"contents": "<span style=\"font-weight: 400;\">The Ministerial Conference of the World Trade Organization (WTO) is this week discussing the </span><a href=\"https://docs.wto.org/dol2fe/Pages/SS/directdoc.aspx?filename=q:/WT/MIN22/W15.pdf&Open=True\"><span style=\"font-weight: 400;\">“Draft Decision”</span></a> <span style=\"font-weight: 400;\">presented a few days ago by the WTO Secretariat in relation to a proposal to waive certain intellectual property rights, which have acted as barriers to greater access to vaccines and other health products, resulting in global health inequity following a leaked text shared in </span><a href=\"https://www.dailymaverick.co.za/article/2022-03-22-ramaphosa-urged-not-to-endorse-sham-of-a-waiver-for-covid-19-patents/\"><span style=\"font-weight: 400;\">March 2022</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">An alternative, more comprehensive proposal, designed to support health justice and meaningfully bring this pandemic – and the next – under control was proposed by South Africa and India nearly two years ago, in </span><a href=\"https://docs.wto.org/dol2fe/Pages/SS/directdoc.aspx?filename=q:/IP/C/W669.pdf\"><span style=\"font-weight: 400;\">October 2020</span></a><span style=\"font-weight: 400;\">, but it </span><span style=\"font-weight: 400;\">has been blocked by the European Union, the UK, Switzerland, Canada and other rich countries for the past 20 months. </span>\r\n\r\n<span style=\"font-weight: 400;\">Globally, more than 100 countries, world leaders past and present, the pope, faith groups, academics, activists, researchers, politicians and hundreds of thousands of people across the world </span><a href=\"https://peoplesvaccine.org/\"><span style=\"font-weight: 400;\">have called</span></a><span style=\"font-weight: 400;\"> on these rich countries to “walk the talk</span><span style=\"font-weight: 400;\">”</span><span style=\"font-weight: 400;\"> of solidarity – but they have </span><span style=\"font-weight: 400;\">simply </span><span style=\"font-weight: 400;\">ignored them. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1113512\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2021/12/MC-Trips-Oped_2.jpg\" alt=\"\" width=\"720\" height=\"360\" /> Activists around the world continue to rally for a TRIPS waiver that will make life-saving vaccines more accessible to everyone. (Photo: EPA-EFE / Shawn Thew)</p>\r\n\r\n<span style=\"font-weight: 400;\">These are the same countries that hoarded vaccines and vaccine knowledge at the peak of the pandemic and relegated Africa to being a recipient of charity – they often sent us their leftover vaccines on an ad hoc basis in return for positive headlines. </span>\r\n\r\n<span style=\"font-weight: 400;\">Now they have partnered with the WTO to preserve this pandemic and its devastation on countries in the Global South for many more years to come – if this proposed bad deal is adopted.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the past few weeks, civil society organisations and experts have engaged with a range of government agencies and the South African government to </span><a href=\"https://healthjusticeinitiative.org.za/2022/03/24/trips-waiver-negotiations-leaked-text/\"><span style=\"font-weight: 400;\">share detailed concerns</span></a><span style=\"font-weight: 400;\"> in relation to a “compromise text” promoted by the WTO director-general, on which the proposed </span><a href=\"https://www.citizen.org/article/leaked-wto-proposal-is-not-the-covid-19-medicines-waiver-we-need/\"><span style=\"font-weight: 400;\">bad deal</span></a><span style=\"font-weight: 400;\"> is based. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1113513\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2021/12/MC-Trips-Oped_3.jpg\" alt=\"\" width=\"720\" height=\"390\" /> Certain rich countries <span style=\"font-weight: 400;\">hoarded vaccines and vaccine knowledge at the peak of the pandemic and relegated Africa to being a recipient of charity</span>. (Photo: Gallo Images / Papi Morake)</p>\r\n\r\n<span style=\"font-weight: 400;\">We argue that d</span><span style=\"font-weight: 400;\">eveloping countries should not be coerced into accepting a bad deal but </span><a href=\"https://www.businesslive.co.za/bd/national/health/2022-06-01-sa-urged-to-stand-firm-on-covid-19-ip-waiver/\"><span style=\"font-weight: 400;\">stand their ground</span></a><span style=\"font-weight: 400;\"> and insist that an agreement that puts lives before profits or political agendas is concluded, in other words, a TRUE TRIPS waiver. </span>\r\n\r\n<span style=\"font-weight: 400;\">A bad deal that sustains this pandemic and the next, keeps testing and treatment further out of reach of those who need them most and sets tragic precedents for how the globe responds to the next crisis, sustains the violence of poverty and inequality. (Photo: inrs.ca / Wikipedia)</p>\r\n\r\n<span style=\"font-weight: 400;\">Below we provide at least eight reasons that South Africa (along with </span><a href=\"https://reliefweb.int/report/world/msf-governments-negotiating-wto-get-it-right-and-adopt-real-trips-waiver\"><span style=\"font-weight: 400;\">other groups</span></a><span style=\"font-weight: 400;\">) and indeed all countries committed to enabling access and thus ending the Covid-19 pandemic, should reject the bad deal and text currently being negotiated. </span>\r\n\r\n<span style=\"font-weight: 400;\">The bad text or deal will:</span>\r\n<ol>\r\n \t<li>Relinquish all efforts to address barriers to trade secrets, manufacturing know-how, and other undisclosed information necessary to enable multiple manufacturers to come on board to increase the global supply of health products desperately needed to bring the Covid-19 pandemic under control;</li>\r\n \t<li>Needlessly delay consideration of the inclusion of diagnostics and therapeutics and may, because of bracketed text, exclude them entirely from any eventual waiver;</li>\r\n \t<li>Impose TRIPS-plus anti-diversion and notification requirements and a “necessity” test, which were not required pre-pandemic, thereby rolling back existing flexibilities during this pandemic;</li>\r\n \t<li>Place unwarranted limits on who may be “eligible countries” for the use of this limited waiver, thereby impeding countries from the ability to both supply and access vaccines (as the case may be);</li>\r\n \t<li>Go against the wise counsel of global leaders and experts on public health, including Nobel laureates, scientists, human rights advocates – individuals and institutions with long track records in global health and equity;</li>\r\n \t<li>Risk severely damaging the goodwill and solidarity within the Global South, built over the past 20 months in support of the original waiver proposed by India and South Africa;</li>\r\n \t<li>Risk setting anti-poor and anti-public health precedents in the WTO, adversely affecting the prospects of equitable public health outcomes in the future; and</li>\r\n \t<li>Cement the legacy of the WTO and its leadership as one that imposed further barriers to access to health products during a pandemic.</li>\r\n</ol>\r\n<span style=\"font-weight: 400;\">What is now on the table has effectively </span><a href=\"https://www.oxfam.org/en/press-releases/nearly-30000-people-have-died-every-day-covid-19-wto-talks-vaccine-intellectual\"><span style=\"font-weight: 400;\">consigned all people</span></a><span style=\"font-weight: 400;\"> in the developing world to third-class citizens, so that we become “unworthy” of the benefits of advances in science and the treatments already available to the Global North. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1295611\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/06/MC-Trips-Oped_1.jpg\" alt=\"\" width=\"720\" height=\"405\" /> More than 100 countries, world leaders past and present, the pope, faith groups, academics, activists, researchers, politicians and hundreds of thousands of people across the world have called on rich countries to ‘walk the talk’ of solidarity. (Photo: Gallo Images / Papi Morake)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">We argue that d</span><span style=\"font-weight: 400;\">eveloping countries should not be coerced into accepting a bad deal but </span><a href=\"https://www.businesslive.co.za/bd/national/health/2022-06-01-sa-urged-to-stand-firm-on-covid-19-ip-waiver/\"><span style=\"font-weight: 400;\">stand their ground</span></a><span style=\"font-weight: 400;\"> and insist that an agreement that puts lives before profits or political agendas is concluded, in other words, a TRUE TRIPS waiver. </span>\r\n\r\n<span style=\"font-weight: 400;\">A bad deal that sustains this pandemic and the next, keeps testing and treatment further out of reach of those who need them most and sets tragic precedents for how the globe responds to the next crisis, sustains the violence of poverty and inequality. It also calls into question the relevance of the WTO and the usefulness of its rules and processes, especially in a pandemic.</span>\r\n\r\n[caption id=\"attachment_1295610\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-1295610\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/06/MC-Trips-Oped.jpg\" alt=\"\" width=\"720\" height=\"377\" /> The Ministerial Conference of the World Trade Organization is discussing the 'Draft Decision' presented a few days ago by the WTO Secretariat in relation to a proposal to waive certain intellectual property rights. (Photo: inrs.ca / Wikipedia)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">Below we provide at least eight reasons that South Africa (along with </span><a href=\"https://reliefweb.int/report/world/msf-governments-negotiating-wto-get-it-right-and-adopt-real-trips-waiver\"><span style=\"font-weight: 400;\">other groups</span></a><span style=\"font-weight: 400;\">) and indeed all countries committed to enabling access and thus ending the Covid-19 pandemic, should reject the bad deal and text currently being negotiated. </span>\r\n\r\n<span style=\"font-weight: 400;\">The bad text or deal will:</span>\r\n<ol>\r\n \t<li>Relinquish all efforts to address barriers to trade secrets, manufacturing know-how, and other undisclosed information necessary to enable multiple manufacturers to come on board to increase the global supply of health products desperately needed to bring the Covid-19 pandemic under control;</li>\r\n \t<li>Needlessly delay consideration of the inclusion of diagnostics and therapeutics and may, because of bracketed text, exclude them entirely from any eventual waiver;</li>\r\n \t<li>Impose TRIPS-plus anti-diversion and notification requirements and a “necessity” test, which were not required pre-pandemic, thereby rolling back existing flexibilities during this pandemic;</li>\r\n \t<li>Place unwarranted limits on who may be “eligible countries” for the use of this limited waiver, thereby impeding countries from the ability to both supply and access vaccines (as the case may be);</li>\r\n \t<li>Go against the wise counsel of global leaders and experts on public health, including Nobel laureates, scientists, human rights advocates – individuals and institutions with long track records in global health and equity;</li>\r\n \t<li>Risk severely damaging the goodwill and solidarity within the Global South, built over the past 20 months in support of the original waiver proposed by India and South Africa;</li>\r\n \t<li>Risk setting anti-poor and anti-public health precedents in the WTO, adversely affecting the prospects of equitable public health outcomes in the future; and</li>\r\n \t<li>Cement the legacy of the WTO and its leadership as one that imposed further barriers to access to health products during a pandemic.</li>\r\n</ol>\r\n<span style=\"font-weight: 400;\">What is now on the table has effectively </span><a href=\"https://www.oxfam.org/en/press-releases/nearly-30000-people-have-died-every-day-covid-19-wto-talks-vaccine-intellectual\"><span style=\"font-weight: 400;\">consigned all people</span></a><span style=\"font-weight: 400;\"> in the developing world to third-class citizens, so that we become “unworthy” of the benefits of advances in science and the treatments already available to the Global North. </span>\r\n\r\n[caption id=\"attachment_1295611\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-1295611\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/06/MC-Trips-Oped_1.jpg\" alt=\"\" width=\"720\" height=\"405\" /> More than 100 countries, world leaders past and present, the pope, faith groups, academics, activists, researchers, politicians and hundreds of thousands of people across the world have called on rich countries to ‘walk the talk’ of solidarity.
