"contents": "<span style=\"font-weight: 400;\">The</span><span style=\"font-weight: 400;\"> Constitution confers the right on </span><a href=\"https://www.gov.za/documents/constitution/chapter-2-bill-rights#27\"><span style=\"font-weight: 400;\">“everyone”</span></a><span style=\"font-weight: 400;\"> to have access to health care services, including reproductive health care. This right accrues to everyone within South Africa’s borders and </span><a href=\"http://www.saflii.org/za/cases/ZACC/2004/11.pdf\"><span style=\"font-weight: 400;\">“cannot be construed as referring to citizens”</span></a><span style=\"font-weight: 400;\">. Parliament has left the power to the Minister of Health and healthcare institutions to adopt policies </span><a href=\"https://thought-leadership.azureedge.net/website/attachments/ck1j9eskz00lp0hpe5vw7n6tq-1-explanantion-of-the-current-policy-regarding-the-classification-of-patients-for-the-determination-of-fees.pdf\"><span style=\"font-weight: 400;\">prescribing patient classification</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://archive.opengazettes.org.za/archive/ZA-WC/2019/provincial-gazette-ZA-WC-no-8069-dated-2019-03-29.pdf\"><span style=\"font-weight: 400;\">fee conditions</span></a> <span style=\"font-weight: 400;\">for healthcare services. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, the prevailing laws and policies provide contradictory guidance to </span><span style=\"font-weight: 400;\">medical staff and often result in non-nationals facing unlawful </span><a href=\"https://www.hrw.org/sites/default/files/reports/SAwithcover.pdf\"><span style=\"font-weight: 400;\">barriers</span></a><span style=\"font-weight: 400;\"> to accessing health care services.</span>\r\n\r\n<span style=\"font-weight: 400;\">The recent World Health Organization </span><a href=\"https://www.who.int/teams/health-and-migration-programme/world-report-on-the-health-of-refugees-and-migrants\"><span style=\"font-weight: 400;\">Report on the Health of Refugees and Migrants</span></a><span style=\"font-weight: 400;\"> has called for the prioritisation of the health needs of non-nationals as a global human right to health imperative. Viewing healthcare as a universal right requires South Africa’s current healthcare laws and policies to be </span><a href=\"https://scholar.sun.ac.za/bitstream/handle/10019.1/104903/kavuro_refugees_2018.pdf?sequence=2&isAllowed=y\"><span style=\"font-weight: 400;\">harmonised with fundamental human rights standards</span></a><span style=\"font-weight: 400;\"> that are refugee- and migrant-sensitive and inclusive</span><span style=\"font-weight: 400;\">.</span><span style=\"font-weight: 400;\"> The contours of such an approach are sketched in this article. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1388213\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/09/MC-Health-Borders_2.jpg\" alt=\"healthcare\" width=\"720\" height=\"404\" /> Discrimination against non-nationals in the context of health care services could thus potentially amount to unfair discrimination, according to the authors. (Photo: EPA-EFE / NIC BOTHMA)</p>\r\n<h4><b>Constitutional rights and international human rights law</b></h4>\r\n<span style=\"font-weight: 400;\">To fulfil the constitutional right of everyone to access healthcare services, the State must take </span><a href=\"https://www.gov.za/documents/constitution/chapter-2-bill-rights#27\"><span style=\"font-weight: 400;\">“reasonable legislative and other measures, within its available resources, to achieve the progressive realisation”</span></a><span style=\"font-weight: 400;\">. The Constitution also guarantees that “no one may be deprived of emergency medical treatment”. </span>\r\n\r\n<span style=\"font-weight: 400;\">In addition, “all children” have a right to “basic health care services” and prisoners and other persons deprived of their liberty have the “right to medical treatment”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The right to health provisions must </span><a href=\"http://www.saflii.org/za/cases/ZACC/2020/24.pdf\"><span style=\"font-weight: 400;\">also be read together with</span></a><span style=\"font-weight: 400;\"> the right to equality and non-discrimination in section 9 of the Constitution. Equality is defined in the Constitution to include “the full and equal enjoyment of all rights and freedoms”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Constitutional Court has recognised </span><a href=\"http://www.saflii.org/za/cases/ZACC/1997/16.pdf\"><span style=\"font-weight: 400;\">citizenship</span></a><span style=\"font-weight: 400;\"> as a ground of discrimination as non-nationals are a </span><a href=\"http://www.saflii.org/za/cases/ZACC/2006/23.pdf\"><span style=\"font-weight: 400;\">“vulnerable group of people” and “discrimination against them will often impair their dignity or their rights in a serious manner.”</span></a><span style=\"font-weight: 400;\"> Discrimination against non-nationals in the context of health care services could thus </span><a href=\"http://www.saflii.org/za/cases/ZACC/2004/11.pdf\"><span style=\"font-weight: 400;\">potentially amount to unfair discrimination</span></a><span style=\"font-weight: 400;\"> thereby infringing section 9 of the Constitution read with legislation such as the </span><a href=\"https://www.justice.gov.za/legislation/acts/2000-004.pdf\"><span style=\"font-weight: 400;\">Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">It is also important to interpret constitutional rights in the context of South Africa’s obligations under </span><a href=\"https://www.gov.za/documents/constitution-republic-south-africa-1996-chapter-14-general-provisions#231\"><span style=\"font-weight: 400;\">international</span></a><span style=\"font-weight: 400;\"> human rights law. </span>\r\n\r\n<span style=\"font-weight: 400;\">For example, the International Covenant on Economic, Social and Cultural Rights </span><span style=\"font-weight: 400;\">recognises the right of </span><a href=\"https://www.ohchr.org/en/instruments-mechanisms/instruments/international-covenant-economic-social-and-cultural-rights\"><span style=\"font-weight: 400;\">“everyone”</span></a><span style=\"font-weight: 400;\"> to enjoy the highest attainable standard of physical and mental health. Furthermore, it prohibits any </span><a href=\"https://www.refworld.org/pdfid/4538838d0.pdf\"><span style=\"font-weight: 400;\">discriminatory access</span></a><span style=\"font-weight: 400;\"> to health care services on the </span><a href=\"https://www.right-to-education.org/sites/right-to-education.org/files/resource-attachments/CERD_GC_30_2004_EN.pdf\"><span style=\"font-weight: 400;\">basis of nationality</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">In the African context, </span><a href=\"https://au.int/sites/default/files/treaties/36400-treaty-0005_-_oau_convention_governing_the_specific_aspects_of_refugee_problems_in_africa_e.pdf\"><span style=\"font-weight: 400;\">relevant treaties</span></a><span style=\"font-weight: 400;\"> require South Africa</span><span style=\"font-weight: 400;\"> to accept that the fulfilment of the health needs of </span><a href=\"https://www.achpr.org/public/Document/file/English/ACHPR-Res%20470.%20Resolution%20on%20the%20Protection%20of%20Refugees,%20Asylum%20Seekers.docx\"><span style=\"font-weight: 400;\">African refugees and migrants</span></a><span style=\"font-weight: 400;\"> is the </span><a href=\"https://www.ifrc.org/docs/IDRL/Southern%20African%20Development%20Community.pdf\"><span style=\"font-weight: 400;\">shared responsibility</span></a><span style=\"font-weight: 400;\"> of African states.</span>\r\n<h4><b>Legislation and policy</b></h4>\r\n<span style=\"font-weight: 400;\">In terms of the </span><a href=\"https://www.gov.za/documents/refugees-act\"><span style=\"font-weight: 400;\">Refugees Act</span></a><span style=\"font-weight: 400;\">, asylum seekers and refugees are entitled to the same human rights as citizens and permanent residents. This would include the right to health care services. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/documents/national-health-act\"><span style=\"font-weight: 400;\">National Health Act</span></a><span style=\"font-weight: 400;\"> (NHA) stipulates that services for pregnant and breastfeeding women and children under seven must be delivered free of charge, irrespective of nationality and migrant status. The NHA also entitles everyone to access free primary healthcare services, including people with infectious diseases such as HIV and TB. </span>\r\n\r\n<span style=\"font-weight: 400;\">Beyond primary and basic healthcare services, the NHA empowers the Minister to differentiate between groups of non-nationals to allocate resources for hospital and specialised treatment. Currently, these healthcare services are reserved only for citizens, certain categories of migrants and undocumented migrants from </span><a href=\"https://www.ifrc.org/docs/IDRL/Southern%20African%20Development%20Community.pdf\"><span style=\"font-weight: 400;\">South African Development Community</span></a><span style=\"font-weight: 400;\"> (SADC) countries. </span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">The current legislative and policy framework for regulating non-nationals’ access to healthcare services are a patchwork of provisions that are not well aligned with the human right to health in the Constitution and international human rights law. For example, undocumented migrants not from SADC countries are automatically charged the highest rate of facility fees. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/documents/immigration-act\"><span style=\"font-weight: 400;\">Immigration Act</span></a><span style=\"font-weight: 400;\"> also places a worrying obligation on medical practitioners to determine the legal status of a patient before providing care. This is not aligned with constitutional and international health standards that basic healthcare services, including emergency medical services, must be available to all, </span><a href=\"https://www.ohchr.org/Documents/Issues/Migration/CESCR_Statement_24Feb2017_E.docx\"><span style=\"font-weight: 400;\">irrespective of legal status</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">The NGO, Section27, has </span><a href=\"https://section27.org.za/2022/06/maternal-and-child-health-case-june-2022/\"><span style=\"font-weight: 400;\">instituted court proceedings</span></a><span style=\"font-weight: 400;\"> to declare the Gauteng Department of Health’s policies unconstitutional and discriminatory for barring non-national pregnant and lactating women, and children under six from receiving free healthcare services to which they are entitled.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1388214\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/09/MC-Health-Borders_3.jpg\" alt=\"healthcare\" width=\"720\" height=\"431\" /> In the African context, relevant treaties require South Africa to accept that the fulfilment of the health needs of African refugees and migrants is the shared responsibility of African states, say the authors. (Photo: Gallo Images / Alet Pretorius)</p>\r\n<h4><b>A comprehensive human rights-based framework needed</b></h4>\r\n<span style=\"font-weight: 400;\">It is essential that the State adopt a </span><a href=\"http://www.saflii.org/za/cases/ZACC/2000/19.pdf\"><span style=\"font-weight: 400;\">comprehensive and coordinated</span></a><span style=\"font-weight: 400;\"> legislative and policy framework for regulating access to healthcare services by non-nationals. This framework should give effect to the constitutional obligation of the State to eliminate barriers that prevent the enjoyment of a right. It should also reflect the positive obligation of the State to take steps that will progressively secure and achieve non-nationals’ right to healthcare services. Such a programme should include participation by non-nationals and set clear standards for financing, planning, implementation, monitoring and evaluation. </span>\r\n\r\n<span style=\"font-weight: 400;\">The State must also look at </span><a href=\"https://www.dailymaverick.co.za/article/2022-08-28-limpopo-health-mecs-berating-of-zimbabwean-patient-is-appalling-and-shameful/\"><span style=\"font-weight: 400;\">burden-sharing and fairer resource redistribution</span></a><span style=\"font-weight: 400;\"> between provinces as some regions share a disproportionate burden of addressing the health care needs of non-nationals.</span>\r\n\r\n<span style=\"font-weight: 400;\">If the State wants to </span><a href=\"https://www.refworld.org/pdfid/4538838e10.pdf\"><span style=\"font-weight: 400;\">invoke the lack of resources</span></a><span style=\"font-weight: 400;\"> as a justification for restricting non-national’s right to health, they will have to give </span><a href=\"http://www.saflii.org/za/cases/ZACC/2002/15.html\"><span style=\"font-weight: 400;\">compelling reasons</span></a><span style=\"font-weight: 400;\"> and evidence. Importantly, they will have to show that the restriction is not excluding vulnerable groups of non-nationals or discriminating unfairly against them. </span>\r\n\r\n<span style=\"font-weight: 400;\">The state will also have to show that </span><a href=\"http://www.saflii.org/za/cases/ZASCA/2003/142.pdf\"><span style=\"font-weight: 400;\">each person’s inherent dignity and worth are respected</span></a><span style=\"font-weight: 400;\">, irrespective of their legal status. In addition, they will have to show that the unqualified right to emergency medical treatment is not compromised. The State should educate healthcare service providers on the health rights of non-nationals, and clarify procedures for dealing with non-nationals in the different tiers of the healthcare system. </span>\r\n<h4><b>International assistance and co-operation</b></h4>\r\n<span style=\"font-weight: 400;\">Seeking </span><a href=\"https://www.ohchr.org/Documents/Issues/Migration/CESCR_Statement_24Feb2017_E.docx\"><span style=\"font-weight: 400;\">international assistance</span></a><span style=\"font-weight: 400;\"> and engaging in cooperation with other States is an important part of South Africa’s international obligations in realising the right of access to health care services for all.</span> <span style=\"font-weight: 400;\">Economically developed states have </span><a href=\"https://www.refworld.org/pdfid/4538838d0.pdf\"><span style=\"font-weight: 400;\">a special responsibility</span></a><span style=\"font-weight: 400;\"> to assist developing states such as South Africa in securing health care as a universal right for non-nationals. International cooperation and burden-sharing across borders and continents are </span><a href=\"https://www.who.int/teams/health-and-migration-programme/world-report-on-the-health-of-refugees-and-migrants\"><span style=\"font-weight: 400;\">essential for strengthening healthcare systems</span></a><span style=\"font-weight: 400;\"> to address common challenges such as migration and refugee flows. </span>\r\n\r\n<span style=\"font-weight: 400;\">A coordinated and human rights-informed policy and legislative framework is urgently required to give effect to the right of non-nationals to health careservices. Parliament has left the power to the Minister of Health and healthcare institutions to adopt policies </span><a href=\"https://thought-leadership.azureedge.net/website/attachments/ck1j9eskz00lp0hpe5vw7n6tq-1-explanantion-of-the-current-policy-regarding-the-classification-of-patients-for-the-determination-of-fees.pdf\"><span style=\"font-weight: 400;\">prescribing patient classification</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://archive.opengazettes.org.za/archive/ZA-WC/2019/provincial-gazette-ZA-WC-no-8069-dated-2019-03-29.pdf\"><span style=\"font-weight: 400;\">fee conditions</span></a> <span style=\"font-weight: 400;\">for healthcare services. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, the prevailing laws and policies provide contradictory guidance to </span><span style=\"font-weight: 400;\">medical staff and often result in non-nationals facing unlawful </span><a href=\"https://www.hrw.org/sites/default/files/reports/SAwithcover.pdf\"><span style=\"font-weight: 400;\">barriers</span></a><span style=\"font-weight: 400;\"> to accessing health care services.</span>\r\n\r\n<span style=\"font-weight: 400;\">The recent World Health Organization </span><a href=\"https://www.who.int/teams/health-and-migration-programme/world-report-on-the-health-of-refugees-and-migrants\"><span style=\"font-weight: 400;\">Report on the Health of Refugees and Migrants</span></a><span style=\"font-weight: 400;\"> has called for the prioritisation of the health needs of non-nationals as a global human right to health imperative. Viewing healthcare as a universal right requires South Africa’s current healthcare laws and policies to be </span><a href=\"https://scholar.sun.ac.za/bitstream/handle/10019.1/104903/kavuro_refugees_2018.pdf?sequence=2&isAllowed=y\"><span style=\"font-weight: 400;\">harmonised with fundamental human rights standards</span></a><span style=\"font-weight: 400;\"> that are refugee- and migrant-sensitive and inclusive</span><span style=\"font-weight: 400;\">.</span><span style=\"font-weight: 400;\"> The contours of such an approach are sketched in this article. </span>\r\n\r\n[caption id=\"attachment_1388213\" align=\"aligncenter\" width=\"720\"]<img class=\"size-full wp-image-1388213\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/09/MC-Health-Borders_2.jpg\" alt=\"healthcare\" width=\"720\" height=\"404\" /> Discrimination against non-nationals in the context of health care services could thus potentially amount to unfair discrimination, according to the authors. (Photo: EPA-EFE / NIC BOTHMA)[/caption]\r\n<h4><b>Constitutional rights and international human rights law</b></h4>\r\n<span style=\"font-weight: 400;\">To fulfil the constitutional right of everyone to access healthcare services, the State must take </span><a href=\"https://www.gov.za/documents/constitution/chapter-2-bill-rights#27\"><span style=\"font-weight: 400;\">“reasonable legislative and other measures, within its available resources, to achieve the progressive realisation”</span></a><span style=\"font-weight: 400;\">. The Constitution also guarantees that “no one may be deprived of emergency medical treatment”. </span>\r\n\r\n<span style=\"font-weight: 400;\">In addition, “all children” have a right to “basic health care services” and prisoners and other persons deprived of their liberty have the “right to medical treatment”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The right to health provisions must </span><a href=\"http://www.saflii.org/za/cases/ZACC/2020/24.pdf\"><span style=\"font-weight: 400;\">also be read together with</span></a><span style=\"font-weight: 400;\"> the right to equality and non-discrimination in section 9 of the Constitution. Equality is defined in the Constitution to include “the full and equal enjoyment of all rights and freedoms”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Constitutional Court has recognised </span><a href=\"http://www.saflii.org/za/cases/ZACC/1997/16.pdf\"><span style=\"font-weight: 400;\">citizenship</span></a><span style=\"font-weight: 400;\"> as a ground of discrimination as non-nationals are a </span><a href=\"http://www.saflii.org/za/cases/ZACC/2006/23.pdf\"><span style=\"font-weight: 400;\">“vulnerable group of people” and “discrimination against them will often impair their dignity or their rights in a serious manner.”</span></a><span style=\"font-weight: 400;\"> Discrimination against non-nationals in the context of health care services could thus </span><a href=\"http://www.saflii.org/za/cases/ZACC/2004/11.pdf\"><span style=\"font-weight: 400;\">potentially amount to unfair discrimination</span></a><span style=\"font-weight: 400;\"> thereby infringing section 9 of the Constitution read with legislation such as the </span><a href=\"https://www.justice.gov.za/legislation/acts/2000-004.pdf\"><span style=\"font-weight: 400;\">Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">It is also important to interpret constitutional rights in the context of South Africa’s obligations under </span><a href=\"https://www.gov.za/documents/constitution-republic-south-africa-1996-chapter-14-general-provisions#231\"><span style=\"font-weight: 400;\">international</span></a><span style=\"font-weight: 400;\"> human rights law. </span>\r\n\r\n<span style=\"font-weight: 400;\">For example, the International Covenant on Economic, Social and Cultural Rights </span><span style=\"font-weight: 400;\">recognises the right of </span><a href=\"https://www.ohchr.org/en/instruments-mechanisms/instruments/international-covenant-economic-social-and-cultural-rights\"><span style=\"font-weight: 400;\">“everyone”</span></a><span style=\"font-weight: 400;\"> to enjoy the highest attainable standard of physical and mental health. Furthermore, it prohibits any </span><a href=\"https://www.refworld.org/pdfid/4538838d0.pdf\"><span style=\"font-weight: 400;\">discriminatory access</span></a><span style=\"font-weight: 400;\"> to health care services on the </span><a href=\"https://www.right-to-education.org/sites/right-to-education.org/files/resource-attachments/CERD_GC_30_2004_EN.pdf\"><span style=\"font-weight: 400;\">basis of nationality</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">In the African context, </span><a href=\"https://au.int/sites/default/files/treaties/36400-treaty-0005_-_oau_convention_governing_the_specific_aspects_of_refugee_problems_in_africa_e.pdf\"><span style=\"font-weight: 400;\">relevant treaties</span></a><span style=\"font-weight: 400;\"> require South Africa</span><span style=\"font-weight: 400;\"> to accept that the fulfilment of the health needs of </span><a href=\"https://www.achpr.org/public/Document/file/English/ACHPR-Res%20470.%20Resolution%20on%20the%20Protection%20of%20Refugees,%20Asylum%20Seekers.docx\"><span style=\"font-weight: 400;\">African refugees and migrants</span></a><span style=\"font-weight: 400;\"> is the </span><a href=\"https://www.ifrc.org/docs/IDRL/Southern%20African%20Development%20Community.pdf\"><span style=\"font-weight: 400;\">shared responsibility</span></a><span style=\"font-weight: 400;\"> of African states.</span>\r\n<h4><b>Legislation and policy</b></h4>\r\n<span style=\"font-weight: 400;\">In terms of the </span><a href=\"https://www.gov.za/documents/refugees-act\"><span style=\"font-weight: 400;\">Refugees Act</span></a><span style=\"font-weight: 400;\">, asylum seekers and refugees are entitled to the same human rights as citizens and permanent residents. This would include the right to health care services. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/documents/national-health-act\"><span style=\"font-weight: 400;\">National Health Act</span></a><span style=\"font-weight: 400;\"> (NHA) stipulates that services for pregnant and breastfeeding women and children under seven must be delivered free of charge, irrespective of nationality and migrant status. The NHA also entitles everyone to access free primary healthcare services, including people with infectious diseases such as HIV and TB. </span>\r\n\r\n<span style=\"font-weight: 400;\">Beyond primary and basic healthcare services, the NHA empowers the Minister to differentiate between groups of non-nationals to allocate resources for hospital and specialised treatment. Currently, these healthcare services are reserved only for citizens, certain categories of migrants and undocumented migrants from </span><a href=\"https://www.ifrc.org/docs/IDRL/Southern%20African%20Development%20Community.pdf\"><span style=\"font-weight: 400;\">South African Development Community</span></a><span style=\"font-weight: 400;\"> (SADC) countries. </span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">The current legislative and policy framework for regulating non-nationals’ access to healthcare services are a patchwork of provisions that are not well aligned with the human right to health in the Constitution and international human rights law. For example, undocumented migrants not from SADC countries are automatically charged the highest rate of facility fees. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/documents/immigration-act\"><span style=\"font-weight: 400;\">Immigration Act</span></a><span style=\"font-weight: 400;\"> also places a worrying obligation on medical practitioners to determine the legal status of a patient before providing care. This is not aligned with constitutional and international health standards that basic healthcare services, including emergency medical services, must be available to all, </span><a href=\"https://www.ohchr.org/Documents/Issues/Migration/CESCR_Statement_24Feb2017_E.docx\"><span style=\"font-weight: 400;\">irrespective of legal status</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">The NGO, Section27, has </span><a href=\"https://section27.org.za/2022/06/maternal-and-child-health-case-june-2022/\"><span style=\"font-weight: 400;\">instituted court proceedings</span></a><span style=\"font-weight: 400;\"> to declare the Gauteng Department of Health’s policies unconstitutional and discriminatory for barring non-national pregnant and lactating women, and children under six from receiving free healthcare services to which they are entitled.</span>\r\n\r\n[caption id=\"attachment_1388214\" align=\"aligncenter\" width=\"720\"]<img class=\"size-full wp-image-1388214\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/09/MC-Health-Borders_3.jpg\" alt=\"healthcare\" width=\"720\" height=\"431\" /> In the African context, relevant treaties require South Africa to accept that the fulfilment of the health needs of African refugees and migrants is the shared responsibility of African states, say the authors. (Photo: Gallo Images / Alet Pretorius)[/caption]\r\n<h4><b>A comprehensive human rights-based framework needed</b></h4>\r\n<span style=\"font-weight: 400;\">It is essential that the State adopt a </span><a href=\"http://www.saflii.org/za/cases/ZACC/2000/19.pdf\"><span style=\"font-weight: 400;\">comprehensive and coordinated</span></a><span style=\"font-weight: 400;\"> legislative and policy framework for regulating access to healthcare services by non-nationals. This framework should give effect to the constitutional obligation of the State to eliminate barriers that prevent the enjoyment of a right. It should also reflect the positive obligation of the State to take steps that will progressively secure and achieve non-nationals’ right to healthcare services. Such a programme should include participation by non-nationals and set clear standards for financing, planning, implementation, monitoring and evaluation. </span>\r\n\r\n<span style=\"font-weight: 400;\">The State must also look at </span><a href=\"https://www.dailymaverick.co.za/article/2022-08-28-limpopo-health-mecs-berating-of-zimbabwean-patient-is-appalling-and-shameful/\"><span style=\"font-weight: 400;\">burden-sharing and fairer resource redistribution</span></a><span style=\"font-weight: 400;\"> between provinces as some regions share a disproportionate burden of addressing the health care needs of non-nationals.</span>\r\n\r\n<span style=\"font-weight: 400;\">If the State wants to </span><a href=\"https://www.refworld.org/pdfid/4538838e10.pdf\"><span style=\"font-weight: 400;\">invoke the lack of resources</span></a><span style=\"font-weight: 400;\"> as a justification for restricting non-national’s right to health, they will have to give </span><a href=\"http://www.saflii.org/za/cases/ZACC/2002/15.html\"><span style=\"font-weight: 400;\">compelling reasons</span></a><span style=\"font-weight: 400;\"> and evidence. Importantly, they will have to show that the restriction is not excluding vulnerable groups of non-nationals or discriminating unfairly against them. </span>\r\n\r\n<span style=\"font-weight: 400;\">The state will also have to show that </span><a href=\"http://www.saflii.org/za/cases/ZASCA/2003/142.pdf\"><span style=\"font-weight: 400;\">each person’s inherent dignity and worth are respected</span></a><span style=\"font-weight: 400;\">, irrespective of their legal status. In addition, they will have to show that the unqualified right to emergency medical treatment is not compromised. The State should educate healthcare service providers on the health rights of non-nationals, and clarify procedures for dealing with non-nationals in the different tiers of the healthcare system. </span>\r\n<h4><b>International assistance and co-operation</b></h4>\r\n<span style=\"font-weight: 400;\">Seeking </span><a href=\"https://www.ohchr.org/Documents/Issues/Migration/CESCR_Statement_24Feb2017_E.docx\"><span style=\"font-weight: 400;\">international assistance</span></a><span style=\"font-weight: 400;\"> and engaging in cooperation with other States is an important part of South Africa’s international obligations in realising the right of access to health care services for all.</span> <span style=\"font-weight: 400;\">Economically developed states have </span><a href=\"https://www.refworld.org/pdfid/4538838d0.pdf\"><span style=\"font-weight: 400;\">a special responsibility</span></a><span style=\"font-weight: 400;\"> to assist developing states such as South Africa in securing health care as a universal right for non-nationals. International cooperation and burden-sharing across borders and continents are </span><a href=\"https://www.who.int/teams/health-and-migration-programme/world-report-on-the-health-of-refugees-and-migrants\"><span style=\"font-weight: 400;\">essential for strengthening healthcare systems</span></a><span style=\"font-weight: 400;\"> to address common challenges such as migration and refugee flows. </span>\r\n\r\n<span style=\"font-weight: 400;\">A coordinated and human rights-informed policy and legislative framework is urgently required to give effect to the right of non-nationals to health careservices.
