"contents": "<span style=\"font-weight: 400;\">Beatrice Mtetwa was recently disqualified in her quest to represent her client Hopewell Chin’ono, a distinguished journalist who has been serially exposing grand corruption in Zimbabwe. Chin’ono has been in custody since 20 July 2020 after being arrested live on camera in his bedroom when police forcibly broke his front door to gain entry into his house.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-701734\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/MC-Beatrice-Oped_4.jpg\" alt=\"\" width=\"1743\" height=\"1190\" /> Detained Zimbabwean journalist Hopewell Chin'ono. (Photo: EPA-EFE / Aaron Ufumeli)</p>\r\n\r\n<span style=\"font-weight: 400;\">When African Judges and Jurists (AJJF) proposed a statement by progressive pan-African jurists in support of Mtetwa and to protect the right of fair trial, we had not anticipated the degree of support that would come from African civil society leaders.</span>\r\n\r\n<span style=\"font-weight: 400;\">The</span><a href=\"https://www.aljazeera.com/news/2020/08/zimbabwe-court-bans-top-lawyer-representing-journalist-200818135525063.html\"> <span style=\"font-weight: 400;\">decision of magistrate Ngoni Nduna to disbar Mtetwa</span></a><span style=\"font-weight: 400;\"> on spurious grounds from representing her client was seen as a surprising affront and erosion of the rule of law that required a response.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is a very unusual phenomenon in Africa to get a statement about the justice system in an African country engendering such strong feelings of injustice as has happened in relation to recent developments in Zimbabwe. </span>\r\n\r\n<span style=\"font-weight: 400;\">In addition to Chief Justice Mutunga signing the statement of protest, respected Professors</span><a href=\"https://en.wikipedia.org/wiki/Chidi_Odinkalu\"> <span style=\"font-weight: 400;\">Chidi Anselm Odinkalu</span></a> <span style=\"font-weight: 400;\">(Harvard Law – Visiting),</span><a href=\"http://www.law.uct.ac.za/sites/default/files/image_tool/images/99/Chirwa%20CV.pdf\"> <span style=\"font-weight: 400;\">Danwood Chirwa</span></a> <span style=\"font-weight: 400;\">(UCT),</span><a href=\"https://ias.ug.edu.gh/content/professor-dzodzi-tsikata\"> <span style=\"font-weight: 400;\">Dzodzi Tsikata</span></a><span style=\"font-weight: 400;\"> (University of Ghana at Legon),</span><a href=\"http://www.publiclaw.uct.ac.za/pbl/staff/hcorder\"> <span style=\"font-weight: 400;\">Hugh Corder</span></a><span style=\"font-weight: 400;\"> (UCT),</span><a href=\"https://en.wikipedia.org/wiki/Issa_G._Shivji\"> <span style=\"font-weight: 400;\">Issa Shivji</span></a><span style=\"font-weight: 400;\"> (Dar-Es-Salaam),</span><a href=\"https://www.chr.up.ac.za/latest-news/83-news-chr/1775-professor-hansungule-re-appointed-as-icj-commissioner-to-serve-for-a-third-term\"> <span style=\"font-weight: 400;\">Michelo Hansungule</span></a><span style=\"font-weight: 400;\"> (ex University of Pretoria),</span><a href=\"https://www.researchgate.net/profile/Paris_Yeros\"> <span style=\"font-weight: 400;\">Paris Yeros</span></a> <span style=\"font-weight: 400;\">(Universidade Federal do ABC)</span><span style=\"font-weight: 400;\">,</span><a href=\"https://iversity.org/en/profiles/praveen-jha\"> <span style=\"font-weight: 400;\">Praveen Jha</span></a> <span style=\"font-weight: 400;\">(Jawaharlal Nehru University)</span><span style=\"font-weight: 400;\">,</span><a href=\"https://commonwealthoralhistories.org/explandict/reg-austin/\"> <span style=\"font-weight: 400;\">Reg Austin</span></a><span style=\"font-weight: 400;\"> (Zimbabwe) and</span><a href=\"https://includeplatform.net/incl-author/adriano-nuvunga/\"> <span style=\"font-weight: 400;\">Adriano Alfredo Nuvunga</span></a><span style=\"font-weight: 400;\"> (Eduardo Mondlane, Mozambique) also chose to sign on publicly.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the end of it all, by weaponising the legal system and converting it into an instrument to attack the civic space and perceived opponents, the authorities in Zimbabwe discredit the legal system and erode public confidence in the independence and impartiality of the judiciary, not just in Zimbabwe, but across Africa.</span>\r\n\r\n<span style=\"font-weight: 400;\">The African civil society leaders write that:</span>\r\n\r\n<span style=\"font-weight: 400;\">“By disqualifying Beatrice Mtetwa, the court has undermined the accused person’s (Hopewell Chin’ono) right to legal representation, which is guaranteed in section 70(1) (d) of the Constitution of Zimbabwe, article 14(3) (b) of the ICCPR and article 7(1) of the African Charter. Subsequently, this undermines the accused person’s right to a fair trial.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The 65 NGOs and 67 individuals who signed the statement ended by expressing concern over magistrate Nduna’s judgment arguing that:</span>\r\n\r\n<span style=\"font-weight: 400;\">“It undermines not just Beatrice Mtetwa’s right to practice law but it has a chilling effect on the exercise of many other associated rights, including the right to freedom of expression for lawyers, the accused persons’ right to legal representation as well as the right to fair trial.”</span>\r\n\r\n<span style=\"font-weight: 400;\">While </span><span style=\"font-weight: 400;\">Chin’ono</span><span style=\"font-weight: 400;\"> is being charged with inciting public violence, the majority view is that he infuriated the authorities with his social media campaigns on grand corruption that has brought the country to its knees. The exposure by </span><span style=\"font-weight: 400;\">Chin’ono</span><span style=\"font-weight: 400;\"> of corruption regarding personal protective equipment (PPE) that allegedly cost the country around US$60-million </span><a href=\"https://southerntimesafrica.com/site/news/covidgate-let-the-denials-begin\"><span style=\"font-weight: 400;\">sucking in Namibia</span></a><span style=\"font-weight: 400;\">, the former Minister of Health, Obediah Moyo and</span><a href=\"https://www.iol.co.za/the-star/news/mnangagwas-son-and-bodyguard-at-the-centre-of-zims-ppe-scandal-48851268\"> <span style=\"font-weight: 400;\">people close to the first family</span></a><span style=\"font-weight: 400;\"> of President Emmerson Mnangagwa rattled and angered the powerful.</span>\r\n\r\n<span style=\"font-weight: 400;\">Namibia refuted claims of supplying PPE to Zimbabwe. The close associates to the first family were arrested and are out on bail. Moyo was arrested and is out on</span><a href=\"https://www.aljazeera.com/news/2020/06/zimbabwe-health-minister-granted-bail-60m-corruption-case-200620190428039.html\"><span style=\"font-weight: 400;\"> bail</span></a><span style=\"font-weight: 400;\">. Further, he was removed from office as a minister for his role in the corruption case.</span>\r\n\r\n<span style=\"font-weight: 400;\">Such is the scale of</span><a href=\"https://www.dailymaverick.co.za/article/2020-08-02-covid-19-and-the-epidemic-of-corrupt-governments-a-heart-wrenching-unscrupulous-and-filthy-feeding-frenzy/\"> <span style=\"font-weight: 400;\">corruption around Covid-19</span></a><span style=\"font-weight: 400;\"> procurements in the whole of Africa that the Director-General of WHO, </span><span style=\"font-weight: 400;\">Dr Tedros Adhanom Ghebreyesus, </span><span style=\"font-weight: 400;\">has now equated such corruption to</span><a href=\"https://www.moneyweb.co.za/news/south-africa/madonsela-and-who-boss-slam-covid-19-corruption-in-sa/\"> <span style=\"font-weight: 400;\">“murder”.</span></a>\r\n\r\n<span style=\"font-weight: 400;\">It is therefore a sad indictment on the legal system in Zimbabwe that the corrupt get bail and walk the streets free, on the philosophy of “catch and release” while activists and whistleblowers such as</span><a href=\"https://www.news24.com/news24/africa/zimbabwe/zimbabwe-journalist-hopewell-chinono-denied-bail-for-third-time-over-anti-government-protests-20200824\"><span style=\"font-weight: 400;\"> Chin’ono languish</span></a><span style=\"font-weight: 400;\"> in jail.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ordinarily, courts must be the shield that protects these rights rather than being the sword that destroys fundamental human rights. </span><b>DM/MC</b>\r\n\r\n<span style=\"font-weight: 400;\"> </span><i><span style=\"font-weight: 400;\">Martin Okumu-Masiga is the Secretary-General of the</span></i><a href=\"http://africajurists.org/\"> <i><span style=\"font-weight: 400;\">Africa Judges and Jurists Forum</span></i></a><i><span style=\"font-weight: 400;\"> (AJJF) and writes in his personal capacity.</span></i>",
