"contents": "<span style=\"font-weight: 400;\">Two luxury homes, a property in an upmarket estate, a poultry farm and a Hilux SUV, all allegedly bought with funds siphoned from lottery grants, have been frozen by a </span><a href=\"https://groundup.org.za/media/uploads/documents/nlc_4_preservation_order_1.pdf\"><span style=\"font-weight: 400;\">preservation order</span></a><span style=\"font-weight: 400;\"> granted by the Gauteng Division of the High Court in Pretoria.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Special Investigating Unit and the Asset Forfeiture Unit were granted the orders after an </span><a href=\"https://schoemanlaw.co.za/understanding-ex-parte-applications-in-south-african-courts/\"><span style=\"font-weight: 400;\">ex parte</span></a><span style=\"font-weight: 400;\"> (without the other parties present) hearing by High Court Judge Aubrey Ledwaba on 24 July 2024. This was only made public on Wednesday.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Special Investigating Unit, which does not have prosecutorial powers and is only mandated to recover state funds misappropriated through corruption, has handed the dockets of its investigations into all these grants, as well as many others, to the Hawks to investigate.</span>\r\n\r\n<span style=\"font-weight: 400;\">But while millions in misappropriated properties, cars and other assets have been frozen because of the unit’s investigations, there is growing frustration at the slow pace of investigations by both the SAPS and the Hawks into the looting of the lottery, and prosecutions by the National Prosecuting Authority, of those involved.</span>\r\n\r\n<span style=\"font-weight: 400;\">So far only one person has been </span><a href=\"https://www.news24.com/news24/southafrica/news/joburg-man-gets-8-years-in-jail-for-r15m-lottery-fraud-20220707\"><span style=\"font-weight: 400;\">successfully prosecuted, </span></a><span style=\"font-weight: 400;\">and two men have </span><a href=\"https://groundup.org.za/article/lottery-corruption-two-men-arrested-in-soweto/\"><span style=\"font-weight: 400;\">appeared in court</span></a><span style=\"font-weight: 400;\"> in connection with misappropriated lottery funds.</span>\r\n\r\n<span style=\"font-weight: 400;\">The latest order has frozen:</span>\r\n<ul>\r\n \t<li>A luxury home in Ekurhuleni co-owned by Ngwedzeni Moudy Mudzielwana and Phindile Garish Mudzielwana.</li>\r\n \t<li>A property in Sable Hills in Pretoria registered to the Malwandla Siweya Family Trust, represented by trustee Malwandla Solly Siweya.</li>\r\n \t<li>A poultry farm in Midvaal registered in the name of Dimakatso Pheto, the sister of Tsotsi actor Terry Pheto.</li>\r\n \t<li>A house in Louis Trichardt registered to Collin Mukondeleli Tshisimba.</li>\r\n \t<li>A Toyota Hilux registered to Preldon Construction (Pty) Ltd, represented by Pretty Shandukani.</li>\r\n</ul>\r\n<h4><b>Dodgy borehole grant</b></h4>\r\n<span style=\"font-weight: 400;\">Mudzielwana’s home was bought using funds from a multimillion-rand grant meant to </span><a href=\"https://www.timeslive.co.za/sunday-times/news/2018-01-27-middlemen-hit-jackpot-lottopreneurs-cash-in-on-a-change-in-the-law/\"><span style=\"font-weight: 400;\">install 200 boreholes</span></a><span style=\"font-weight: 400;\"> in drought-stricken villages across South Africa.</span>\r\n\r\n<span style=\"font-weight: 400;\">His newly established non-profit company, Tshikovha Graduate Academy, was granted a </span><a href=\"https://groundup.org.za/media/uploads/images/Graphics/siu-20240829/moudy_madzielwana.jpg\"><span style=\"font-weight: 400;\">R55-million grant</span></a><span style=\"font-weight: 400;\"> by the National Lotteries Commission in 2016 to install the boreholes. Before the National Lotteries Commission’s funds landed, there was only R46.73 in Tshikovha’s bank account.</span>\r\n\r\n<span style=\"font-weight: 400;\">Konani Pfunzo Comprehensive Learning Centre, a Limpopo school with just 46 learners, acted as a conduit for the funds. The grant application was signed by Mudzielwana and co-signed by Collin Tshisimba, who has been implicated in several other dodgy lottery grants.</span>\r\n\r\n<span style=\"font-weight: 400;\">Once the lottery money landed, Tshikovha made two deposits, of R4.8-million and R4.5-million, to Redtaq, a company related to former National Lotteries Commission chief operating officer Phillemon Letwaba. GroundUp has </span><a href=\"https://groundup.org.za/article/how-the-former-lottery-board-chair-paid-for-his-r65-million-rolls-royce/\"><span style=\"font-weight: 400;\">reported</span></a><span style=\"font-weight: 400;\"> how Redtaq </span><a href=\"https://groundup.org.za/media/uploads/images/Graphics/siu-20240829/konani_pfuzno_and_redtaq.png\"><span style=\"font-weight: 400;\">then paid </span></a><span style=\"font-weight: 400;\">R1-million to a dealership towards a Rolls Royce for former Lottery chairperson Alfred Nevhutanda.</span>\r\n<h4><b>‘Failed to provide bank statements’</b></h4>\r\n<span style=\"font-weight: 400;\">Audit firm SkX Protiviti, which was commissioned by the National Lotteries Commission to investigate the grant, said it had been unable to reconcile how the money was spent as “Konani and Tshikovha failed to provide us with their bank statements and financial records”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The beneficiary and his contractor indicated that they were not willing to consult with us,” SkX said in its report, adding that no background checks or the verification of any documents had been done by the National Lotteries Commission.</span>\r\n\r\n<span style=\"font-weight: 400;\">When SkX investigators visited the borehole sites, they could not locate eight of them using coordinates provided by the commission. Six boreholes had never had pumps fitted and “therefore were not accessible for usage by the public”, while two were installed on private property. The coordinates for one borehole “indicated that it was in a municipal building”, while yet another was located on a farm and had been drilled more than 10 years before the National Lotteries Commission project.</span>\r\n<h4><b>Solly Siweya</b></h4>\r\n<span style=\"font-weight: 400;\">Siweya’s house was </span><a href=\"https://groundup.org.za/media/uploads/documents/august_2024_preservation_order_merged.pdf\"><span style=\"font-weight: 400;\">frozen</span></a><span style=\"font-weight: 400;\"> in connection with a </span><a href=\"https://www.groundup.news/article/what-happened-money-lottery-paid-fund-games-intellectually-impaired/\"><span style=\"font-weight: 400;\">R30-million grant</span></a><span style=\"font-weight: 400;\"> for the </span><a href=\"http://sasaii.co.za/\"><span style=\"font-weight: 400;\">South African Sports Association for the Intellectually Impaired</span></a><span style=\"font-weight: 400;\">, a sports body for intellectually impaired athletes, to host a Bloemfontein event. Soon after the money landed, the association transferred R3.5-million in two payments to Ironbridge Travelling Agency, which is associated with Phillemon Letwaba.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ironbridge, in turn, transferred R2-million to Ndzhuku Trading, in which Siweya was one of two directors. Ndzhuku then transferred the money to another of its accounts, and then paid R350,000 to transferring attorneys handling the sale of a property registered to the Malwandla Siweya Family Trust, in Sable Hills, Pretoria.</span>\r\n\r\n<span style=\"font-weight: 400;\">GroundUp has reported on other dodgy lottery grants involving Siweya, including an R80-million grant supposedly to support Durban’s (failed) attempt to</span><a href=\"https://groundup.org.za/article/secrecy-surrounds-r80-million-lottery-funding-sports-project/\"><span style=\"font-weight: 400;\"> host the Commonwealth Games</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">He also acted as an intermediary in the purchase of a </span><a href=\"https://groundup.org.za/article/fikile-mbalula-in-row-over-frozen-luxury-house/\"><span style=\"font-weight: 400;\">house in Bryanston</span></a><span style=\"font-weight: 400;\"> by Upbrand Properties, a company closely linked to Letwaba and his brother, Joe. ANC secretary-general Fikile Mbalula and his wife originally </span><a href=\"https://groundup.org.za/article/minister-lottery-boss-and-luxury-r56-million-home/\"><span style=\"font-weight: 400;\">put in a cash offer</span></a><span style=\"font-weight: 400;\"> for R5.6-million on the house, but they withdrew and an identical cash offer was then submitted by Upbrand, which bought the house. The minister lived in it briefly before suddenly moving out.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mbalula and Letwaba were good friends at one stage, but then fell out. Letwaba’s wife and brother both claimed in affidavits when the preservation order was contested that R3-million paid towards the purchase of the house in Bryanston </span><a href=\"https://groundup.org.za/article/fikile-mbalula-in-row-over-frozen-luxury-house/\"><span style=\"font-weight: 400;\">was a loan to Mbalula</span></a><span style=\"font-weight: 400;\">.</span>\r\n<h4><b>Chicken farm</b></h4>\r\n<span style=\"font-weight: 400;\">Part of a R23.7-million grant to </span><a href=\"https://www.nunnafricafoundation.org/\"><span style=\"font-weight: 400;\">Nunnovation Africa Foundation</span></a><span style=\"font-weight: 400;\"> to </span><a href=\"https://groundup.org.za/article/lottery-and-mystery-multi-million-rand-boxing-arena/\"><span style=\"font-weight: 400;\">build a “boxing arena”</span></a><span style=\"font-weight: 400;\"> in Storms River was used </span><a href=\"https://groundup.org.za/media/uploads/images/Graphics/siu-20240829/dimakatso_pheto.jpg\"><span style=\"font-weight: 400;\">to buy a chicken farm </span></a><span style=\"font-weight: 400;\">in Midvaal for Dimakatso Terry, the sister of “Tsotsi” actor Moitheri “Terry” Pheto. Nunnovation had no track record in construction.</span>\r\n\r\n<span style=\"font-weight: 400;\">Pheto’s luxury home in Bryanston, which was bought using lottery funds, was frozen by the SIU and subsequently </span><a href=\"https://groundup.org.za/article/sold-terry-phetos-house-that-was-paid-for-with-lottery-money/\"><span style=\"font-weight: 400;\">sold</span></a><span style=\"font-weight: 400;\"> in March last year. The offer to purchase the farm for R850,000 was signed by former National Lotteries Commission board chairperson Nevhutanda.</span>\r\n\r\n<span style=\"font-weight: 400;\">A house frozen in Louis Trichardt by the preservation order is </span><a href=\"https://groundup.org.za/article/lottery-corruption-limpopo-couples-bid-to-hold-on-to-their-luxury-homes/\"><span style=\"font-weight: 400;\">one of several</span></a><span style=\"font-weight: 400;\"> owned by Collins Tshisimba and his wife, Fulufhelo Promise Kharivhe, that are subject to preservation orders.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Special Investigating Unit believes Tshisimba is part of “a syndicate that has been consistently defrauding the National Lotteries Commission” through various non-profit organisations.</span>\r\n\r\n<span style=\"font-weight: 400;\">The unit says he was part of a group of people who syphoned off hundreds of millions of rand from lottery grants between 2016 and 2019, money that was meant to uplift poor people and communities.</span>\r\n\r\n<span style=\"font-weight: 400;\">Pretty Shandukani, whose Hilux DC 2.4GD-6 has been frozen, is married to Mashudu Shandukani. His Mshandukani Foundation, as well as his construction company, Mshandukani Holdings, have been identified by the unit as being used to allegedly launder tens of millions of rand misappropriated from lottery grants.
