"contents": "<span style=\"font-weight: 400;\">South Africa’s decision to take Israel to the International Court of Justice (ICJ) on charges of genocide has elicited polarised global responses. Critics </span><a href=\"https://www.economist.com/leaders/2024/01/18/charging-israel-with-genocide-makes-a-mockery-of-the-icj\"><span style=\"font-weight: 400;\">accuse</span></a><span style=\"font-weight: 400;\"> South Africa of theatre, political opportunism and double standards, while supporters </span><a href=\"https://www.euronews.com/2024/01/14/genocide-case-against-israel-where-does-the-rest-of-the-world-stand-on-allegations\"><span style=\"font-weight: 400;\">laud</span></a><span style=\"font-weight: 400;\"> its principled and clear-eyed stance. </span>\r\n\r\n<span style=\"font-weight: 400;\">The move has catapulted Pretoria into the centre of an international legal maelstrom and will have significant ripple effects on its international relations. Why has South Africa chosen this course of action amid potentially grave diplomatic risks?</span>\r\n\r\n<span style=\"font-weight: 400;\">Legally, as a contracting party to the Genocide Convention, South Africa may approach the ICJ if it believes the convention has been violated. Apart from that, Pretoria’s support for the Palestinian cause is deeply rooted in democratic South Africa’s foreign policy. By way of the country’s apartheid history, the Palestinian cause is largely seen as analogous to its own struggle against oppression, occupation and violence. </span>\r\n\r\n<b>Read more in Daily Maverick:</b> <a href=\"https://www.dailymaverick.co.za/article/2021-04-28-israel-guilty-of-apartheid-crimes-against-palestinians-says-human-rights-watch/\"><span style=\"font-weight: 400;\">Israel guilty of ‘apartheid’ crimes against Palestinians, says Human Rights Watch</span></a>\r\n\r\n<span style=\"font-weight: 400;\">Minister of International Relations and Cooperation Naledi Pandor recently </span><a href=\"https://www.youtube.com/watch?v=0xVLvP49qpY\"><span style=\"font-weight: 400;\">echoed</span></a><span style=\"font-weight: 400;\"> this: “South Africa really has a moral responsibility to always stand with the oppressed because we come from a history of struggle, a history of striving for freedom, a history of believing that everybody deserves human dignity, justice and freedom; this is the only reason that we have taken this major step as South Africa”.</span>\r\n\r\n<span style=\"font-weight: 400;\">By drawing on established international institutions, South Africa’s government is simultaneously asking the ICJ to rule on whether there is an ongoing genocide in Gaza and to clarify the duties of all states to prevent genocide, while testing the legitimacy and consistency of this system. That means the value of the case is not solely about the legal outcome, but about spotlighting concerns surrounding the fairness and accountability of the international justice system. </span>\r\n<h4><b>SA foreign policy contradictions</b></h4>\r\n<span style=\"font-weight: 400;\">South Africa should be applauded for working through legitimate global legal instruments in its support of the Palestinian cause. However, Pretoria’s glaring foreign policy contradictions and inconsistencies cannot be ignored, especially if the government believes this ICJ case may help the country rekindle its moral authority on the world stage. </span>\r\n\r\n<b>Read more in Daily Maverick:</b> <a href=\"https://www.dailymaverick.co.za/article/2023-11-10-sas-fickle-foreign-policy-means-it-has-no-principled-approach-towards-global-crises/\"><span style=\"font-weight: 400;\">SA’s fickle foreign policy means it has no principled approach towards global crises</span></a>\r\n\r\n<span style=\"font-weight: 400;\">From its 2015 </span><a href=\"https://issafrica.org/iss-today/the-real-problem-behind-south-africas-refusal-to-arrest-al-bashir\"><span style=\"font-weight: 400;\">failure</span></a><span style=\"font-weight: 400;\"> to uphold its international and domestic legal obligations to arrest former Sudanese president </span><a href=\"https://www.dailymaverick.co.za/article/2021-08-30-ghost-of-omar-al-bashir-may-have-stopped-south-africas-justice-minister-in-his-tracks-in-manuel-chang-extradition-saga/\"><span style=\"font-weight: 400;\">Omar al-Bashir</span></a><span style=\"font-weight: 400;\">, to its </span><a href=\"https://issafrica.org/iss-today/wheels-come-off-south-africas-hollow-version-of-non-alignment\"><span style=\"font-weight: 400;\">muddled</span></a><span style=\"font-weight: 400;\"> response to </span><a href=\"https://www.dailymaverick.co.za/middle-east-crisis-news-hub/\"><span style=\"font-weight: 400;\">Russia’s invasion of Ukraine</span></a><span style=\"font-weight: 400;\">, there are many cases where international law violations and abuses of power by other states haven’t received a similar reaction from Pretoria. </span>\r\n\r\n<span style=\"font-weight: 400;\">The situation is complicated by the country’s </span><a href=\"https://issafrica.org/iss-today/south-africas-squandered-chance-to-show-real-leadership\"><span style=\"font-weight: 400;\">troubled</span></a><span style=\"font-weight: 400;\"> relationship with the International Criminal Court, from which the ruling African National Congress has threatened to withdraw — a proposal that’s since been </span><a href=\"https://www.aljazeera.com/news/2023/4/26/s-africa-backtracks-on-quitting-icc-blames-communications-error\"><span style=\"font-weight: 400;\">revoked</span></a><span style=\"font-weight: 400;\">. And foreign policy missteps such as the </span><a href=\"https://www.dailymaverick.co.za/article/2023-09-05-lady-r-executive-summary-report-nothing-to-see-here-folks/\"><span style=\"font-weight: 400;\">clumsy</span></a><span style=\"font-weight: 400;\"> handling of the </span><a href=\"https://www.dailymaverick.co.za/lady-r/\"><span style=\"font-weight: 400;\">Lady R saga</span></a><span style=\"font-weight: 400;\"> risk the loss of global moral and financial capital. </span>\r\n\r\n<span style=\"font-weight: 400;\">To be fair, most countries’ international relations are rife with contradictions, and the art of foreign policy may be seen as the business of navigating such inconsistencies towards a defined national interest. However, this may be a tall order for South Africa, given how deeply divisive international responses to its case against Israel have been. </span>\r\n\r\n<span style=\"font-weight: 400;\">On the one hand, Pretoria’s stance plays well internationally. Amidst rising geopolitical competition, South Africa has sought to position itself as a leading voice of the global south. Its successful hosting of last year’s BRICS summit was a notable step in pursuing a more equitable and just global political and economic system. </span>\r\n<h4><b>Rising global support</b></h4>\r\n<span style=\"font-weight: 400;\">The decision to use the United Nations’ World Court to advocate the Palestine cause has generated widespread support among global south countries and has ramped up pressure for a ceasefire. Following South Africa’s actions, Indonesia has brought a separate </span><a href=\"https://www.iol.co.za/news/world/indonesia-takes-israel-to-icj-over-illegal-occupation-of-palestine-507ef2d3-8dae-4991-95d1-525e0507f9ba\"><span style=\"font-weight: 400;\">case</span></a><span style=\"font-weight: 400;\"> against Israel to the ICJ, while Chile and Mexico intend to </span><a href=\"https://www.reuters.com/world/mexico-chile-refer-israel-hamas-conflict-court-over-possible-crimes-2024-01-18/\"><span style=\"font-weight: 400;\">refer</span></a><span style=\"font-weight: 400;\"> Israel to the ICC for alleged war crimes. And this month, the Non-Aligned Movement summit adopted a </span><a href=\"https://www.aljazeera.com/news/2024/1/19/non-aligned-movement-criticises-israeli-war-in-gaza-at-kampala-summit\"><span style=\"font-weight: 400;\">resolution</span></a><span style=\"font-weight: 400;\"> calling for an immediate ceasefire.</span>\r\n\r\n<span style=\"font-weight: 400;\">Government positions towards South Africa may become more entrenched after the ICJ’s imminent ruling on provisional measures, and over the coming years when a decision on the merits of the genocide case is expected. </span>\r\n\r\n<span style=\"font-weight: 400;\">This will test Pretoria’s bilateral relations with numerous major Western partners opposed to the case. In particular, the United States (US) </span><a href=\"https://www.youtube.com/watch?v=AA9c0A0zZCI\"><span style=\"font-weight: 400;\">dismissed</span></a><span style=\"font-weight: 400;\"> the legal action as a ‘meritless’ distraction, and Germany intends to </span><a href=\"https://www.aljazeera.com/podcasts/2024/1/19/the-take-why-is-germany-supporting-israel-at-the-icj\"><span style=\"font-weight: 400;\">join</span></a><span style=\"font-weight: 400;\"> the legal proceedings as a third party supporting Israel.</span>\r\n\r\n<span style=\"font-weight: 400;\">In better managing South Africa’s foreign policy contradictions and relations with leading states, Pretoria must recognise that the country largely sits outside the intricate </span><a href=\"https://www.economist.com/the-world-ahead/2023/11/13/a-new-balance-of-power-will-emerge-in-the-middle-east\"><span style=\"font-weight: 400;\">patchwork</span></a><span style=\"font-weight: 400;\"> of geopolitics and security interests that plague the Middle East. This necessitates a foreign policy as well versed in the discourse of geopolitics, violent extremism and religious fundamentalism, as in progressive internationalism, oppression and occupation. </span>\r\n\r\n<span style=\"font-weight: 400;\">As the world awaits the ICJ’s decision, South Africa’s international relations will require careful recalibration regardless of the outcome. Hamas fired rockets into Israel and stormed southern Israeli cities and towns across the border of the Gaza strip. The attack killed and injured hundreds of soldiers and civilians and took dozens of hostages.</p>\r\n<p data-sourcepos=\"9:1-9:227\">The attack took Israel by surprise, though the state quickly mounted a deadly retaliatory operation. The Israeli Defense Forces (IDF) launched airstrikes against Hamas targets in Gaza. The IDF also sent ground troops into Gaza.</p>\r\n<p data-sourcepos=\"11:1-11:218\">The conflict has been devastating for both sides. Thousands have died or have been injured.</p>\r\n<p data-sourcepos=\"13:1-13:238\">The conflict has also had a devastating impact on the infrastructure in Gaza. The IDF has destroyed hospitals, schools, and power plants. The United Nations estimates that more than 72,000 Palestinians have been displaced by the fighting.</p>\r\n<p data-sourcepos=\"15:1-15:261\">The international community has called for a cease-fire between Israel and Palestine to end the latest crisis in the Middle East.
