. This in turn had made it difficult for Becker to contest the allegations.</span>\r\n\r\n<span style=\"font-weight: 400;\">The specific allegations against Becker, as laid out in Mantashe’s letter from 15 February 2022, include:</span>\r\n<ul>\r\n \t<li>Potentially causing reputational harm to the NNR and South African government through implying, in an article for <i>Energize </i>magazine on 10 June 2021, that safety concerns may have been ignored in the restarting of reactor 1 at Koeberg Nuclear Power Station;</li>\r\n \t<li>Implying that members of the NNR board would ignore their fiduciary and statutory obligations, by suggesting in an email to the chairperson of the NNR on 27 July 2021 that the board’s approval of the replacement of the steam generators at Koeberg could mean that the board is not able to make an unbiased decision on whether the life of the power station should be extended;</li>\r\n \t<li>Potentially causing reputational harm to the NNR and the government by publicly speaking out against the extension of Koeberg’s lifespan, in such a way that implies the board and government will not properly carry out their obligations.</li>\r\n</ul>\r\n<p style=\"margin: 12px auto 6px auto; font-family: Helvetica,Arial,Sans-serif; font-style: normal; font-variant: normal; font-weight: normal; font-size: 14px; line-height: normal; font-size-adjust: none; font-stretch: normal; -x-system-font: none; display: block;\"> <a style=\"text-decoration: underline;\" title=\"View 2022 02 15 - Letter From the Minister to Mr P Becker (Co Chennells Albertyn)-OCR (1) on Scribd\" href=\"https://www.scribd.com/document/559514941/2022-02-15-Letter-From-the-Minister-to-Mr-P-Becker-Co-Chennells-Albertyn-OCR-1#from_embed\">2022 02 15 - Letter From the Minister to Mr P Becker (Co Chennells Albertyn)-OCR (1)</a> by <a style=\"text-decoration: underline;\" title=\"View janet's profile on Scribd\" href=\"https://www.scribd.com/user/389811916/janet#from_embed\">janet</a> on Scribd</p>\r\n<iframe id=\"doc_39759\" class=\"scribd_iframe_embed\" title=\"2022 02 15 - Letter From the Minister to Mr P Becker (Co Chennells Albertyn)-OCR (1)\" src=\"https://www.scribd.com/embeds/559514941/content?start_page=1&view_mode=scroll&access_key=key-jY3WF9dCGomJCuCwZxqm\" width=\"100%\" height=\"600\" frameborder=\"0\" scrolling=\"no\" data-auto-height=\"false\" data-aspect-ratio=\"0.75\"></iframe>\r\n\r\n<span style=\"font-weight: 400;\">In detailing these allegations, Mantashe mentioned Becker’s role as spokesperson of the Koeberg Alert Alliance, an anti-nuclear organisation. </span>\r\n\r\n<span style=\"font-weight: 400;\">“It appears to me that you may be impossibly conflicted in your respective roles, as an anti-nuclear activist, and as a member of the Board,” said Mantashe.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker, however, contended that having a variety of opinions on the NNR board is a source of strength. He pointed out that the board includes a representative of the DMRE, which is known to be pro-nuclear.</span>\r\n\r\n<span style=\"font-weight: 400;\">“At least I was the voice there to put an alternative view forward, […] not about whether nuclear is good or bad, but about how cautious we should be,” said Becker.</span>\r\n\r\n<span style=\"font-weight: 400;\">Speaking at Thursday’s protest, De Gasparis said, “We’re really concerned [about] this idea that if you’re anti-nuclear energy, and you’re representing community voices, that the National Nuclear Regulator wouldn’t want you on the board, and that the Minister has said that’s one of the key reasons why he doesn’t want the current community representative on the board.”</span>\r\n\r\n<span style=\"font-weight: 400;\">“Surely, the issue that we’re faced with is you want someone who is critical and concerned about the impact of nuclear energy on communities on the board,” she continued. “And what we’re seeing is an actual removal of that person.” </span><b>DM</b>",
