"contents": "<span style=\"font-weight: 400;\">The National Prosecuting Authority (NPA) deputy director in Gauteng, advocate George Baloyi, told the commission of inquiry into Gauteng taxi violence that prosecutors often declined to prosecute taxi violence cases because of poor investigative work.</span>\r\n\r\nIn most cases, charges had to be withdrawn or the accused were acquitted. He told the commission that reasons given by prosecutors for withdrawing the cases included:\r\n<ul>\r\n \t<li>Poor statements taken by the police;</li>\r\n \t<li>Poor police investigations;</li>\r\n \t<li>Delays in finalising the investigations;</li>\r\n \t<li>Witnesses contradicting statements and evidence, an absence of witnesses, lack of cooperation from witnesses and witnesses reluctant to testify; and</li>\r\n \t<li>Lack of evidence regarding the identity and participation of the suspects and suspects not being properly linked to the commission of the offence.</li>\r\n</ul>\r\n“This could be attributed to a number of factors, one of them being intimidation. One of the tools available to investigators is to apply for witness protection.\r\n\r\n“These types of matters are notorious for being protracted. The accused… often engage strong and experienced legal practitioners, and cross-examination [goes on] for days on end, often taking away the conceivable point. Sometimes the legal stratagem that is being employed does lead to the delays,” said Baloyi.\r\n\r\nHe said the longer it took for a witness to testify, the harder it was to get a successful conviction. Also, there was always the possibility of the death of witnesses.\r\n\r\nIn earlier testimony, General Vinesh Moonoo, a retired police general investigating taxi violence in Gauteng, said 95% of cases were not prosecuted.\r\n\r\nProsecutors have recommended extensive training for investigating officers. Baloyi said prosecutors needed to provide reasons when a particular matter was struck off the roll.\r\n\r\nCases could only be struck off the roll if a screening prosecutor explained the shortcomings of the case to the investigating officer, and gave the officer a chance to rectify the case and return the docket for enrolment later that day.\r\n\r\n“Our instruction to the prosecutors is... no case, no enrolment. If the accused cannot be connected with the offence the case cannot be enrolled. We live in a constitutional democracy,” said Baloyi.\r\n\r\nAnother problem identified by prosecutors was that detectives adopted a lazy attitude in the knowledge that prosecutors would fill the gaps.\r\n\r\nA sad reality of prosecutor-guided investigations was the “lack of critical thinking” by SAPS detectives, who adopted a laid-back approach. They were not interested in evaluating the evidence in their dockets and employing critical thinking which would enable them to submit a docket that needed the minimum of prosecutor-guided investigations.\r\n\r\nThis had left South Africa with a “very small pool of experienced investigators” to tackle crime. Baloyi said it was challenging for prosecutors to stand in for SAPS detectives, commanders and supervisors by providing prosecutor-guided investigations in the vast majority of dockets.\r\n\r\nHe said that the number of taxi violence cases did not warrant the establishment of a special court to deal exclusively with such matters.\r\n\r\nHe said prosecutors were overwhelmed with prioritised crimes and crime categories and often had to resort to juggling cases.\r\n\r\nBaloyi’s testimony continues. <strong>DM</strong>",
