"contents": "<span style=\"font-weight: 400;\">A day after Public Protector Busisiwe Mkhwebane was </span><a href=\"https://www.dailymaverick.co.za/article/2022-06-09-exodus-president-cyril-ramaphosa-suspends-public-protector-busisiwe-mkhwebane/\"><span style=\"font-weight: 400;\">suspended</span></a><span style=\"font-weight: 400;\"> by President Cyril Ramaphosa, she lost her application for an interim prohibitory interdict of the impeachment proceedings in the Western Cape High Court.</span>\r\n\r\n<span style=\"font-weight: 400;\">Reading the judgment, Judge Nathan Erasmus said: “This court was enjoined to consider an application that, in the main, seeks to prevent organs of state from exercising powers specifically assigned to them by the Constitution.”</span>\r\n<p style=\"margin: 12px auto 6px auto; font-family: Helvetica,Arial,Sans-serif; font-style: normal; font-variant: normal; font-weight: normal; font-size: 14px; line-height: normal; font-size-adjust: none; font-stretch: normal; -x-system-font: none; display: block;\"> <a style=\"text-decoration: underline;\" title=\"View Public Protector v National Speaker + 16 JJM 10 Jun 2022 on Scribd\" href=\"https://www.scribd.com/document/577791844/Public-Protector-v-National-Speaker-16-JJM-10-Jun-2022#from_embed\">Public Protector v National Speaker + 16 JJM 10 Jun 2022</a> by <a style=\"text-decoration: underline;\" title=\"View janet's profile on Scribd\" href=\"https://www.scribd.com/user/389811916/janet#from_embed\">janet</a> on Scribd</p>\r\n<iframe id=\"doc_61496\" class=\"scribd_iframe_embed\" title=\"Public Protector v National Speaker + 16 JJM 10 Jun 2022\" src=\"https://www.scribd.com/embeds/577791844/content?start_page=1&view_mode=scroll&access_key=key-bDhklmzYR0X1AXwYaYG5\" width=\"100%\" height=\"600\" frameborder=\"0\" scrolling=\"no\" data-auto-height=\"false\" data-aspect-ratio=\"0.7024922118380063\"></iframe>\r\n\r\n<span style=\"font-weight: 400;\">The relief Mkhwebane sought included:</span>\r\n<ul>\r\n \t<li>The President is prohibited from taking any steps in pursuance of the suspension;</li>\r\n \t<li>The President is mandated to withdraw his <a href=\"https://www.dailymaverick.co.za/article/2022-03-18-facing-impeachment-mkhwebane-gets-10-days-to-convince-ramaphosa-to-spare-her-from-suspension/\">letter</a> to Mkhwebane dated 17 March, in which he asked her to provide reasons that she should not be suspended;</li>\r\n \t<li>The Speaker and/or National Assembly is/are prohibited from authorising the commencement and/or performance of any function(s) of the Committee established in terms of Section 194 of the Constitution.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Mkhwebane was seeking an order preventing the President from suspending her because, she argued, he was “highly conflicted” because she was investigating complaints against him. </span>\r\n\r\n<span style=\"font-weight: 400;\">Friday’s judgment comes after Mkwebane has repeatedly headed to court over the Section 194 committee in Parliament. </span>\r\n\r\n<span style=\"font-weight: 400;\">“The core contention advanced by Mkhwebane is that this entire inquiry process falls to be ‘stayed’ because she launched an application for the rescission and reconsideration of a refusal of a rescission of a judgment delivered against her in the apex court,” reads the judgment. </span>\r\n\r\n<span style=\"font-weight: 400;\">As Marianne Merten </span><a href=\"https://www.dailymaverick.co.za/article/2022-05-11-public-protector-impeachment-inquiry-to-go-ahead-never-mind-mkhwebanes-renewed-rescission-bid/\"><span style=\"font-weight: 400;\">reported</span></a><span style=\"font-weight: 400;\"> last month, </span><span style=\"font-weight: 400;\">Mkhwebane’s lawyers had written to Parliament, asking that the impeachment proceedings be delayed until the finalisation of her renewed rescission application to the Constitutional Court, against the dismissal of the earlier rescission application. According to her affidavit, a central issue was that the SMS leak that her application had been unsuccessful had “undermined justice”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The leak refers to the SMS sent to Parliament’s lead counsel by Ismail Abramjee, which read: “Hello Adv Breytenbach, Re: the Public Protector case tomorrow, I have it on very good authority that the ConCourt has declined to hear the Public Protector’s rescission application. The decision will be made known sometime this coming week but not later than Friday, I thought I’d share this with on a strictly confidential basis. Thanks.”</span>\r\n\r\n<span style=\"font-weight: 400;\">On 6 May 2022, the Constitutional Court dismissed Mkhwebane’s rescission application against the February judgment upholding Parliament’s impeachment process. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Constitutional Court judgment said: “The court has concluded that the rescission application does not establish any rescindable errors in the judgment. There are also no exceptional circumstances that warrant the rescission of the judgment”.</span>\r\n\r\n<span style=\"font-weight: 400;\">In Friday’s ruling, Judge Erasmus said “a strong signal needs to be sent that judgments handed down by the apex court are final, need to be obeyed, respected and cannot be circumvented through the device of a rescission application”.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Read in </span></i><span style=\"font-weight: 400;\">Daily Maverick</span><i><span style=\"font-weight: 400;\">: “</span></i><a href=\"https://www.dailymaverick.co.za/article/2022-06-09-exodus-president-cyril-ramaphosa-suspends-public-protector-busisiwe-mkhwebane/\"><i><span style=\"font-weight: 400;\">Exodus: President Cyril Ramaphosa suspends Public Protector Busisiwe Mkhwebane</span></i></a><i><span style=\"font-weight: 400;\">”</span></i>\r\n\r\n<span style=\"font-weight: 400;\">Regarding the costs of the litigation, the judge said Mkhwebane had been “less than candid” during “this unfortunate litigation between the parties”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Judge Erasmus continued: “it must have dawned on her shortly after the refusal of her rescission application handed down by the apex court, that the shields that she had raised to the inquiry process and the alleged bias of the third respondent [Cyril Ramaphosa] were doomed to failure.
