Jiba and Mrwebi are on suspension pending the outcome of the inquiry.</span></span>\r\n<p align=\"LEFT\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">On Tuesday</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">, 29 January</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">, Glynnis Breytenbach, a former senior prosecutor under Mzinyathi, <a href=\"https://www.dailymaverick.co.za/article/2019-01-30-breytenbach-tells-of-days-of-darkness-at-npa/\">testified</a> </span></span><a href=\"https://www.dailymaverick.co.za/article/2019-01-30-breytenbach-tells-of-days-of-darkness-at-npa/\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">regarding</span></span></span></a><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><a href=\"https://www.dailymaverick.co.za/article/2019-01-30-breytenbach-tells-of-days-of-darkness-at-npa/\"> the circumstances</a> leading to her ousting at the NPA. </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">She said</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> Jiba and Mrwebi </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">had</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> gone to extreme lengths to ensure that the case against Mdluli did not make it to court.</span></span></p>\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">On Wednesday, Mzinyathi testified </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">that</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> Mrwebi, the then newly appointed head of the </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">SCCU, had</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> arrived </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">at</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> his office on 5 December 2011</span></span> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">to discuss the Mdluli case.</span></span>\r\n\r\n“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">He told me</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\"> that</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> in terms of the NPA </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">A</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">ct, a Special Director need</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">ed</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> to consult with a DPP when he need</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">ed</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> to make a decision,” said Mzinyathi.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Mrwebi, Mzinyathi said, was of the view that the case should be dropped</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">,</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> claiming that there was not enough evidence</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">. But h</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">e</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\"> had</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> argued that there was a prima facie case for the Crime Intelligence boss to answer</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">, said </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Mzinyathi.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Mrwebi </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">had </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">left without the two coming to a consensus</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">, </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Mzinyathi</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\"> said,</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> and he</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\"> had</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> believed that the SCCU boss was going to canvas</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">s</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> further opinion in the NPA.</span></span>\r\n\r\n“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">We parted on the understanding that he </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">was</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> still going to do some research and he </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">was</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> still going to come back to me for further discussions</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">.”</span></span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">However, on 6 December, a day after their meeting, Mzinyathi said he received two memos, one addressed to him</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">self</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> and the other to Breytenbach</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">,</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> in which Mrwebi informed them that he had decided the case should be withdrawn.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The memos were dated 4 December – the day before Mrwebi </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">had </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">“consulted” him, Mzinyathi testified.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">He later came to realise that Mrwebi's “consultation” visit was simply aimed at fulfilling a policy obligation rather than to reach a consensus on the matter.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">According to Mzinyathi, he and Breytenbach held a joint meeting with Mrwebi on 9 December to try </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">to</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> persuade him not to withdraw the case. </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">He </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">again informed Mrwebi that he did not share his view</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">, saying</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> the NPA had a prosecutable case.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">At that time, Menzi Simelani’s appointment as </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">the </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">head of NPA had </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">recently</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> been set aside by the court and the position was still vacant. This meant there was no senior director to mediate the impasse between the two equally ranked directors.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Mrwebi, Mzinyathi testified, </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">said</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> he could not reverse the decision as he had already sent a letter to Mdluli</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">’</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">s attorneys </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">saying</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> the case had been dropped. </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">H</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">e had also instructed Chris Smith, the advocate handling the Mdluli case, to remove it from the court’s role.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Breytenbach still </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">strongly believed</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> that there was a good case to prosecute. However, Mzinyathi said it would be an embarrassment if two senior prosecutors were to give a junior prosecutor conflicting instructions in court. As a compromise, it was decided that Smith would make a “provisional withdrawal” of the case pending further investigation.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Shortly thereafter, Breytenbach was suspended by Jiba, who had been appointed</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\"> the</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> acting head of </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">the </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">NPA.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Since then the case against Mdluli has been in limbo.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Attempts by </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><i>Daily Maverick</i></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> to get an update on the case and the application for documents to be declassified were unsuccessful on Wednesday. </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u><b>DM</b></u></span></span>",
