"contents": "\r\n<p><g class=\"gr_ gr_113 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"113\" data-gr-id=\"113\">Sars</g> Chief Financial Officer Matsobane Matlwa was marched out of Sars Lehae building in Pretoria this week under the supervision of security personnel. He left <g class=\"gr_ gr_114 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"114\" data-gr-id=\"114\">Sars</g> Lehae for Hilton House offices, also in Pretoria, to fetch some of his belongings and was escorted out of this building too. He has been ordered to serve his notice period at home – a fact that struck every source in <g class=\"gr_ gr_115 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"115\" data-gr-id=\"115\">Sars</g> as very odd.</p>\r\n<p><span ><span ><span>Yet, Matlwa tried his best to convince Scorpio on Friday that he has “resigned on my own accord”.</span></span></span></p>\r\n<p><span >“<span ><span><span><span style=\"\">I spoke to [Moyane], we agreed to part amicably. He did nothing wrong on his part, I did nothing wrong on my part. The resignation has been coming for a while. It was time to make a move on to other things.”</span></span></span></span></span></p>\r\n<p><span ><span ><span>Scorpio sent formal questions to <g class=\"gr_ gr_99 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"99\" data-gr-id=\"99\">Sars</g> on Wednesday evening asking for context regarding the matter. Hours later, <g class=\"gr_ gr_100 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"100\" data-gr-id=\"100\">Sars</g> sent an internal memo to staff, informing them Matlwa “resigned”.</span></span></span></p>\r\n<p><span ><span ><span>Sars spokesperson Sandile Memela repeated this version to Scorpio, saying “… unless otherwise and or necessary, <g class=\"gr_ gr_103 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"103\" data-gr-id=\"103\">Sars</g> does not divulge or discuss its employees and related matters between employee and employer in the public domain”.</span></span></span></p>\r\n<p><span ><span ><span><span><span style=\"\">The facts on the table contradict the official version.</span></span></span></span></span></p>\r\n<p><span ><span ><span>Matlwa didn’t mention the pending complaint against him to Scorpio, nor that he was threatened with disciplinary action and that an investigation into his conduct has been launched. According to senior sources in Sars, Matlwa chose to resign rather than sit through the disciplinary process. Only after Scorpio revealed knowledge of the sword hanging over his head, did Matlwa confirm the existence of the <g class=\"gr_ gr_110 gr-alert gr_gramm gr_inline_cards gr_run_anim Punctuation multiReplace\" id=\"110\" data-gr-id=\"110\">complaint.</g></span></span></span></p>\r\n<p><span >“<span ><span><span><span style=\"\">I’ve sat through what they call an investigative interview. I explained the matter to Moyane. But this is not the reason for my resignation. In the reasons, you’ll see I didn’t mention any bullying or abusive behaviour,” Matlwa said. He declined to provide Scorpio with his reasons for resigning.</span></span></span></span></span></p>\r\n<p><span ><span ><span>In a formal complaint of 6 pages dated July 21, a female employee in <g class=\"gr_ gr_98 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del multiReplace\" id=\"98\" data-gr-id=\"98\">Matlwa’s</g> office accused him of being abusive, unprofessional, extremely sexist, that he threatened to kick her out of her job and shouted at her.</span></span></span></p>\r\n<p><span ><span ><span>Matlwa denied the allegations.</span></span></span></p>\r\n<p><span ><span ><span><span><span style=\"\">Moyane has acted swiftly against Matlwa. Two weeks after the complaint was laid, an initial charge sheet was drawn up, a disciplinary investigation was under way and Matlwa decided to resign.</span></span></span></span></span></p>\r\n<p><span ><span ><span>This stands in stark contrast with how Moyane dilly dallied on the suspension of Jonas Makwakwa.</span></span></span></p>\r\n<p><span ><span ><span>Makwakwa, <g class=\"gr_ gr_97 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"97\" data-gr-id=\"97\">Sars</g>’ chief officer: business and individual taxes, has been red flagged for R1.3m in “suspicious and unusual” cash payments into his bank accounts as well as three cash deposits into his girlfriend’s account.</span></span></span></p>\r\n<p><span ><span ><span>During Moyane’s reign, Makwakwa became a powerful official at <g class=\"gr_ gr_107 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"107\" data-gr-id=\"107\">Sars</g>. Over and above his normal tasks, Moyane also ordered him to oversee the Large Business Centre, effectively giving Makwakwa oversight into the matters of all taxpayers.</span></span></span></p>\r\n<p><span ><span ><span>A banking regulator investigated Makwakwa’s FNB bank account between 2010 and 2016, finding a series of deposits totalling R785 130. The bulk of these – 48 deposits totalling R726 400 – was made between 2014 and 2015.</span></span></span></p>\r\n<p><span ><span ><span>It is unsure what triggered the investigation.</span></span></span></p>\r\n<p><span ><span ><span>Makwakwa and his girlfriend were apparently also filmed depositing large cash amounts at ATM’s on three consecutive days, using three different ATM’s in a 10km radius.</span></span></span></p>\r\n<p><span ><span ><span>A report that included various other transgressions was compiled and sent to <g class=\"gr_ gr_95 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del multiReplace\" id=\"95\" data-gr-id=\"95\">Moyane</g> on May 17, 2016.</span></span></span></p>\r\n<p><span ><span ><span>The report was locked in Moyane’s vault for four months until it was leaked to the media.</span></span></span></p>\r\n<p><span ><span ><span>On September 15 Moyane begrudgingly suspended Makwakwa. In an internal note he appeased staff by saying: “I would like to assure all of you that when this matter was brought to my attention, <g class=\"gr_ gr_105 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"105\" data-gr-id=\"105\">Sars</g> took all the reasonable steps within our policies to engage with the matter…I believe <g class=\"gr_ gr_106 gr-alert gr_spell gr_inline_cards gr_run_anim ContextualSpelling ins-del\" id=\"106\" data-gr-id=\"106\">Sars</g> has followed the correct procedure…”</span></span></span></p>\r\n<p><span ><span ><span>That, however, is highly questionable. In terms of the Financial Intelligence Centre Act (FICA), Moyane was obliged not to disclose the information in the report to Makwakwa - which he did.</span></span></span></p>\r\n<p><span ><span ><span>Controversies around Makwakwa haven't stopped since he was suspended, either.</span></span></span></p>\r\n<p><span ><span ><span>amaBhungane revealed in October last year that Makwakwa seems to have used his influence to secure a position in the legal department for his then 25-year-old girlfriend.</span></span></span></p>\r\n<p><span ><span ><span>In February 2017, Business Day accused Makwakwa of allegedly intervening in a tax matter at the behest of Durban billionaires Shauwn and S’bu Mpisane, whilst he was under suspension.</span></span></span></p>\r\n<p><span ><span ><span>Scorpio has seen evidence that <g class=\"gr_ gr_90 gr-alert gr_gramm gr_inline_cards gr_run_anim Grammar multiReplace\" id=\"90\" data-gr-id=\"90\">back</g> both amaBhungane and Business Day’s stories.</span></span></span></p>\r\n<p><span ><span ><span>The media has questioned Moyane several times about the Makwakwa matter since his suspension, soliciting a combative and defensive response from Moyane.</span></span></span></p>\r\n<p><span ><span ><span>Moyane’s standard answer is that he’s “waiting” for a response from law firm Hogan Lovells, who was appointed to investigate the matter.</span></span></span></p>\r\n<p><span ><span ><span><span><span style=\"\">Why the ringing disparity in Moyane’s conduct? Scorpio does not yet have documentary evidence to answer that question.</span></span></span></span></span></p>\r\n<p><span ><span ><span>Senior Sars sources, however, said Matlwa fell into disfavour with the boss after he made certain revelations to the Auditor-General relating to payments to Makwakwa.
