"contents": "<span style=\"font-weight: 400;\">A non-profit organisation that lobbied for amendments to the Lotteries Act went on to benefit to the tune of tens of millions of rands in grants after the law was changed.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Southern African Youth Movement (SAYM) recommended the introduction of a new way of funding projects by the National Lotteries Commission (NLC) to the Trade, Industry and Competition Parliamentary Committee. Instead of the NLC waiting for applications, SAYM proposed the introduction of proactive funding, which enables the NLC to award a grant without first receiving an application.</span>\r\n\r\n<span style=\"font-weight: 400;\">Proactive funding, which has been at the </span><a href=\"https://www.groundup.org.za/article/national-lotteries-commission-ignored-warnings-about-corruption/\"><span style=\"font-weight: 400;\">heart of the looting</span></a><span style=\"font-weight: 400;\"> of the Lottery, has been suspended by the NLC’s new board.</span>\r\n\r\n<span style=\"font-weight: 400;\">SAYM executive director Alfred Sigudhla and Sello Pietersen, who was then the organisation’s Assistant Programme Manager, </span><a href=\"https://pmg.org.za/committee-meeting/16201/\"><span style=\"font-weight: 400;\">gave evidence to Parliament</span></a><span style=\"font-weight: 400;\"> in 2013 in support of amendments to the Lotteries Act, including the introduction of proactive funding.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the years that followed, SAYM was to receive over R67.5-million in proactive funding for several projects, including an </span><a href=\"https://www.groundup.org.za/article/mystery-why-did-a-youth-movement-get-lottery-funding-to-build-an-old-age-home-that-doesnt-appear-to-be-needed/\"><span style=\"font-weight: 400;\">old age home</span></a><span style=\"font-weight: 400;\">, a </span><a href=\"https://www.groundup.org.za/article/r27-million-from-lottery-but-six-years-later-rehab-still-not-open/\"><span style=\"font-weight: 400;\">drug rehabilitation centre</span></a><span style=\"font-weight: 400;\">, and an anti-drug-themed </span><a href=\"https://www.groundup.org.za/article/questions-surround-lottery-fund-musical-directed-by-tsotsi-star/\"><span style=\"font-weight: 400;\">musical</span></a><span style=\"font-weight: 400;\">, which was funded to do a three-province tour. Neither the old age home nor the rehab are operational, and the musical staged only a handful of performances.</span>\r\n\r\n[embed]https://www.dailymaverick.co.za/opinionista/2022-03-08-is-it-time-to-stop-buying-that-powerball-ticket/[/embed]\r\n\r\n<span style=\"font-weight: 400;\">SAYM’s grants are all recorded in NLC annual reports under several different variations of the organisation’s name. All have one thing in common: the involvement of Sigudhla, according to both company and Department of Social Development records. Sigudhla has enjoyed a longstanding relationship with the NLC.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2014 the board of the National Lotteries Board, the predecessor to the NLC, decided to stop funding SAYM because of irregularities with its funding applications. But the bar on funding was lifted after the personal intervention of former NLC commissioner </span><a href=\"https://www.groundup.org.za/article/lottery-boss-resigns-with-immediate-effect/\"><span style=\"font-weight: 400;\">Thabang Mampane</span></a><span style=\"font-weight: 400;\"> and former board chairperson, </span><a href=\"https://www.groundup.org.za/article/siu-freezes-mansion-of-former-lottery-chair/\"><span style=\"font-weight: 400;\">Alfred Nevhutanda</span></a><span style=\"font-weight: 400;\">. Both are now under investigation for the abuse of Lottery funds.</span>\r\n\r\n<span style=\"font-weight: 400;\">Former NLC chief risk officer Bathabile Kapumha has told how she was pressured to withdraw SAYM from the list of organisations the NLC should not fund. Attorney Trevor Bailey, who was commissioned by the then-NLC board to investigate Kaphumha’s suspension, said in his </span><a href=\"https://www.groundup.org.za/article/woman-who-tried-stop-lottery-rot-was-hounded-out/\"><span style=\"font-weight: 400;\">2015 report </span></a><span style=\"font-weight: 400;\">that she had told him how she had been summoned to meetings with Mampane and Nevhutanda, some of which were also attended by representatives of the SAYM.</span>\r\n\r\n<span style=\"font-weight: 400;\">During one meeting, Kapumha told Bailey that a SAYM representative had said the organisation had supported the NLC over changes to legislation and therefore should not be prejudiced because of irregularities with its funding applications. A source told </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> that the SAYM representative was Sigudhla, but Sigudhla did not respond to questions asking him if he attended this meeting.</span>\r\n\r\n<span style=\"font-weight: 400;\">Nevhutanda instructed Kapumha to remove the SAYM from the list of organisations that the Board had decided not to fund or to discontinue funding, which she did, Bailey reported.</span>\r\n\r\n<span style=\"font-weight: 400;\">Kapumha quit the NLC in fear of her life soon after she was involved in an accident, apparently caused by malfunctioning of her car’s brakes and steering.</span>\r\n\r\n<span style=\"font-weight: 400;\">When </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> sent questions to Sigudhla about the R67.5-million grants, he did not respond.</span>\r\n\r\n<span style=\"font-weight: 400;\">Instead, Dr Lekgotla Mafisa, chair of SAYM’s board, responded, copying in Sigudhla. He said he had been “mandated” to respond to </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\">. “The board took the decision to respond to the questions as decisions on projects are approved by the board and not management”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The board is happy with all projects undertaken under the leadership of the executive director unless persuaded by anybody.”</span>\r\n<h4><b>Millions annually</b></h4>\r\n<span style=\"font-weight: 400;\">Mafisa said SAYM had “managed projects in excess of R3-billion over 20 years”. He said funding came from governments, international funding agencies, such as the United Nations, and private donors.</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">Mafisa said the movement had been involved in more than 20 construction projects with a budget of more than R100-million “in various municipalities”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“This is outside the funding of the NLC.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Over the years, SAYM has received Lottery funding of over R67.5-million, consisting of:</span>\r\n<ul>\r\n \t<li>R27.5-million for an <a href=\"https://www.groundup.org.za/article/mystery-why-did-a-youth-movement-get-lottery-funding-to-build-an-old-age-home-that-doesnt-appear-to-be-needed/\">old age home</a> in Thaba Nchu, near Bloemfontein in the Free State between 2017 and 2020. SAYM says construction of the home is complete and it has been licensed by the DSD and will become operational in 2023. SAYM claimed it was unable to provide a copy of the licence to operate as this document would only be obtained at the “handover” of the facility. But the Free State DSD said it already had an old age home in the area where the SAYM old age home is situated. When the department “was eventually consulted” in 2022, it had “advised that the old age home be repurposed to a substance abuse halfway house”, according to Lindiwe Mnguni of the Free State DSD.</li>\r\n \t<li>Almost R27-million for a <a href=\"https://www.groundup.org.za/article/r27-million-from-lottery-but-six-years-later-rehab-still-not-open/\">drug rehabilitation centre</a> in Nelspruit, between 2017 and 2021. When <i>GroundUp</i> visited the site early in November, construction was still underway on a Lottery-funded indoor sports centre on the edge of the rehab property. Late last year, neighbours close to the property told <i>GroundUp</i> that work on the site was still continuing;</li>\r\n \t<li>R15-million to stage an anti-drug musical, which was co-written and directed by Tsotsi star <a href=\"https://www.groundup.org.za/article/questions-surround-lottery-fund-musical-directed-by-tsotsi-star/\">Presley Chweneyagae</a>. But the production never undertook the major three-province tour that was promised.</li>\r\n \t<li>R144,000 for a research project in 2011/2012 that investigated the funding of non-profits in South Africa.</li>\r\n</ul>\r\n<h4><b>Life in the fast lane</b></h4>\r\n<span style=\"font-weight: 400;\">Pictures of Sigudhla on his personal Facebook page suggest he appears to enjoy a life of luxury and opulence. Investigative journalism team </span><i><span style=\"font-weight: 400;\">amaBhungane</span></i> <a href=\"https://amabhungane.org/stories/at-community-work-programme-family-and-staff-eat-first/\"><span style=\"font-weight: 400;\">reported in 2020</span></a><span style=\"font-weight: 400;\">: “Before shutting down his Facebook profile, he liked to post photos of his collection of cars and bottles of Moët & Chandon, and parties with local celebrities.”</span>\r\n\r\n<span style=\"font-weight: 400;\">In addition to its R67.5-million Lotteries money, the SAYM managed to collect millions from the Department of Cooperative Governance and Traditional Affairs (Cogta) for a Community Works Programme (CWP) in the Eastern Cape in 2018, </span><a href=\"https://amabhungane.org/stories/at-community-work-programme-family-and-staff-eat-first/\"><i><span style=\"font-weight: 400;\">amaBhungane</span></i> </a><span style=\"font-weight: 400;\">has reported.</span>\r\n\r\n<span style=\"font-weight: 400;\">Using Cogta records obtained through a Promotion of Access to Information Act application, </span><i><span style=\"font-weight: 400;\">amaBhungane</span></i><span style=\"font-weight: 400;\"> revealed that “at least ten contracts worth R13.6-million were awarded to companies run by SAYM staff, their business partners, and apparent members of Sigudhla’s family.”</span>\r\n\r\n<i><span style=\"font-weight: 400;\">amaBhungane</span></i><span style=\"font-weight: 400;\"> also </span><a href=\"https://amabhungane.org/stories/on-the-trail-of-the-cwps-orange-gear/\"><span style=\"font-weight: 400;\">reported </span></a><span style=\"font-weight: 400;\">how SAYM allegedly sourced protective clothing for participants in the CWP programme from a factory that Sigudhla set up in Pretoria to manufacture T-shirts, overalls, and hats to the specifications that the tender would require. The factory was set up just weeks before the tender was issued.</span>\r\n<h4><b>Evidence in Parliament</b></h4>\r\n<span style=\"font-weight: 400;\">Sigudhla was one of two SAYM officials who gave evidence at a Parliamentary hearing into a bill to amend the Lotteries Act.</span>\r\n\r\n<span style=\"font-weight: 400;\">The bill was introduced in 2013 and finally promulgated in 2015. In </span><a href=\"https://drive.google.com/file/d/116HzFE06lsdw7z4vneJrvOsOb0bvlRTw/view?usp=sharing\"><span style=\"font-weight: 400;\">his presentation</span></a><span style=\"font-weight: 400;\">, Sigudhla </span><a href=\"https://drive.google.com/file/d/116HzFE06lsdw7z4vneJrvOsOb0bvlRTw/view?usp=sharing\"><span style=\"font-weight: 400;\">refers to proactive funding</span></a><span style=\"font-weight: 400;\">, which has been suspended by the new board of the NLC. This is the first reference to proactive funding that </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> has been able to find.</span>\r\n\r\n<span style=\"font-weight: 400;\">Another suggestion by Sigudhla in his presentation was a change to the way members of the distributing agencies which adjudicate grant applications are chosen. Supported by the National House of Traditional Leaders, and the South African Youth Council, he suggested that the NLC board should recommend members to the Minister of Trade, Industry and Competition, who has oversight of the Lottery, for the minister to approve. The recommendation was not included in amendments to the legislation, and as a result, the members of the agencies are still appointed through a public nomination followed by interviews with candidates, after which the minister presents preferred candidates to the Cabinet for approval.</span>\r\n\r\n<span style=\"font-weight: 400;\">Commenting on amendments to the Lotteries Act, Mafisa said: “SAYM, as an organisation, has no capacity to convince the entire Parliament of South Africa to change the laws to favour itself. It is impossible. SAYM formed part of a group of organisations that presented to Parliament changes that many organisations wanted to see in the legislation.
