"contents": "<span style=\"font-weight: 400;\">This emerged following a Necsa board meeting on Thursday, 28 May, where the board authorised its chairman, David Nicholls, to approach the minister of minerals and energy, Gwede Mantashe, to seek the reappointment of Tshelane as a consultant to Necsa on a limited-term contract.</span>\r\n\r\n<span style=\"font-weight: 400;\">When asked for comment, Mantashe indicated that he is not a member of the Necsa board and is unaware of the details. However, he confirmed that the proposed reappointment was raised with him on Friday 29 May by the Necsa chairman, and that a meeting to address the matter has been scheduled for this week.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is understood that, at this stage, the consulting contract envisaged by the Necsa board for former CEO Tshelane would be for a term of about six months. His first task would be to make progress on the establishment of a state-owned pharmaceutical company, </span><a href=\"http://www.ketlaphela.co.za/\"><span style=\"font-weight: 400;\">Ketlaphela Pharmaceuticals</span></a><span style=\"font-weight: 400;\">, to manufacture anti-retroviral (ARV) drugs in South Africa.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ketlaphela Pharmaceuticals is a subsidiary of Pelchem, a company in deep financial distress. Pelchem, in turn, is a wholly-owned subsidiary of the Necsa Group, a company itself in severe financial distress, that received a </span><a href=\"https://www.ee.co.za/wp-content/uploads/2019/07/Necsa-Annual-Report-2018-120-126.pdf\"><span style=\"font-weight: 400;\">damning qualified audit in its 2017/18 financial year</span></a><span style=\"font-weight: 400;\">, and </span><a href=\"https://www.ee.co.za/wp-content/uploads/2020/03/Necsa-AG-report-2019-pages-137-143.pdf\"><span style=\"font-weight: 400;\">again in 2018/19</span></a><span style=\"font-weight: 400;\">, from the Auditor General.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Necsa group undertakes R&D and commercial activities in the field of nuclear energy and radiation sciences, and produces medical nuclear radioisotopes and associated services. Necsa is also responsible for processing source material, including uranium enrichment, nuclear waste disposal and co-operating with other institutions, locally and abroad, on nuclear and related matters.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-638543\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/Yelland-necsa-reappoint-option-1.jpg\" alt=\"\" width=\"2000\" height=\"1000\" /> Phumzile Tshelane. (Photo: Flickr/La Société Française d’Energie Nucléaire)</p>\r\n\r\n<span style=\"font-weight: 400;\">Sources indicate that Finance Minister Tito Mboweni is sitting on a proposal to give Ketlaphela Pharmaceuticals a two-year monopoly for the import of ARVs from India into South Africa, while arrangements are made with the Indian ARV supplier to set up a local ARV manufacturing facility in South Africa.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is well known that there is a </span><a href=\"https://www.ee.co.za/article/pyrrhic-victory-for-fired-former-necsa-board-members.html\"><span style=\"font-weight: 400;\">longstanding dispute</span></a><span style=\"font-weight: 400;\"> between Necsa and its former CEO, who was suspended in December 2018 by former energy minister Jeff Radebe, when he dismissed the entire board of Necsa at the time, including then board chairman, Kelvin Kemm. </span>\r\n\r\n<span style=\"font-weight: 400;\">Kemm, Tshelane and another former board member, Pamela Bosman, who had been </span><a href=\"https://www.pressreader.com/south-africa/daily-dispatch/20180616/281479277127074\"><span style=\"font-weight: 400;\">convicted of fraud</span></a><span style=\"font-weight: 400;\"> in June 2018 and was subsequently appealing her conviction, challenged the dismissal of the Necsa board and the suspension of Tshelane by Radebe in the Pretoria High Court.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, despite finding that due procedure had not been followed by then minister Radebe in his removal of the board, the </span><a href=\"https://www.ee.co.za/article/pyrrhic-victory-for-fired-former-necsa-board-members.html\"><span style=\"font-weight: 400;\">judge dismissed Tshelane’s application</span></a><span style=\"font-weight: 400;\"> for his suspension as CEO of Necsa to be lifted. The minister was not found to have acted </span><i><span style=\"font-weight: 400;\">ultra vires</span></i><span style=\"font-weight: 400;\">, nor did the judge find that Radebe had ulterior motives in the actions that he took, as alleged by the applicants.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Hasty he definitely was, but [this was] in pursuance of restoring the stature of Necsa as an institution,” ruled Judge Mtati.</span>\r\n<blockquote><span style=\"font-weight: 400;\">Necsa chairman David Nicholls has flatly denied that an amount of R13-million, or indeed any amount, has been discussed or agreed upon as remuneration to Tshelane for a limited-term consulting contract with Necsa of about six months. </span></blockquote>\r\n<span style=\"font-weight: 400;\">Following the </span><a href=\"https://www.ee.co.za/wp-content/uploads/2019/08/Judment-Kemm-Bosman-Tshelane-vs-minister-of-energy.pdf\"><span style=\"font-weight: 400;\">judgement on 16 August 2019</span></a><span style=\"font-weight: 400;\">, the new Necsa board instituted disciplinary action against the suspended CEO and Tshelane was subsequently fired. However, ongoing legal actions by Tshelane have continued in further efforts by him to be reinstated.</span>\r\n\r\n<span style=\"font-weight: 400;\">Necsa chairman David Nicholls has acknowledged that the board had considered offering its former CEO a substantial sum in settlement of all issues and litigation. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",
