This echoes the enduring</span><a href=\"https://www.oecd.org/sti/inno/2102514.pdf\"> <span style=\"font-weight: 400;\">tension</span></a><span style=\"font-weight: 400;\"> between innovation and regulation.</span>\r\n\r\n<span style=\"font-weight: 400;\">The</span><a href=\"https://www.bbc.com/news/world-us-canada-65934887\"><span style=\"font-weight: 400;\"> tragic</span></a><span style=\"font-weight: 400;\"> loss of life aboard the Titan submersible at the Titanic wreckage serves as a poignant metaphor for the AI era, where the allure of greatness interweaves with danger. The passengers of the Titan were enticed by the promise of awe-inspiring sights, but the risk-taking of an</span><a href=\"https://www.cbsnews.com/news/missing-submarine-titanic-implosion-oceangate-rules-tourism/\"> <span style=\"font-weight: 400;\">unregulated</span></a><span style=\"font-weight: 400;\"> venture resulted in their needless demise.</span>\r\n\r\n<span style=\"font-weight: 400;\">The tragedy is a reminder that we should not ignore expert</span><a href=\"https://www.nytimes.com/2023/06/20/us/oceangate-titanic-missing-submersible.html\"> <span style=\"font-weight: 400;\">warnings</span></a><span style=\"font-weight: 400;\"> and</span><a href=\"https://www.reuters.com/world/us/missing-titanic-sub-experts-raised-safety-concerns-about-oceangate-titan-2018-2023-06-21/\"> <span style=\"font-weight: 400;\">downplay safety</span></a><span style=\"font-weight: 400;\"> on the altar of progress and</span><a href=\"https://www.insider.com/oceangate-ceo-stockton-rush-broken-some-rules-titanic-sub-remembered-2023-6\"> <span style=\"font-weight: 400;\">innovation</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">AI is anticipated to bring about substantial economic growth, with</span><a href=\"https://www.gspublishing.com/content/research/en/reports/2023/03/27/d64e052b-0f6e-45d7-967b-d7be35fabd16.html\"> <span style=\"font-weight: 400;\">Goldman Sachs</span></a><span style=\"font-weight: 400;\">,</span><a href=\"https://www.mckinsey.com/capabilities/mckinsey-digital/our-insights/the-economic-potential-of-generative-ai-the-next-productivity-frontier#/auth-download/%2F~%2Fmedia%2Fmckinsey%2Fbusiness%20functions%2Fmckinsey%20digital%2Four%20insights%2Fthe%20economic%20potential%20of%20generative%20ai%20the%20next%20productivity%20frontier%2Fthe-economic-potential-of-generative-ai-the-next-productivity-frontier-vf.pdf\"> <span style=\"font-weight: 400;\">McKinsey</span></a><span style=\"font-weight: 400;\">, and</span><a href=\"https://www.mckinsey.com/capabilities/mckinsey-digital/our-insights/the-economic-potential-of-generative-ai-the-next-productivity-frontier#/auth-download/%2F~%2Fmedia%2Fmckinsey%2Fbusiness%20functions%2Fmckinsey%20digital%2Four%20insights%2Fthe%20economic%20potential%20of%20generative%20ai%20the%20next%20productivity%20frontier%2Fthe-economic-potential-of-generative-ai-the-next-productivity-frontier-vf.pdf\"> <span style=\"font-weight: 400;\">PwC</span></a><span style=\"font-weight: 400;\"> projecting an increase in global GDP by as much as 7% or a staggering $7.3-trillion.</span>\r\n\r\n<span style=\"font-weight: 400;\">Despite these prospects,</span><a href=\"https://www.aljazeera.com/news/2023/5/23/governments-race-to-regulate-artificial-intelligence-tools\"> <span style=\"font-weight: 400;\">governments</span></a><span style=\"font-weight: 400;\"> worldwide, both in developed and developing nations, along with AI</span><a href=\"https://garymarcus.substack.com/p/two-models-of-ai-oversight-and-how?utm_source=twitter&sd=pf\"> <span style=\"font-weight: 400;\">experts</span></a><span style=\"font-weight: 400;\">, have raised concerns about the risks and proposed regulatory measures.</span>\r\n\r\n<span style=\"font-weight: 400;\">In contrast, South Africa’s political leadership has only generically</span><a href=\"https://www.gov.za/sites/default/files/gcis_document/202010/43834gen591.pdf\"> <span style=\"font-weight: 400;\">acknowledged</span></a><span style=\"font-weight: 400;\"> the potential benefits of AI while giving little attention to its multifaceted</span><a href=\"https://theconversation.com/artificial-intelligence-in-south-africa-comes-with-special-dilemmas-plus-the-usual-risks-194277\"> <span style=\"font-weight: 400;\">risks</span></a><span style=\"font-weight: 400;\">. In doing so, they inadvertently prioritise innovation while overlooking the hazards.</span>\r\n<h4><b>Apathy of the political class</b></h4>\r\n<span style=\"font-weight: 400;\">In South Africa, the regulatory void is compounded by the lack of evidence that policymakers, legislators, or political parties fully appreciate the epoch-defining nature of AI. Several points highlight this relative disinterest.</span>\r\n\r\n<span style=\"font-weight: 400;\">Firstly, there is a distinct lack of focus on AI among top officials and within policy documents. The most recent mention of AI in the State of the Nation Address dates back to</span><a href=\"https://techcentral.co.za/ramaphosas-remarkably-tech-focused-sona-what-he-said-about-ict/178212/\"> <span style=\"font-weight: 400;\">2019</span></a><span style=\"font-weight: 400;\">. While the Minister of Communications and Digital Technology, Khumbudzo Ntshavheni, has sporadically expressed critical</span><a href=\"https://www.dcdt.gov.za/minister-s-speeches/329-minister-s-remarks-on-artificial-intelligence-ai-regulation-and-development-in-namibia-4-november-2021.html?highlight=WyJhcnRpZmljaWFsIGludGVsbGlnZW5jZSJd\"> <span style=\"font-weight: 400;\">reflections</span></a><span style=\"font-weight: 400;\"> on AI, there is no evidence indicating that these points have translated into concrete policy initiatives.</span>\r\n\r\n<span style=\"font-weight: 400;\">Notably, AI remains untouched within key government policy documents such as the</span><a href=\"https://www.gov.za/issues/national-development-plan-2030\"> <span style=\"font-weight: 400;\">National Development Plan</span></a><span style=\"font-weight: 400;\">. Secondly, AI-related matters have received limited attention in Parliament. The term “artificial intelligence” has only been</span><a href=\"https://pmg.org.za/search/?q=%22artificial+intelligence%22&filter%5Btype%5D=minister_question\"> <span style=\"font-weight: 400;\">mentioned</span></a><span style=\"font-weight: 400;\"> in passing throughout the current year and in 2022, with minimal substantive engagement on the subject.</span>\r\n\r\n<span style=\"font-weight: 400;\">Lastly, major political parties have mostly failed to develop meaningful AI policies. The African National Congress, in its 120-page apex</span><a href=\"https://www.anc1912.org.za/anc-55th-conference-resolutions/\"> <span style=\"font-weight: 400;\">policy document</span></a><span style=\"font-weight: 400;\">, makes only fleeting references to AI.</span>\r\n\r\n<span style=\"font-weight: 400;\">Similarly, the</span><a href=\"https://www.da.org.za/why-the-da/policies\"> <span style=\"font-weight: 400;\">policies</span></a><span style=\"font-weight: 400;\"> of the Democratic Alliance do not address the technology, although some officials occasionally</span><a href=\"https://wc.da.org.za/2022/11/da-led-wc-government-uses-ai-to-ensure-accountability\"> <span style=\"font-weight: 400;\">comment</span></a><span style=\"font-weight: 400;\"> on the</span><a href=\"https://mg.co.za/news/2022-04-18-machine-learning-and-ai-is-coming-for-corrupt-officials/\"> <span style=\"font-weight: 400;\">issue</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">More encouragingly, the Economic Freedom Fighters has at least made AI-linked proposals in</span><a href=\"https://effonline.org/wp-content/uploads/2019/11/2ND-NPA-DISCUSSION-DOCUMENT-A4.pdf\"> <span style=\"font-weight: 400;\">two</span></a><span style=\"font-weight: 400;\"> of its policy</span><a href=\"https://effonline.org/wp-content/uploads/2019/07/2019-EFF-MANIFESTO-FINAL-1.pdf\"> <span style=\"font-weight: 400;\">documents</span></a><span style=\"font-weight: 400;\"> from 2019, but not too much beyond that.</span>\r\n\r\n<span style=\"font-weight: 400;\">South Africa’s indifference towards AI positions it as an outlier among upper-middle-income nations. This is exemplified by the country’s low positioning in the</span><a href=\"https://www.unido.org/sites/default/files/files/2023-01/Government_AI_Readiness_2022_FV.pdf\"> <span style=\"font-weight: 400;\">AI Government Readiness Index</span></a><span style=\"font-weight: 400;\"> — a global, multidimensional index that considers factors such as government strategy, vision, and governance.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the 2022 index, South Africa was placed at a disappointing 68th out of 181 countries, trailing behind our BRICS counterparts and many other emerging markets. Further putting the country apart is an absence of a national AI policy, in contrast to African peers like</span><a href=\"https://www.minict.gov.rw/index.php?eID=dumpFile&t=f&f=67550&token=6195a53203e197efa47592f40ff4aaf24579640e\"> <span style=\"font-weight: 400;\">Rwanda</span></a><span style=\"font-weight: 400;\"> and</span><a href=\"https://ncb.govmu.org/ncb/strategicplans/MauritiusAIStrategy2018.pdf\"> <span style=\"font-weight: 400;\">Mauritius</span></a><span style=\"font-weight: 400;\">.</span>\r\n<h4><b>Political will needed</b></h4>\r\n<span style=\"font-weight: 400;\">My</span><a href=\"https://papers.ssrn.com/sol3/papers.cfm?abstract_id=4368020\"> <span style=\"font-weight: 400;\">research</span></a><span style=\"font-weight: 400;\"> found that AI companies in South Africa are themselves in favour of regulation as it would establish a level playing field and ensure responsible practices.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, regulating AI presents at least two interrelated challenges.</span>\r\n\r\n<span style=\"font-weight: 400;\">Firstly, the “</span><a href=\"https://www.igi-global.com/dictionary/regulating-digital-transformation/96685#:~:text=Chapter%209,gap%20between%20technology%20and%20regulation.\"><span style=\"font-weight: 400;\">pacing problem</span></a><span style=\"font-weight: 400;\">”.</span> <span style=\"font-weight: 400;\">Digital technologies tend to develop faster than the social structures, causing a gap between technology and regulation. A case in point is ChatGPT’s fast-paced</span><a href=\"https://www.sciencedirect.com/science/article/pii/S1472811723000289\"> <span style=\"font-weight: 400;\">disruption</span></a><span style=\"font-weight: 400;\"> of the education sector.</span>\r\n\r\n<span style=\"font-weight: 400;\">Secondly</span><i><span style=\"font-weight: 400;\">,</span></i><span style=\"font-weight: 400;\"> the so-called</span> <span style=\"font-weight: 400;\">“</span><a href=\"https://journals.sagepub.com/doi/pdf/10.1177/0162243918793711\"><span style=\"font-weight: 400;\">Collingridge dilemma</span></a><span style=\"font-weight: 400;\">”. It is difficult to predict and control the impacts of a technology at its early stages, but by the time its impact becomes clear, it is too deeply embedded in society, making it challenging to control. For example, social media’s</span><a href=\"https://www.sciencedirect.com/science/article/pii/S2772503022000159\"> <span style=\"font-weight: 400;\">entrenchment</span></a><span style=\"font-weight: 400;\"> in society, along with all its harms, within a regulatory vacuum.</span>\r\n\r\n<span style=\"font-weight: 400;\">In South Africa, it is worth considering a third factor contributing to the lack of AI regulation: the apparent absence of political will. This can be partly understood as policymakers prioritising pressing socioeconomic</span><a href=\"https://www.ipsos.com/sites/default/files/ct/news/documents/2023-03/Global%20Report%20-%20What%20Worries%20the%20World%20Mar%2023.pdf\"> <span style=\"font-weight: 400;\">concerns</span></a><span style=\"font-weight: 400;\"> that directly impact citizens' lives, as AI policies may not be seen as winning votes.</span>\r\n\r\n<span style=\"font-weight: 400;\">A similar argument can be made on climate change, which</span><a href=\"https://www.afrobarometer.org/wp-content/uploads/2023/03/AD615-Climate-change-still-unknown-to-many-South-Africans-Afrobarometer-8mar22.pdf\"> <span style=\"font-weight: 400;\">hardly</span></a><span style=\"font-weight: 400;\"> registers as a concern among South Africans. However, despite this, the government has shown political</span><a href=\"https://www.climatecommission.org.za/\"> <span style=\"font-weight: 400;\">commitment</span></a><span style=\"font-weight: 400;\"> to address climate change, indicating a</span><a href=\"https://www.thepresidency.gov.za/from-the-desk-of-the-president/global-development-financing-must-achieve-local-benefit\"> <span style=\"font-weight: 400;\">strategic decision</span></a><span style=\"font-weight: 400;\"> to prioritise an important issue despite limited immediate political pay-off.</span>\r\n\r\n<span style=\"font-weight: 400;\">Our political establishment should also be concerned about AI. Why? While there are multiple</span><a href=\"https://theconversation.com/artificial-intelligence-in-south-africa-comes-with-special-dilemmas-plus-the-usual-risks-194277\"> <span style=\"font-weight: 400;\">risks</span></a><span style=\"font-weight: 400;\"> associated with this technology, a crucial point is its</span><a href=\"https://www.sciencedirect.com/science/article/abs/pii/S157406840501018X\"> <span style=\"font-weight: 400;\">general-purpose</span></a><span style=\"font-weight: 400;\"> nature. AI has the capacity to enhance human cognitive abilities on a large scale and at a remarkable speed, all at a relatively low cost. This means that it can, for instance, help benevolent actors</span><a href=\"http://dx.doi.org/10.1038/s41467-019-14108-y\"> <span style=\"font-weight: 400;\">achieve</span></a><span style=\"font-weight: 400;\"> the UN Sustainable Development Goals.</span>\r\n\r\n<span style=\"font-weight: 400;\">But it can also be used for a near-endless range of malicious acts, such as creating</span><a href=\"https://www.cnbc.com/2023/06/26/elections-are-going-to-be-a-mess-due-to-ai-ex-google-ceo-schmidt.html\"> <span style=\"font-weight: 400;\">misinformation</span></a><span style=\"font-weight: 400;\">, committing</span><a href=\"https://www.foxbusiness.com/technology/generative-ai-tools-lead-rising-deepfake-fraud\"> <span style=\"font-weight: 400;\">fraud</span></a><span style=\"font-weight: 400;\">, and designing</span><a href=\"https://www.scientificamerican.com/article/ai-drug-discovery-systems-might-be-repurposed-to-make-chemical-weapons-researchers-warn/\"> <span style=\"font-weight: 400;\">weapons</span></a><span style=\"font-weight: 400;\"> of mass destruction. Not to mention unintended consequences like perpetuating</span><a href=\"https://www.nist.gov/news-events/news/2022/03/theres-more-ai-bias-biased-data-nist-report-highlights\"> <span style=\"font-weight: 400;\">social bias</span></a><span style=\"font-weight: 400;\">, displacing</span><a href=\"https://edition.cnn.com/2023/03/29/tech/chatgpt-ai-automation-jobs-impact-intl-hnk/index.html\"> <span style=\"font-weight: 400;\">jobs</span></a><span style=\"font-weight: 400;\">, and exacerbating</span><a href=\"https://theconversation.com/ai-will-increase-inequality-and-raise-tough-questions-about-humanity-economists-warn-203056\"> <span style=\"font-weight: 400;\">inequality</span></a><span style=\"font-weight: 400;\">.</span>\r\n<h4><b>Regulation for innovation</b></h4>\r\n<span style=\"font-weight: 400;\">In a democratic system, the responsibility of regulating AI should rest with elected officials, rather than leaving it to technology companies, the existing default position. Moreover, officials must develop a clear vision for AI that encompasses the protection of rights, establishment of responsibilities, implementation of safeguards, and provision of recourse mechanisms.</span><span style=\"font-weight: 400;\">\r\n</span><span style=\"font-weight: 400;\">\r\n</span><span style=\"font-weight: 400;\">Having regulations and a well-defined strategy for AI is not a cure-all solution, but they are crucial steps towards governing AI in a manner that benefits society as a whole. This becomes even more significant as AI is increasingly adopted by state institutions, as seen with the</span><a href=\"https://businesstech.co.za/news/business-opinion/617511/sars-boss-kieswetter-on-why-he-wants-your-data/\"> <span style=\"font-weight: 400;\">utilisation</span></a><span style=\"font-weight: 400;\"> of AI by the South African Revenue Service.</span>\r\n\r\n<span style=\"font-weight: 400;\">Government must also consider the</span><a href=\"https://johanfourie.substack.com/p/what-does-a-st-helena-governor-a?utm_source=substack&utm_medium=email\"> <span style=\"font-weight: 400;\">potential</span></a><span style=\"font-weight: 400;\"> winners and losers that may arise as a result of the technology’s advancements. Policymakers can work towards ensuring that the benefits are distributed equitably and that measures are in place to support those negatively affected by AI. These efforts will take time and will be ongoing as the technology evolves.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the near-term, government should leverage the</span><a href=\"https://aii-sa.co.za/\"> <span style=\"font-weight: 400;\">Artificial Intelligence Institute of South Africa</span></a><span style=\"font-weight: 400;\"> to help inform the debate, and agencies such as the</span><a href=\"https://inforegulator.org.za/\"> <span style=\"font-weight: 400;\">Information Regulator</span></a><span style=\"font-weight: 400;\"> should enforce laws on data collection, protection, and use in relation to AI.</span>\r\n\r\n<span style=\"font-weight: 400;\">South Africa’s political establishment should heed the warning of the Titan tragedy — unbridled innovation can come at a grave cost. Whereas</span><a href=\"https://www2.deloitte.com/us/en/insights/industry/public-sector/government-trends/2023/regulatory-agencies-and-innovation.html\"> <span style=\"font-weight: 400;\">regulation</span></a><span style=\"font-weight: 400;\"> accompanied by a compelling vision can</span><a href=\"https://onlinelibrary.wiley.com/doi/full/10.1002/eet.2035\"> <span style=\"font-weight: 400;\">spur</span></a><span style=\"font-weight: 400;\"> economic growth, mitigate risk, and promote societal benefits. </span><b>DM</b>",
