"contents": "<span style=\"font-weight: 400;\">Since the eruption of the Ukraine-Russia conflict in February 2022, South Africa has maintained a “</span><a href=\"https://www.dailymaverick.co.za/opinionista/2023-02-22-the-war-in-ukraine-and-the-future-of-the-non-aligned-movement/\"><span style=\"font-weight: 400;\">non-aligned</span></a><span style=\"font-weight: 400;\">” approach,</span><a href=\"https://www.gov.za/speeches/minister-naledi-pandor-russia-ukraine-conflict-8-apr-2022-0000\"> <span style=\"font-weight: 400;\">arguing</span></a><span style=\"font-weight: 400;\"> that “peaceful dialogue”, “mediation”, “negotiation” and “diplomacy” are the only “constructive solutions” that will end the conflict.</span>\r\n\r\n<span style=\"font-weight: 400;\">Further, it has abstained from voting in favour of every resolution by the United Nations General Assembly’s</span><a href=\"https://www.un.org/en/ga/sessions/emergency11th.shtml\"> <span style=\"font-weight: 400;\">Emergency Special Session</span></a><span style=\"font-weight: 400;\"> that has condemned Russia’s aggression and commission of gross human rights violations.</span>\r\n\r\n<span style=\"font-weight: 400;\">Yet, doubt is increasingly cast upon South Africa’s proclaimed neutrality on the conflict.</span>\r\n\r\n<span style=\"font-weight: 400;\">Some recent examples include</span><a href=\"https://www.bbc.com/news/world-64380572\"> <span style=\"font-weight: 400;\">joint military drills</span></a><span style=\"font-weight: 400;\"> with Russia and China that overlapped the first anniversary of the outbreak of the conflict, International Relations Minister Naledi Pandor’s</span><a href=\"https://www.iol.co.za/news/politics/we-cannot-be-forced-to-dump-russia-says-naledi-pandor-702b1a1a-5d0f-4a02-bc40-194cca5c8912\"> <span style=\"font-weight: 400;\">repeated emphasis</span></a><span style=\"font-weight: 400;\"> that Russia is a “</span><a href=\"https://www.youtube.com/watch?v=NPwKK8t5vVU\"><span style=\"font-weight: 400;\">historic friend</span></a><span style=\"font-weight: 400;\">”,</span><a href=\"https://www.aljazeera.com/news/2023/5/12/south-africa-rejects-us-accusations-of-arms-shipment-to-russia\"> <span style=\"font-weight: 400;\">allegations</span></a><span style=\"font-weight: 400;\"> that the government supplied arms and ammunition to Russia, chief of the South African army Lieutenant-General Lawrence Mbatha’s</span><a href=\"https://twitter.com/SANDF_ZA/status/1658263391566274560/photo/1\"> <span style=\"font-weight: 400;\">meeting</span></a><span style=\"font-weight: 400;\"> with his Russian counterpart, General Oleg Salyukov, “to discuss matters of mutual interest”, as well as a</span><a href=\"http://en.kremlin.ru/events/president/news/71120\"> <span style=\"font-weight: 400;\">telephone conversation</span></a><span style=\"font-weight: 400;\"> between Russian President Vladimir Putin and SA President Cyril Ramaphosa where they “expressed a desire to further step up mutually beneficial ties in various areas”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Another factor casting serious doubt on South Africa’s proclaimed neutrality is its response to the </span><a href=\"https://www.icc-cpi.int/news/situation-ukraine-icc-judges-issue-arrest-warrants-against-vladimir-vladimirovich-putin-and\"><span style=\"font-weight: 400;\">ICC’s </span><span style=\"font-weight: 400;\">arrest warrant</span></a><span style=\"font-weight: 400;\"> against Putin. Putin is accused of the war crime of unlawfully deporting and transferring children from occupied territory in Ukraine, but the ICC</span><a href=\"https://www.icc-cpi.int/news/statement-icc-prosecutor-karim-aa-khan-qc-situation-ukraine-receipt-referrals-39-states\"> <span style=\"font-weight: 400;\">is also investigating</span></a><span style=\"font-weight: 400;\"> genocide and crimes against humanity.</span>\r\n\r\n<span style=\"font-weight: 400;\">Earlier this year, Putin was</span><a href=\"https://www.news24.com/news24/politics/parliament/ramaphosa-formally-invited-alleged-war-criminal-putin-to-sa-cabinet-is-still-looking-for-a-way-out-20230418\"> <span style=\"font-weight: 400;\">formally invited</span></a><span style=\"font-weight: 400;\"> to attend a BRICS summit scheduled to take place in South Africa in August. However, there are already strong indicators that the government will not execute the warrant should he attend in person.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Department of International Relations indicated that it was seeking a</span><a href=\"https://www.news24.com/news24/politics/parliament/ramaphosa-formally-invited-alleged-war-criminal-putin-to-sa-cabinet-is-still-looking-for-a-way-out-20230418\"> <span style=\"font-weight: 400;\">legal opinion</span></a><span style=\"font-weight: 400;\"> on whether there is indeed an obligation to arrest and surrender Putin to the ICC.</span>\r\n\r\n<span style=\"font-weight: 400;\">In April, Ramaphosa sowed confusion when he stated that South Africa would withdraw from the ICC,</span><a href=\"https://www.gov.za/speeches/south-africa-remains-participant-international-criminal-court-26-apr-2023-0000\"> <span style=\"font-weight: 400;\">contradicting</span></a><span style=\"font-weight: 400;\"> a December 2022 ANC</span><a href=\"https://www.anc1912.org.za/wp-content/uploads/2023/02/ANC-55th-Conference-Resolutions-INTERNATIONAL-RELATIONS.pdf\"> <span style=\"font-weight: 400;\">resolution</span></a><span style=\"font-weight: 400;\"> that the government must “rescind” its withdrawal from the ICC.</span>\r\n\r\n<span style=\"font-weight: 400;\">Then, on 29 May, Naledi Pandor</span><a href=\"https://www.gov.za/sites/default/files/gcis_document/202305/48668gon3472.pdf\"> <span style=\"font-weight: 400;\">gazetted a notice</span></a><span style=\"font-weight: 400;\"> granting general immunity “to the participants of the BRICS Ministerial Meeting and the BRICS summit for the duration of both meetings”. Although such a notice granting immunity to attendees of international events is not unusual in itself, the direct upshot of this particular notice is that Putin might be protected by the government should he attend the summit in person.</span>\r\n\r\n<span style=\"font-weight: 400;\">These unfolding events point to the advent of the prediction of the Supreme Court of Appeal in 2017 that the issues raised in the Al-Bashir case will continue to be a “live and justiciable controversy” and an issue “of public importance that will have an effect on future matters” for South Africa.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2015, South Africa was faced with executing ICC arrest warrants for war crimes, crimes against humanity and genocide against another political ally, the then president of Sudan, Omar al-Bashir. Al-Bashir attended an African Union summit hosted by South Africa, but the government failed to arrest and surrender him to the ICC.</span>\r\n\r\n<span style=\"font-weight: 400;\">The government's justification was that a “host agreement” published as a notice in the </span><i><span style=\"font-weight: 400;\">Government Gazette</span></i><span style=\"font-weight: 400;\"> granting immunity to delegates and attendees “provided the requisite reprieve to South Africa not to comply with its ICC obligations of arresting President Bashir during his attendance of the summit”.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, the</span><a href=\"http://www.saflii.org/za/cases/ZAGPPHC/2015/402.pdf\"> <span style=\"font-weight: 400;\">high court</span></a><span style=\"font-weight: 400;\"> explicitly held that the</span><a href=\"https://www.gov.za/documents/implementation-rome-statute-international-criminal-court-act-0\"> <span style=\"font-weight: 400;\">implementation of the Rome Statute of the International Criminal Court Act</span></a><span style=\"font-weight: 400;\"> “enjoys legislative authority, having passed through Parliament, and it cannot be displaced by a notice promulgated by a Minister or by a Cabinet decision”.</span>\r\n\r\n<span style=\"font-weight: 400;\">On appeal, the</span><a href=\"http://www.saflii.org/za/cases/ZASCA/2016/17.pdf\"> <span style=\"font-weight: 400;\">Supreme Court of Appeal</span></a><span style=\"font-weight: 400;\"> confirmed this, emphasising that the act’s exclusion of immunity to anyone “is a clear indication that South Africa does not support immunities when people are charged with international crimes”, and that the </span><i><span style=\"font-weight: 400;\">Government Gazette</span></i><span style=\"font-weight: 400;\"> notice unmistakably “demonstrated that as far as South Africa was concerned this involved a departure from its commitment to its obligations under the Rome Statute”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The</span><a href=\"https://www.icc-cpi.int/sites/default/files/CourtRecords/CR2017_04402.PDF\"> <span style=\"font-weight: 400;\">ICC</span></a><span style=\"font-weight: 400;\"> also decided on the matter, stating that South Africa, when it “voluntarily ratified the Statute”, accepted that “immunities based on official capacity, including those that they may otherwise possess under international law” are clearly excluded and “rendered inapplicable”.</span>\r\n<h4><b>‘Mediator for peace’</b></h4>\r\n<span style=\"font-weight: 400;\">Concurrent with these court proceedings, the government declared its intention to withdraw its membership of the ICC, labelling its obligation to arrest and surrender accused persons to the court a hindrance to its “</span><a href=\"https://www.justice.gov.za/m_speeches/2017/20171206-ICC.html\"><span style=\"font-weight: 400;\">role as mediator for peace</span></a><span style=\"font-weight: 400;\">” in conflict situations.</span>\r\n\r\n<span style=\"font-weight: 400;\">The domestic legislative process initially involved the introduction of a</span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201611/b23-2016implementationofromestatuteactrepeal161103.pdf\"> <span style=\"font-weight: 400;\">Bill repealing</span></a><span style=\"font-weight: 400;\"> the Implementation Act, which was shortly thereafter withdrawn and replaced with the</span><a href=\"https://www.parliament.gov.za/storage/app/media/Bills/2017/B37_2017_International_Crimes_Bill/B37_2017_International_Crimes_Bill.pdf\"> <span style=\"font-weight: 400;\">International Crimes Bill</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">This Bill also aimed to repeal the Implementation Act, but further set out to guarantee absolute immunity from arrest and prosecution to incumbent senior government officials, as well as enabling South Africa to resolve conflicts through diplomacy and dialogue.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, the bill was ultimately</span><a href=\"https://pmg.org.za/bill/751/\"> <span style=\"font-weight: 400;\">withdrawn</span></a><span style=\"font-weight: 400;\"> on 10 March this year, incidentally exactly a week before the ICC issued its arrest warrant against Putin.</span>\r\n\r\n<span style=\"font-weight: 400;\">Unfortunately, the ruling party’s decision to remain a member state of the ICC did not indicate a larger shift in the government’s standpoint, as is illustrated by Ramaphosa’s statement regarding withdrawal from ICC membership.</span>\r\n\r\n<span style=\"font-weight: 400;\">The timing of the government’s backlash against Putin’s arrest warrant therefore suggests that this is not based on an established governmental principle, but more accurately to safeguard Putin in particular from ICC prosecution.</span>\r\n\r\n<span style=\"font-weight: 400;\">If all these arguments of the government were a true reflection of its principles relating to international criminal justice, there has been ample time to align our domestic law with it. The government could either have adopted the International Crimes Bill, or it could simply have amended the existing Implementation Act.</span>\r\n\r\n<span style=\"font-weight: 400;\">Instead, it completely withdrew the former and has not made any move towards amending the latter. The current legal obligations on South Africa, in terms of domestic and international law, as well as the three courts’ decisions, are therefore clear: the government must arrest and surrender Putin to the ICC should he enter South African territory.</span>\r\n\r\n<span style=\"font-weight: 400;\">All these obligations have been undertaken voluntarily, indicating that the government attaches importance to the prosecution of anyone accused of committing international crimes to ensure that they do not enjoy impunity.</span>\r\n\r\n<span style=\"font-weight: 400;\">Unfortunately, at this stage, a number of objective facts indicate that South Africa will once again prioritise its continued good political and economic relations with another “historic friend” by bestowing its head of state with immunity.</span>\r\n\r\n<span style=\"font-weight: 400;\">It remains to be seen whether the Al-Bashir arguments will be rehashed — for example that the recent </span><i><span style=\"font-weight: 400;\">Government Gazette</span></i><span style=\"font-weight: 400;\"> notice trumps any obligations in terms of domestic or international law; whether the</span><a href=\"https://www.timeslive.co.za/politics/2023-04-28-malema-how-i-wish-president-putin-could-make-a-turn-in-cape-town/\"> <span style=\"font-weight: 400;\">support base</span></a><span style=\"font-weight: 400;\"> in favour of granting Putin immunity will grow; or whether there is any truth to threats that arresting Putin would be a “</span><a href=\"https://ewn.co.za/2023/05/15/anc-says-russian-party-warned-that-if-sa-arrests-putin-it-s-a-war-declaration\"><span style=\"font-weight: 400;\">declaration of war</span></a><span style=\"font-weight: 400;\">”.</span>\r\n\r\n<span style=\"font-weight: 400;\">South Africa is therefore called upon to honour the main purpose of international criminal justice: to protect victims of genocide, crimes against humanity and war crimes by holding their perpetrators criminally responsible. South Africa entrenched this purpose as binding domestic law when it adopted the Implementation Act.</span>\r\n\r\n<span style=\"font-weight: 400;\">The government is further urged to make it unequivocally clear that any person against whom an ICC arrest warrant has been issued who enters South African territory will be arrested and surrendered to the court for prosecution.</span>\r\n\r\n<span style=\"font-weight: 400;\">This will, once again, place South Africa “in the vanguard of attempts to prevent international crimes and, when they occur, cause the perpetrators to be prosecuted, that [is] a matter for national pride rather than concern. It is wholly consistent with our commitment to human rights both at a national and an international level.” (</span><a href=\"http://www.saflii.org/za/cases/ZASCA/2016/17.html\"><i><span style=\"font-weight: 400;\">Minister of Justice and Constitutional Development v Southern Africa Litigation Centre 2016 3 SA 317 (SCA) at para 103</span></i></a><span style=\"font-weight: 400;\">). </span><b>DM</b>",
