A battle — that cuts across the ANC’s factions and leagues — about corruption and who gets on to the election lists is roiling the party.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the weekend, Chief Justice Raymond Zondo was drawn into the fray when he denied a </span><a href=\"https://www.news24.com/citypress/politics/anc-election-list-integrity-commission-flags-those-implicated-at-zondo-commission-says-they-should-be-excluded-20240303\"><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> report</span></a><span style=\"font-weight: 400;\"> which claimed that Mineral Resources and Energy Minister Gwede Mantashe had successfully challenged the Commission of Inquiry into State Capture. (The commission </span><a href=\"https://www.dailymaverick.co.za/article/2022-03-02-charge-zuma-mokonyane-and-mantashe-for-bosasa-graft-state-capture-report-recommends/\"><span style=\"font-weight: 400;\">recommended</span></a><span style=\"font-weight: 400;\"> further investigations into Mantashe related to security installations by Bosasa, the facilities management and catering company at the heart of South Africa’s story of corruption.)</span>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe said </span><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> had not contacted him before publication and confirmed the courts had yet to hear his review. </span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo said: “The statement in the </span><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> that Minister Mantashe successfully challenged the State Capture Commission report is simply not true. The </span><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> failed to do a basic investigation on this. The true position is that Minister Mantashe’s review application is still pending and has not yet been decided. In fact, no review application against the commission’s report has been decided.”</span>\r\n\r\n<span style=\"font-weight: 400;\">It has been</span><a href=\"https://www.news24.com/citypress/politics/anc-election-list-integrity-commission-flags-those-implicated-at-zondo-commission-says-they-should-be-excluded-20240303\"><span style=\"font-weight: 400;\"> reported</span></a><span style=\"font-weight: 400;\"> that the ANC’s Integrity Commission, chaired by the Rev Frank Chikane, has recommended that ANC cadres named in the State Capture Commission report be excluded from election lists. The party is set to finalise the lists, which </span><a href=\"https://www.dailymaverick.co.za/article/2024-02-26-sas-polls-timetable-cast-in-stone-says-iec-urging-parties-to-meet-registration-deadlines/\"><span style=\"font-weight: 400;\">must be lodged</span></a><span style=\"font-weight: 400;\"> with the Electoral Commission by Friday, March 8. </span>\r\n\r\n<p><a href=\"https://www.dailymaverick.co.za/politics-anc-lists/\"><img loading=\"lazy\" class=\"size-full wp-image-2079724\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/03/politics-ANC-lists.jpg\" alt=\"ANC poll lists\" width=\"720\" height=\"334\" /></a> <em>Illustrative image | From left: Bongani Bongo. (Photo: Gallo Images / Frennie Shivambu)</em></p>\r\n\r\n<span style=\"font-weight: 400;\">Among ANC members named by the State Capture Commission as having a case to answer for abuse of power, abrogation of duty and instances of alleged corruption are:</span>\r\n<h4><b>Current members of the executive</b></h4>\r\n<ul>\r\n \t<li>Gwede Mantashe — minister of mineral resources and energy and ANC national chairperson (Bosasa graft).</li>\r\n \t<li>Zizi Kodwa — minister of sports, arts and culture (favours from corruption-accused company EOH).</li>\r\n \t<li>Khumbudzo Ntshavheni — minister in the Presidency (for lack of vigilance as a board member at Denel during the administration of former president Jacob Zuma).</li>\r\n \t<li>David Mahlobo — deputy minister of water and sanitation (alleged looting of national intelligence funds and siphoning a monthly allowance of about R2.5-million to Zuma while intelligence minister under his administration).</li>\r\n</ul>\r\n<h4><b>Senior ANC official </b></h4>\r\n<ul>\r\n \t<li>Nomvula Mokonyane — first secretary-general of the ANC (Bosasa graft).</li>\r\n</ul>\r\n<h4><b>ANC members of the National Assembly</b></h4>\r\n<ul>\r\n \t<li>Cedrick Frolick (Bosasa graft).</li>\r\n \t<li>Thabang Makwetla (Bosasa graft).</li>\r\n \t<li>Bongani Bongo (numerous allegations).</li>\r\n \t<li>Mosebenzi Zwane (numerous allegations).</li>\r\n \t<li>Sfiso Buthelezi — (alleged corruption at the Passenger Rail Agency of SA while board chairperson).</li>\r\n</ul>\r\n<h4><b>ANC member of the National Council of Provinces</b></h4>\r\n<ul>\r\n \t<li>Winnie Ngwenya (Bosasa graft).</li>\r\n</ul>\r\n<h4><b>ANC NEC</b></h4>\r\n<ul>\r\n \t<li>Malusi Gigaba (serving the Gupta network using the numerous Cabinet portfolios he occupied, for which he allegedly received cash payments).</li>\r\n</ul>\r\n<h4><b>ANC veterans</b></h4>\r\n<ul>\r\n \t<li>Vincent Smith (Bosasa graft).</li>\r\n \t<li>SA’s ambassador to China, Siyabonga Cwele (for alleged abuse of power while intelligence minister).</li>\r\n \t<li>Former president Jacob Zuma (for numerous abuses of power related to State Capture; Zuma is now the public face of the uMkhonto Wesizwe party).</li>\r\n \t<li>Former ANC secretary-general Ace Magashule (for alleged corruption related to his time as Free State premier; Magashule now heads the African Congress for Transformation party).</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.dailymaverick.co.za/article/2023-12-14-mavuso-msimang-backtracks-on-resignation-leaving-fikile-mbalula-shame-faced-over-bribe-comments/\"><span style=\"font-weight: 400;\">ANC agreed to exclude</span></a><span style=\"font-weight: 400;\"> from the lists its members</span><span style=\"font-weight: 400;\"> implicated in State Capture after veteran Mavuso Msimang resigned and returned after the party’s turnabout. However, the debate about whether or not they should be on party lists is still dividing the party and appears to have yet to be concluded.</span>\r\n\r\n<span style=\"font-weight: 400;\">The exclusions could affect bigwigs including Dr Zweli Mkhize, who was implicated in the Digital Vibes scandal exposed by </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">. Mkhize is the chairperson of the ANC’s influential social transformation committee. </span>\r\n\r\n<span style=\"font-weight: 400;\">Nonkululeko Njilo reported </span><a href=\"https://www.dailymaverick.co.za/article/2022-12-17-ancs-integrity-commission-to-summon-97-leaders-named-in-zondo-state-capture-report/\"><span style=\"font-weight: 400;\">here</span></a><span style=\"font-weight: 400;\"> on the 97 party members and leaders implicated in the State Capture Commission report, and on the process followed by the previous Integrity Commission.</span>\r\n\r\n<span style=\"font-weight: 400;\">Marianne Merten reported </span><a href=\"https://www.dailymaverick.co.za/article/2023-10-03-nothing-to-see-here-parliaments-ethics-committee-absolves-four-anc-mps-implicated-in-state-capture/\"><span style=\"font-weight: 400;\">here</span></a><span style=\"font-weight: 400;\"> on Parliament clearing four MPs implicated by the State Capture Commission.</span>\r\n<h3><b>Explainer</b></h3>\r\n<span style=\"font-weight: 400;\">The ANC members affected by the Integrity Commission report argue they do not have to step aside from their roles or decline nomination to be on the party lists because they have not been charged with any offence under the law.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ANC has watered down the step-aside rule to deal with corruption from an initial 2017 conference resolution, which said that members implicated in public corruption scandals should step aside. The party’s National Executive Committee decided this was prejudicial and it was moderated to “step aside only after being charged”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Even though the Commission of Inquiry into State Capture was a judicial process, its rules of evidence differ from those of a legal process. Hence, members implicated in it argue that they must first be charged before stepping aside from the party’s election lists.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ANC Veterans’ League, chaired by Snuki Zikalala, has lobbied for the implicated members to be excluded. The Women’s and Youth League say members not formally charged should be on party election lists.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe, Kodwa and Mokonyane characterised the allegations against them as coming from individuals who did not understand the ANC culture of comradely care and kinship.</span>\r\n\r\n<span style=\"font-weight: 400;\">Three opinion polls, including its own, have found that the ANC is likely to poll lower than ever before in the May 29 election. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",

A battle — that cuts across the ANC’s factions and leagues — about corruption and who gets on to the election lists is roiling the party.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the weekend, Chief Justice Raymond Zondo was drawn into the fray when he denied a </span><a href=\"https://www.news24.com/citypress/politics/anc-election-list-integrity-commission-flags-those-implicated-at-zondo-commission-says-they-should-be-excluded-20240303\"><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> report</span></a><span style=\"font-weight: 400;\"> which claimed that Mineral Resources and Energy Minister Gwede Mantashe had successfully challenged the Commission of Inquiry into State Capture. (The commission </span><a href=\"https://www.dailymaverick.co.za/article/2022-03-02-charge-zuma-mokonyane-and-mantashe-for-bosasa-graft-state-capture-report-recommends/\"><span style=\"font-weight: 400;\">recommended</span></a><span style=\"font-weight: 400;\"> further investigations into Mantashe related to security installations by Bosasa, the facilities management and catering company at the heart of South Africa’s story of corruption.)</span>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe said </span><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> had not contacted him before publication and confirmed the courts had yet to hear his review. </span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo said: “The statement in the </span><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> that Minister Mantashe successfully challenged the State Capture Commission report is simply not true. The </span><i><span style=\"font-weight: 400;\">City Press</span></i><span style=\"font-weight: 400;\"> failed to do a basic investigation on this. The true position is that Minister Mantashe’s review application is still pending and has not yet been decided. In fact, no review application against the commission’s report has been decided.”</span>\r\n\r\n<span style=\"font-weight: 400;\">It has been</span><a href=\"https://www.news24.com/citypress/politics/anc-election-list-integrity-commission-flags-those-implicated-at-zondo-commission-says-they-should-be-excluded-20240303\"><span style=\"font-weight: 400;\"> reported</span></a><span style=\"font-weight: 400;\"> that the ANC’s Integrity Commission, chaired by the Rev Frank Chikane, has recommended that ANC cadres named in the State Capture Commission report be excluded from election lists. (Photo: Gallo Images / Frennie Shivambu)</em>[/caption]\r\n\r\n<span style=\"font-weight: 400;\">Among ANC members named by the State Capture Commission as having a case to answer for abuse of power, abrogation of duty and instances of alleged corruption are:</span>\r\n<h4><b>Current members of the executive</b></h4>\r\n<ul>\r\n \t<li>Gwede Mantashe — minister of mineral resources and energy and ANC national chairperson (Bosasa graft).</li>\r\n \t<li>Zizi Kodwa — minister of sports, arts and culture (favours from corruption-accused company EOH).</li>\r\n \t<li>Khumbudzo Ntshavheni — minister in the Presidency (for lack of vigilance as a board member at Denel during the administration of former president Jacob Zuma).</li>\r\n \t<li>David Mahlobo — deputy minister of water and sanitation (alleged looting of national intelligence funds and siphoning a monthly allowance of about R2.5-million to Zuma while intelligence minister under his administration).</li>\r\n</ul>\r\n<h4><b>Senior ANC official </b></h4>\r\n<ul>\r\n \t<li>Nomvula Mokonyane — first secretary-general of the ANC (Bosasa graft).</li>\r\n</ul>\r\n<h4><b>ANC members of the National Assembly</b></h4>\r\n<ul>\r\n \t<li>Cedrick Frolick (Bosasa graft).</li>\r\n \t<li>Thabang Makwetla (Bosasa graft).</li>\r\n \t<li>Bongani Bongo (numerous allegations).</li>\r\n \t<li>Mosebenzi Zwane (numerous allegations).</li>\r\n \t<li>Sfiso Buthelezi — (alleged corruption at the Passenger Rail Agency of SA while board chairperson).</li>\r\n</ul>\r\n<h4><b>ANC member of the National Council of Provinces</b></h4>\r\n<ul>\r\n \t<li>Winnie Ngwenya (Bosasa graft).</li>\r\n</ul>\r\n<h4><b>ANC NEC</b></h4>\r\n<ul>\r\n \t<li>Malusi Gigaba (serving the Gupta network using the numerous Cabinet portfolios he occupied, for which he allegedly received cash payments).</li>\r\n</ul>\r\n<h4><b>ANC veterans</b></h4>\r\n<ul>\r\n \t<li>Vincent Smith (Bosasa graft).</li>\r\n \t<li>SA’s ambassador to China, Siyabonga Cwele (for alleged abuse of power while intelligence minister).</li>\r\n \t<li>Former president Jacob Zuma (for numerous abuses of power related to State Capture; Zuma is now the public face of the uMkhonto Wesizwe party).</li>\r\n \t<li>Former ANC secretary-general Ace Magashule (for alleged corruption related to his time as Free State premier; Magashule now heads the African Congress for Transformation party).</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.dailymaverick.co.za/article/2023-12-14-mavuso-msimang-backtracks-on-resignation-leaving-fikile-mbalula-shame-faced-over-bribe-comments/\"><span style=\"font-weight: 400;\">ANC agreed to exclude</span></a><span style=\"font-weight: 400;\"> from the lists its members</span><span style=\"font-weight: 400;\"> implicated in State Capture after veteran Mavuso Msimang resigned and returned after the party’s turnabout. However, the debate about whether or not they should be on party lists is still dividing the party and appears to have yet to be concluded.</span>\r\n\r\n<span style=\"font-weight: 400;\">The exclusions could affect bigwigs including Dr Zweli Mkhize, who was implicated in the Digital Vibes scandal exposed by </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">. Mkhize is the chairperson of the ANC’s influential social transformation committee. </span>\r\n\r\n<span style=\"font-weight: 400;\">Nonkululeko Njilo reported </span><a href=\"https://www.dailymaverick.co.za/article/2022-12-17-ancs-integrity-commission-to-summon-97-leaders-named-in-zondo-state-capture-report/\"><span style=\"font-weight: 400;\">here</span></a><span style=\"font-weight: 400;\"> on the 97 party members and leaders implicated in the State Capture Commission report, and on the process followed by the previous Integrity Commission.</span>\r\n\r\n<span style=\"font-weight: 400;\">Marianne Merten reported </span><a href=\"https://www.dailymaverick.co.za/article/2023-10-03-nothing-to-see-here-parliaments-ethics-committee-absolves-four-anc-mps-implicated-in-state-capture/\"><span style=\"font-weight: 400;\">here</span></a><span style=\"font-weight: 400;\"> on Parliament clearing four MPs implicated by the State Capture Commission.</span>\r\n<h3><b>Explainer</b></h3>\r\n<span style=\"font-weight: 400;\">The ANC members affected by the Integrity Commission report argue they do not have to step aside from their roles or decline nomination to be on the party lists because they have not been charged with any offence under the law.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ANC has watered down the step-aside rule to deal with corruption from an initial 2017 conference resolution, which said that members implicated in public corruption scandals should step aside. The party’s National Executive Committee decided this was prejudicial and it was moderated to “step aside only after being charged”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Even though the Commission of Inquiry into State Capture was a judicial process, its rules of evidence differ from those of a legal process. Hence, members implicated in it argue that they must first be charged before stepping aside from the party’s election lists.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ANC Veterans’ League, chaired by Snuki Zikalala, has lobbied for the implicated members to be excluded. The Women’s and Youth League say members not formally charged should be on party election lists.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe, Kodwa and Mokonyane characterised the allegations against them as coming from individuals who did not understand the ANC culture of comradely care and kinship.</span>\r\n\r\n<span style=\"font-weight: 400;\">Three opinion polls, including its own, have found that the ANC is likely to poll lower than ever before in the May 29 election.
