"contents": "<span style=\"font-weight: 400;\">On 25 July, South Africa’s Department of Justice </span><a href=\"https://www.justice.gov.za/m_statements/2022/20220725-MLA.html\"><span style=\"font-weight: 400;\">announced</span></a><span style=\"font-weight: 400;\"> that it received a request for mutual legal assistance from Spain regarding “</span><a href=\"https://www.dailymaverick.co.za/article/2021-04-20-auswell-tall-trains-mashaba-the-middleman-who-derailed-prasa/\"><span style=\"font-weight: 400;\">alleged corruption by Mr Makhensa Mabunda</span></a><span style=\"font-weight: 400;\"> and others, acting on behalf of Prasa for the supply of locomotives by a Spanish company, Vossloh Espana Sau”.</span>\r\n\r\n<span style=\"font-weight: 400;\">These requests were received on 9 March 2022 and 11 April 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">According to the press release, the NPA and Interpol are gathering evidence. It stated that “a court date is awaited from the office of the DPP [Director of Public Prosecutions]”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mabunda was one of the key organisers and profiteers from the </span><a href=\"https://www.dailymaverick.co.za/article/2020-03-03-gravy-trains-r500m-from-failed-prasa-locomotives-deal-fraudulently-funnelled-to-trust-private-accounts-and-properties/\"><span style=\"font-weight: 400;\">Swifambo deal</span></a><span style=\"font-weight: 400;\">, which resulted in Prasa buying locomotives that came to be known as the “</span><a href=\"https://www.dailymaverick.co.za/article/2022-07-26-groundhog-day-a-la-anc-prasa-chair-leonard-ramatlakanes-tall-train-lies/\"><span style=\"font-weight: 400;\">too-tall trains</span></a><span style=\"font-weight: 400;\">” deal. The deal was not just corrupt and fixed in favour of Vossloh España, but the locomotives, which were meant to service long-distance routes, exceeded the maximum height for South Africa’s lines. The locomotives were also a danger to the trains and to rail infrastructure.</span>\r\n\r\n<span style=\"font-weight: 400;\">Prasa paid R2.7-billion to Swifambo, the front company set up by Vossloh. Swifambo transferred R1.8-billion to Vossloh. In return, Prasa received 13 locomotives (R200-million per locomotive), none of which could be operated safely.</span>\r\n\r\n<span style=\"font-weight: 400;\">According to </span><a href=\"https://www.news24.com/News24/exclusive-prasas-spanish-supplier-paid-r75m-consulting-fees-to-montanas-friend-20180114\"><span style=\"font-weight: 400;\">news reports</span></a><span style=\"font-weight: 400;\">, Mabunda received R75-million from Vossloh España. A flow of funds analysis presented to the </span><a href=\"https://www.statecapture.org.za/site/files/announcements/668/OCR_version_-_State_Capture_Commission_Report_Part_V_Vol_II_-_SABC,Waterkloof,Prasa.pdf\"><span style=\"font-weight: 400;\">Judicial Commission of Inquiry into Allegations of State Capture</span></a><span style=\"font-weight: 400;\"> (Zondo Commission) by Swifambo’s liquidators, showed that Mabunda and companies under his control received R63-million from Swifambo’s holding company, and a further R17-million from Swifambo itself.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Zondo Commission heard evidence that Mabunda’s S-Group of companies received over R1-billion from Prasa for </span><a href=\"https://www.groundup.org.za/article/prasa-lawyers-try-stop-r59-million-payment-siyaya/\"><span style=\"font-weight: 400;\">various contracts</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Commuter activist group #UniteBehind told </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> that they “applaud the Spanish government and its criminal investigation authorities for finally taking action on corruption that was part of the destruction of commuter rail services in South Africa”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Since 2017, #UniteBehind has been calling for the prosecution of Mabunda and others involved in the </span><a href=\"https://www.groundup.org.za/article/npa-accused-failing-act-against-corruption-prasa/\"><span style=\"font-weight: 400;\">Swifambo deal</span></a><span style=\"font-weight: 400;\">. It picketed in 2019 outside the </span><a href=\"https://www.groundup.org.za/article/prosecute-prasa-thieves/\"><span style=\"font-weight: 400;\">NPA’s offices</span></a><span style=\"font-weight: 400;\">, and </span><a href=\"https://www.groundup.org.za/article/activist-call-international-authorities-prosecute-those-involved-state-capture/\"><span style=\"font-weight: 400;\">outside the German consulate</span></a><span style=\"font-weight: 400;\">. In 2015, Vossloh España, based in Valencia, was </span><a href=\"https://www.vossloh.com/en/press/press-releases/detail/pressdetail_2816.html\"><span style=\"font-weight: 400;\">sold by its German parent company</span></a><span style=\"font-weight: 400;\">, Vossloh, to Swiss rail company Stadler Rail AG.</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">The Hawks and NPA have thus far failed to prosecute any people responsible for the Swifambo/Vossloh España tender.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2018, the then-Prasa chairperson </span><a href=\"https://www.groundup.org.za/article/hawks-lose-challenge-against-prasa/\"><span style=\"font-weight: 400;\">Popo Molofe won a case against the Hawks</span></a><span style=\"font-weight: 400;\"> to compel the agency to finalise investigations into the Swifambo deal, among others. Despite this, no further action has been taken.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ryan Sacks, a forensic auditor appointed by the Hawks to investigate the Swifambo deal in 2015, </span><a href=\"https://www.dailymaverick.co.za/article/2021-07-15-former-prasa-chairpersons-company-got-r99m-in-ill-fated-locomotive-deal-inquiry-told/\"><span style=\"font-weight: 400;\">told the Zondo Commission</span></a><span style=\"font-weight: 400;\"> a flow-of-funds report was given to Brigadier Mmeli Makinyane and another member of General Alfred Khana’s team on 19 April 2017. After that Sacks heard nothing further from the Directorate for Priority Crime Investigation.</span>\r\n\r\n<span style=\"font-weight: 400;\">Chief Justice Zondo rejected the explanation by the Hawks on the stalled investigation into Swifambo, saying that it did not stand scrutiny and that the Hawks’ inaction was “disturbing”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Judgments — in the high court in 2017 and in the </span><a href=\"https://www.groundup.org.za/article/appeal-court-strikes-down-infamous-locomotive-contract/\"><span style=\"font-weight: 400;\">Supreme Court of Appeal in 2018</span></a><span style=\"font-weight: 400;\"> — found that Swifambo was a front for Vossloh España, and that the deal was riddled with corruption, with people working from inside Prasa to fix the deal for Vossloh/Swifambo. The SCA found that “Swifambo’s real role was undoubtedly to enable Vossloh to become the real bidder for the tender”.</span>\r\n\r\n<span style=\"font-weight: 400;\">In his report into state capture at Prasa, Chief Justice Zondo recommended that former Prasa CEO Lucky Montana, former Prasa Chairperson Sfiso Buthelezi (current Chairperson of Standing Committee on Appropriations), Swifambo’s CEO Auswell Mashaba, Mabunda, Prasa’s former chief engineer Daniel Mthimkhulu and others involved in the tender award should be prosecuted.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Zondo Commission heard evidence of Mabunda’s involvement in the Swifambo deal from the outset, when Mashaba, who would become Swifambo’s CEO, was approached by Mabunda to lead the front company. Mabunda was a former colleague of Montana in the Department of Public Enterprise.</span>\r\n\r\n<span style=\"font-weight: 400;\">Despite this background and the scandal surrounding the “too-tall trains” deal, Prasa Chairperson Leonard Ramatlakane </span><a href=\"https://www.dailymaverick.co.za/article/2022-07-22-fikile-mbalula-calls-on-prasa-board-to-stamp-out-corruption-threatens-to-wield-axe/\"><span style=\"font-weight: 400;\">wants to use these trains</span></a><span style=\"font-weight: 400;\">. In March 2020, </span><i><span style=\"font-weight: 400;\">GroundUp</span></i> <a href=\"https://www.groundup.org.za/article/why-prasa-still-trying-buy-trains-which-cant-be-used/\"><span style=\"font-weight: 400;\">reported</span></a><span style=\"font-weight: 400;\"> on Prasa and the Department of Transport’s efforts to keep the deal alive. Ramatlakane alleged that the reporting on the locomotives’ unsuitability was based on false information. But Ramatlakane’s claims have been </span><a href=\"https://www.dailymaverick.co.za/article/2022-07-26-groundhog-day-a-la-anc-prasa-chair-leonard-ramatlakanes-tall-train-lies/\"><span style=\"font-weight: 400;\">rebutted by Pieter-Louis Myburgh</span></a><span style=\"font-weight: 400;\">, the journalist that broke the too-tall train story.</span>\r\n\r\n<span style=\"font-weight: 400;\">“None of the companies and people involved should be allowed to profit from the racketeering and corruption,” #UniteBehind told </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\">.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> sought comment from the Spanish prosecutors, who said they could not comment. The NPA, Hawks, and Mabunda were contacted but did not respond.
