"contents": "<span style=\"font-weight: 400;\">South Africa’s</span><a href=\"https://www.theguardian.com/world/2020/mar/23/south-africa-to-go-into-21-day-lockdown-on-thursday-night\"> <span style=\"font-weight: 400;\">lockdown</span></a><span style=\"font-weight: 400;\"> period in response to the Covid-19 pandemic included a temporary</span><a href=\"https://www.nytimes.com/2020/05/08/world/africa/coronavirus-south-africa-tobacco-alcohol-ban.html\"> <span style=\"font-weight: 400;\">ban</span></a><span style=\"font-weight: 400;\"> on the sale of tobacco and alcohol products. South Africa was one of a</span><a href=\"https://ggtc.world/2020/04/23/bans-contemplated-bans-on-tobacco-vaping-products/\"> <span style=\"font-weight: 400;\">handful of countries</span></a><span style=\"font-weight: 400;\"> to take such measures. The tobacco industry has been highly critical of the ban, with large companies like British American Tobacco South Africa (Batsa), Phillip Morris South Africa (PMSA), and Japan Tobacco International (JTI) as well as smaller local tobacco companies urging the government to reverse the ban while instituting legal actions against it.</span>\r\n\r\n<span style=\"font-weight: 400;\">In addition to claiming that the ban would force consumers to</span><a href=\"https://ewn.co.za/2020/04/05/batsa-warns-cigarette-ban-risks-lockdown-defiance-by-desperate-smokers\"> <span style=\"font-weight: 400;\">defy the lockdown</span></a><span style=\"font-weight: 400;\">, and</span><a href=\"http://southafrica.watsupafrica.com/news/tobacco-companies-against-ban/\"> <span style=\"font-weight: 400;\">damage the state budget</span></a><span style=\"font-weight: 400;\">, Batsa, JTI, PMSA and The South Africa Tobacco Transformation Alliance (of which Batsa is a member), have</span><a href=\"https://www.dailymaverick.co.za/article/2020-05-06-bat-spat-tobacco-giant-drops-legal-action-to-pursue-talks-on-cigarette-ban/\"> <span style=\"font-weight: 400;\">argued</span></a><span style=\"font-weight: 400;\"> that the ban will increase South Africa’s illicit tobacco trade. The illicit tobacco trade can be</span><a href=\"https://apps.who.int/iris/bitstream/handle/10665/80873/9789241505246_eng.pdf?sequence=1\"> <span style=\"font-weight: 400;\">defined</span></a><span style=\"font-weight: 400;\"> as any practice prohibited by law which relates to the production, shipment, receipt, possession or distribution, sale or purchase of tobacco, and is acknowledged by</span><a href=\"https://tobaccocontrol.bmj.com/content/early/2019/08/05/tobaccocontrol-2018-054798\"> <span style=\"font-weight: 400;\">both industry and independent data</span></a><span style=\"font-weight: 400;\"> as being a significant problem in the country.</span>\r\n\r\n<span style=\"font-weight: 400;\">After</span><a href=\"https://www.capetownetc.com/news/british-american-tobacco-retracts-case-against-government/\"> <span style=\"font-weight: 400;\">on and off</span></a><span style=\"font-weight: 400;\"> threats of legal action against the government over the ban, Batsa and JTI have</span><a href=\"https://www.dailymaverick.co.za/article/2020-05-29-tobacco-giants-batsa-and-jti-head-to-court-over-tobacco-ban/\"> <span style=\"font-weight: 400;\">taken the government to court</span></a><span style=\"font-weight: 400;\"> to oppose the ban. The Fair Trade Independent Tobacco Association (Fita), which represents 80% of licensed tobacco manufacturers in South Africa, most of which are local and smaller manufacturers, also took the government to court to have the ban overturned. Fita’s affidavit for the court case</span><a href=\"https://www.iol.co.za/news/politics/fita-says-tobacco-ban-is-increasing-illicit-trade-of-cigarettes-47585340\"> <span style=\"font-weight: 400;\">argued</span></a><span style=\"font-weight: 400;\"> that “the prohibition has well-recognised negative results in the form of increased illicit trade”. While Fita’s legal challenge was</span><a href=\"http://www1.saflii.org/za/cases/ZAGPPHC/2020/246.html\"> <span style=\"font-weight: 400;\">recently dismissed</span></a><span style=\"font-weight: 400;\"> by the High Court in South Africa, the outcome of Batsa and JTI’s challenge</span><a href=\"https://www.iol.co.za/news/politics/legal-battle-over-ban-on-sale-of-cigarettes-drags-on-as-online-petition-gains-momentum-49804716\"> <span style=\"font-weight: 400;\">has yet to be decided</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">The government is now in a difficult situation, working to defend the ban against the industry’s legal challenges which, if successful, would create a worrying precedent of the industry successfully overturning tobacco control measures in South Africa. Recently, Minister Nkosazana Dlamini Zuma of the Cooperative Governance and Traditional Affairs Ministry, which is responsible for the regulation of the Disaster Management Act, responded to the legal action, doubling down on the importance of the temporary ban and arguing that South Africa’s illicit trade problem has been around for decades and cannot be attributed to the ban alone. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, in early May 2020, the South African Revenue Service (SARS)</span><a href=\"https://ewn.co.za/2020/05/05/sars-revises-expected-revenue-loss-due-to-illicit-lockdown-trade-to-r1-7bn\"> <span style=\"font-weight: 400;\">collated data</span></a><span style=\"font-weight: 400;\"> related to the illicit market which indicated that the illicit economy was growing under the lockdown and</span><a href=\"http://www.reep.uct.ac.za/sites/default/files/image_tool/images/405/Publications/reports/Lockdown%20Survey%20Final.pdf\"><span style=\"font-weight: 400;\"> early reports</span></a><span style=\"font-weight: 400;\"> suggest that some consumers have been able to access tobacco during the ban via informal markets. Regardless of the ultimate impact of the ban on South Africa’s illicit market, the tobacco industry’s use of this argument has been duplicitous, to say the least.</span>\r\n<blockquote><span style=\"font-weight: 400;\">Were the industry really concerned about illicit trade, it would take effective measures to control its supply chain and not oppose government efforts to implement effective policy to address illicit trade. This has not been the case. </span></blockquote>\r\n<span style=\"font-weight: 400;\">The tobacco industry’s actions have repeatedly demonstrated that it is neither committed to addressing South Africa’s illicit trade problem nor a trusted source on the topic. </span>\r\n\r\n<span style=\"font-weight: 400;\">For example, the industry has</span><a href=\"https://www.dailymaverick.co.za/article/2019-06-09-shameless-and-blameless-how-big-tobacco-is-trying-to-dupe-everyone-and-what-sars-should-do-about-it/#gsc.tab=0\"> <span style=\"font-weight: 400;\">aggressively</span></a><span style=\"font-weight: 400;\"> opposed the best tool for monitoring illicit trade – SARS’ tender process for a tracking and tracing system. This </span><span style=\"font-weight: 400;\">would have been a means of controlling illicit trade by tracking tobacco products through the supply chain and would have made it possible to track the impact of the tobacco ban on South Africa’s illicit trade. Instead, the tobacco industry</span><a href=\"https://citizen.co.za/news/south-africa/crime/2135107/tobacco-institute-warns-against-rushed-system-for-tracking-illegal-cigarettes/\"> <span style=\"font-weight: 400;\">criticised</span></a><span style=\"font-weight: 400;\"> SARS’ efforts to deploy this effective tool.</span>\r\n\r\n<span style=\"font-weight: 400;\">The original announcement of the tender process received</span><a href=\"https://citizen.co.za/news/south-africa/crime/2135107/tobacco-institute-warns-against-rushed-system-for-tracking-illegal-cigarettes/\"> <span style=\"font-weight: 400;\">extensive criticism</span></a><span style=\"font-weight: 400;\"> from the,</span><a href=\"https://citizen.co.za/news/south-africa/investigation/2233087/soon-to-be-defunct-sa-tobacco-institute-to-ramp-up-resources-in-fight-against-illegal-cigarette-trade/\"> <span style=\"font-weight: 400;\">now defunct</span></a><span style=\"font-weight: 400;\">, Tobacco Institute of Southern Africa (Tisa), an organisation whose members</span><a href=\"https://web.archive.org/web/20190420165811/http:/www.tobaccosa.co.za/about/our-members\"> <span style=\"font-weight: 400;\">included</span></a><span style=\"font-weight: 400;\"> Batsa, PMSA, Japan Tobacco International and Imperial Tobacco. Tisa described the tender as a “rushed process” which would </span><span style=\"font-weight: 400;\">“impose excessive and impractical regulatory burdens on small retailers” and “only encourage retailers to sell illegal products”. After extensive delays, the tender has since been</span><a href=\"https://www.sars.gov.za/Procurement/Pages/Cancelled-Tenders--.aspx\"> <span style=\"font-weight: 400;\">cancelled</span></a><span style=\"font-weight: 400;\"> and Fita has</span><a href=\"https://city-press.news24.com/News/sars-boss-accused-of-bowing-to-big-tobacco-20200510\"> <span style=\"font-weight: 400;\">argued</span></a><span style=\"font-weight: 400;\"> that this is due to the influence that transnational tobacco companies have over the government. </span>\r\n\r\n<span style=\"font-weight: 400;\">To add salt to the wound, during the lockdown, SARS </span><a href=\"https://www.sars.gov.za/Legal/Secondary-Legislation/Rule-Amendments/Pages/2020.aspx\"><span style=\"font-weight: 400;\">issued a regulation</span></a><span style=\"font-weight: 400;\"> requiring counting devices to monitor cigarette production. This is a measure which the industry has</span><a href=\"https://web.archive.org/web/20181221103608/http:/www.tobaccosa.co.za/wp-content/uploads/TISA-IPSOS-Media-Presentation-05-July-2018.pdf\"> <span style=\"font-weight: 400;\">recommended</span></a><span style=\"font-weight: 400;\"> in recent months and is a far cry from the implementation of a robust tracking and tracing system. Unsurprisingly, SARS’ adoption of this approach rather than comprehensive tracking and tracing of tobacco products has been</span><a href=\"https://www.news24.com/fin24/Economy/sars-fight-against-illicit-cigarette-trade-backed-by-industry-players-20190430\"> <span style=\"font-weight: 400;\">welcomed</span></a><span style=\"font-weight: 400;\"> by both Tisa and Fita. </span>\r\n\r\n<span style=\"font-weight: 400;\">This is the latest in</span><a href=\"https://www.dailymaverick.co.za/article/2019-06-09-shameless-and-blameless-how-big-tobacco-is-trying-to-dupe-everyone-and-what-sars-should-do-about-it/\"> <span style=\"font-weight: 400;\">a number of</span></a><span style=\"font-weight: 400;\"> successful attempts by the tobacco industry to undermine SARS in South Africa, and in the </span><span style=\"font-weight: 400;\">extensive history of the tobacco industry facilitating illicit trade across</span><a href=\"https://tobaccocontrol.bmj.com/content/17/5/339\"> <span style=\"font-weight: 400;\">Africa</span></a><span style=\"font-weight: 400;\">. SARS even had a</span><a href=\"https://www.news24.com/news24/SouthAfrica/News/tobacco-industry-insiders-behind-initial-attacks-on-sars-former-unit-head-20160824\"><span style=\"font-weight: 400;\"> project</span></a><span style=\"font-weight: 400;\"> established specifically to address South Africa’s illicit trade which led to BAT becoming the subject of in-depth audits, although the investigation was later</span><a href=\"https://www.dailymaverick.co.za/article/2017-02-10-sars-wars-suspension-of-the-last-remaining-key-official-jeopardises-tobacco-war-cases/#gsc.tab=0\"> <span style=\"font-weight: 400;\">quashed</span></a><span style=\"font-weight: 400;\"> due to</span><a href=\"https://www.dailymaverick.co.za/article/2016-09-07-sars-wars-purge-has-left-sars-criminal-investigative-capacity-vulnerable/#gsc.tab=0\"> <span style=\"font-weight: 400;\">BAT interference</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Batsa has not appeared to have stopped producing cigarettes during the ban, with SARS</span><a href=\"https://youtu.be/bPldi8ily2A?t=1035\"> <span style=\"font-weight: 400;\">reportedly</span></a><span style=\"font-weight: 400;\"> raiding a BAT factory</span><a href=\"https://www.timeslive.co.za/politics/2020-05-05-failing-companies-booze-cig-bans-lead-to-r285bn-drop-in-tax-revenue/\"> <span style=\"font-weight: 400;\">which continued to produce cigarettes</span></a><span style=\"font-weight: 400;\"> during the ban. The company would have an incentive to continue producing goods for the South African market.</span><span style=\"font-weight: 400;\"> Evidence from the</span><a href=\"http://www.reep.uct.ac.za/sites/default/files/image_tool/images/405/Publications/reports/Lockdown%20Survey%20Final.pdf\"> <span style=\"font-weight: 400;\">recent survey</span></a><span style=\"font-weight: 400;\"> conducted by the Research Unit on the Economics of Excisable Products at the University of Cape Town indicates that there has been a huge switch away from transnational tobacco company brands during the lockdown with most brands purchased since the ban having been produced by local tobacco </span><span style=\"font-weight: 400;\">producers in South Africa.</span>\r\n\r\n<span style=\"font-weight: 400;\">Were the industry really concerned about illicit trade, it would take effective measures to control its supply chain and not oppose government efforts to implement effective policy to address illicit trade. This has not been the case. </span>\r\n\r\n<span style=\"font-weight: 400;\">Rather, just like in the past, the tobacco industry’s actions have been largely limited to using illicit trade as an argument against tobacco control measures. For example, Tisa paid social media influencers to promote the</span><a href=\"https://tobaccotactics.org/wiki/yusuf-abramjee/\"> <span style=\"font-weight: 400;\">#TakeBackTheTax</span></a> <span style=\"font-weight: 400;\">campaign, which drew on narratives about illicit trade, to oppose</span><a href=\"https://www.tobaccosa.co.za/wp-content/uploads/2019/06/SUMMARY-Control-of-Tobacco-Products-and-Electronic-Delivery-Systems-Bill.pdf\"> <span style=\"font-weight: 400;\">the </span><span style=\"font-weight: 400;\">Control of Tobacco Products and Electronic Delivery Systems Bill</span></a><span style=\"font-weight: 400;\">. </span><span style=\"font-weight: 400;\">Often the only evidence to support these narratives came from industry-funded research which, when compared with independent data, consistently overestimated the scale of illicit tobacco – as Tisa did</span><a href=\"https://tobaccocontrol.bmj.com/content/24/e2/e142\"> <span style=\"font-weight: 400;\">in South Africa</span></a> <span style=\"font-weight: 400;\">for years.</span>\r\n\r\n<span style=\"font-weight: 400;\">The tobacco industry’s behaviour during South Africa’s lockdown is another example of its</span><a href=\"https://blogs.bmj.com/tc/2020/05/10/the-two-faces-of-the-tobacco-industry-during-the-covid-19-pandemic/\"> <span style=\"font-weight: 400;\">already documented</span></a><span style=\"font-weight: 400;\"> duplicity throughout the Covid-19 pandemic. The tobacco industry is far from a trustworthy voice as its primary focus is on protecting its ability to sell its deadly products rather than on protecting the health of its consumers. </span><b>DM</b>\r\n\r\n<i><span style=\"font-weight: 400;\">Allen Gallagher is a research associate in the Tobacco Control Research Group at the University of Bath, a partner in STOP, a global tobacco industry watchdog.
