"contents": "<span style=\"font-weight: 400;\">The first three months of 2022 were “</span><a href=\"https://www.gov.za/speeches/minister-bheki-cele-release-quarter-four-crime-statistics-202122-3-jun-2022-0000\"><span style=\"font-weight: 400;\">especially brutal for (the) women and children of this country</span></a><span style=\"font-weight: 400;\">”. These are the words of the Minister of Police, Bheki Cele, while reflecting on the most recent crime statistics. They revealed that from January to March of 2022, attempted murder and assault of women had a double-digit increase, while child murder increased by 37.2%.</span>\r\n\r\n<span style=\"font-weight: 400;\">For a country where <a href=\"https://www.dailymaverick.co.za/article/2022-04-29-its-been-three-and-a-half-years-and-still-no-gender-based-violence-council/\">devastating incidents of gender-based violence</a> (GBV) regularly make front-page news, these statistics are disturbing. The Minister himself has admitted that there is</span><a href=\"https://businesstech.co.za/news/government/593520/no-justification-for-shocking-crime-stats-but-there-are-plans-to-fix-them-police-minister/\"> <span style=\"font-weight: 400;\">no justifiable excuse for these statistics</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">South Africa is not without a plan for dealing with GBV. In 2020, the government adopted the Gender-based Violence and Femicide National Strategic Plan (</span><a href=\"https://www.justice.gov.za/vg/gbv/NSP-GBVF-FINAL-DOC-04-05.pdf\"><span style=\"font-weight: 400;\">NSP</span></a><span style=\"font-weight: 400;\">). This is supported against the backdrop of an extensive and progressive constitutional, legislative and policy framework aimed at combating GBV. This framework includes the recently amended</span><a href=\"https://www.justice.gov.za/legislation/acts/2021-014.pdf\"> <span style=\"font-weight: 400;\">Domestic Violence Act (DVA)</span></a><span style=\"font-weight: 400;\"> and the</span><a href=\"https://www.gov.za/sites/default/files/gcis_document/202203/45823gen787.pdf\"> <span style=\"font-weight: 400;\">Criminal law (Sexual Offences and Related Matters) Act</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Summarised briefly, the NSP aims to provide a multi-sectoral, coherent and strategic framework geared towards strengthening a coordinated national response to GBV. The NSP includes among its areas of focus the prevention of GBV, improving justice, safety and protection; and enhancing accountability and leadership across government sectors and society.</span>\r\n\r\n<span style=\"font-weight: 400;\">Although the NSP serves as a symbol of hope, practical and accountable implementation has slowed to a snail’s pace. For example, the NSP specifically calls for government to align departmental strategic plans and existing programmes with the outcomes in the NSP.</span>\r\n\r\n<p><a href=\"https://www.dailymaverick.co.za/cape-town-gender-based-violence-protests-affect-wef-10/\"><img loading=\"lazy\" class=\"size-full wp-image-1302196\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/06/Oped-Bannister-GBVpoliceTW.jpeg\" alt=\"\" width=\"720\" height=\"360\" /></a> Clashes broke out between protesters and police outside the Cape Town International Convention Centre. While the development of performance indicators is a difficult and complicated process, evidence-based indicators need to be developed in consultation with experts on policing, GBV and gender equality. The need for wider consultation with experts is further evidenced by the</span><a href=\"https://www.news24.com/amp/news24/analysis/lisa-vetten-madness-in-the-method-why-governments-gbv-hot-spots-are-really-not-spots-20201126\"> <span style=\"font-weight: 400;\">criticism levelled against SAPS for their identification of GBV hotspots</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Strengthened accountability and detailed performance indicators further need to be coupled with intensive training geared towards transforming the internal culture within police organisations. While SAPS has</span><a href=\"https://www.sanews.gov.za/south-africa/police-urged-treat-gbv-victims-care\"> <span style=\"font-weight: 400;\">affirmed its commitment to combat GBV</span></a><span style=\"font-weight: 400;\">, this is not reflected in the arguments made on behalf of SAPS in the case of</span><a href=\"https://collections.concourt.org.za/bitstream/handle/20.500.12144/36724/Final%20Judgment%20CCT94-20%20AK%20v%20Minister%20of%20Police.pdf?sequence=44&isAllowed=y\"> <i><span style=\"font-weight: 400;\">AK v Minister of Police</span></i></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">In this case, the complainant was kidnapped and brutally gang-raped. After attempting to ensure that SAPS effectively investigated the crime with no success, the claimant instituted a claim for damages in the high court. Inexplicably,</span><span style=\"font-weight: 400;\"> the minister argued that the applicant’s case was not about GBV and that it was not a constitutional issue but rather a “normal delictual action”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The minister of police then went on to argue that “finding in favour of the applicant in these circumstances would have a chilling effect on its ability to conduct investigations and carry out its constitutional mandate”.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is concerning that instead of recognising its failings and considering how SAPS could improve, the focus was on defending such lacklustre services while attempting to downplay the trauma that the claimant experienced. This approach undermines the NSP’s goal to strengthen leadership and accountability.</span>\r\n\r\n<span style=\"font-weight: 400;\">If this negative conception of police accountability represents the underlying narrative informing the police response to GBV, one has to wonder how effective the</span><a href=\"https://www.saps.gov.za/newsroom/msspeechdetail.php?nid=39993\"> <span style=\"font-weight: 400;\">newly established GBV desks</span></a><span style=\"font-weight: 400;\"> will be. </span><span style=\"font-weight: 400;\">The Civilian Secretariat for Police Services (CSPS) is still in the process of auditing these GBV desks to verify and ensure their existence (and effective functioning) at all police stations.</span>\r\n\r\n<span style=\"font-weight: 400;\">Given that SAPS has received extensive criticism for failing to</span><a href=\"https://www.news24.com/news24/southafrica/news/investigation-into-w-cape-police-handling-of-gbv-case-complaints-show-concerning-inefficiencies-mec-20210818\"> <span style=\"font-weight: 400;\">provide victim-friendly services</span></a><span style=\"font-weight: 400;\"> while</span><a href=\"https://www.iol.co.za/news/politics/watchdog-body-finds-saps-non-compliant-with-domestic-violence-act-7d546fb9-c178-4912-b65d-ee23fff26f91\"> <span style=\"font-weight: 400;\">failing to implement the DVA</span></a><span style=\"font-weight: 400;\">, the extent to which these desks will translate into responsive services for survivors of GBV remains to be seen.</span>\r\n\r\n<span style=\"font-weight: 400;\">SAPS has also</span><a href=\"https://pmg.org.za/committee-meeting/35046/\"> <span style=\"font-weight: 400;\">lamented the high levels of attrition in domestic violence cases</span></a><span style=\"font-weight: 400;\">, with the focus on complainants who withdraw cases. GBV is a complicated social problem,</span><span style=\"font-weight: 400;\"> emerging from the interplay of multiple intersecting factors at different levels of the social “ecology”, including social and community norms.</span>\r\n\r\n<span style=\"font-weight: 400;\">While SAPS is correct that GBV is a</span><a href=\"https://www.news24.com/news24/southafrica/news/stop-telling-women-to-stay-in-abusive-relationships-urges-cele-20200817\"> <span style=\"font-weight: 400;\">broader social problem</span></a><span style=\"font-weight: 400;\">, SAPS should focus on the role of the police in fulfilling their constitutional obligations and in going back to the basics by providing effective investigative and protective services. SAPS should also focus on its role in facilitating access to health care services and shelters for women, as per section 2(a) of the DVA.</span>\r\n\r\n<span style=\"font-weight: 400;\">While survivors may retract their cases due to violence escalating or due to a lack of feasible economic options, </span><span style=\"font-weight: 400;\">the overly masculinised occupational culture within police institutions also often serves as a barrier for women seeking to access justice.</span>\r\n\r\n<span style=\"font-weight: 400;\">SAPS, therefore, needs to play a more significant role in protecting women and contributing to the change that needs to occur. </span><b>DM</b>\r\n\r\n<i><span style=\"font-weight: 400;\">Dr Tarryn Bannister is Project and Research Officer at the African Policing Civilian Oversight Forum.</span></i>",
