(Photo: Shiraaz Mohamed)</p>\r\n\r\n<span style=\"font-weight: 400;\">In denying bail to Kishene Chetty and James Ramanjalum, the magistrate, Phillip Venter, said there was a chance that if they were released on bail they might commit other Schedule 1 offences.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The only conclusion to be reached is that there is no means to prevent this real risk to society in general or certain individuals other than depriving [Chetty and Ramanjalum] of their liberty,” said Venter.</span>\r\n\r\n<span style=\"font-weight: 400;\">Venter added that Ramanjalum was linked to acts of interference, perjury and collecting information about members of the investigating team and their families. </span>\r\n\r\n<span style=\"font-weight: 400;\">Before delivering his bail verdict, Venter said it was safe to conclude that the State had a strong case against all the applicants. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Applicants seven to 15, Ramahlapi Johannes Mokoena, James Ramanjalum, Lesetja David Mogotlane, Veteran Naipal, Alpheus Nkosibakhe Makhetha, Marcell Duan Patrick Marney, Kysamula Morris Mabasa, Isaac Majaji Ngobeni and Stephinah Mogotle Mahlangu, were part of the supply chain management and able to manipulate the awarding of tenders to specific entities. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Applicants seven, eight, nine, 10, 11 and 13, Ramahlapi Johannes Mokoena, James Ramanjalum, Lesetja David Mogotlane, Veteran Naipal, Alpheus Nkosibakhe Makhetha and Kysamula Morris Mabasa were all high-ranking members of the SAPS and applicant 12, Marcell Duan Patrick Marney, was a senior acting clerk,” said Venter.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, Venter said, the remaining 10 applicants had successfully made their case to justify their release on bail.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The court has considered your financial situations and the severity of the allegations against you,” he said and fixed bail at R20,000 for each of them. </span>\r\n\r\n<span style=\"font-weight: 400;\">They will remain in custody until after they have paid the bail amount and will be expected to appear in court on 29 March. </span>\r\n\r\n<span style=\"font-weight: 400;\">“You may furthermore have no contact directly or indirectly with any of the potential State witnesses, lawyers or any of the staff directly or indirectly,” said Venter.</span>\r\n\r\n<span style=\"font-weight: 400;\">The 10 who were granted bail are Lorette Joubert, Kumarasen Prithiviraj, Volan Prithiviraj, Maricha Joubert, Ramahlapi Johannes Mokoena, Lesetja David Mogotlane, Veteran Naipal, Alpheus Nkosibakhe Makhetha, Marcell Duan Patrick Marney and Kysamula Morris Mabasa.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"wp-image-1178087 size-full\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/02/bheki-PPE-millions2.jpg\" alt=\"police PPE case\" width=\"720\" height=\"426\" /> From left, Kishene Chetty, Salamina Khoza, Lorette Joubert, Kumarasen Prithiviraj, Nolan Prithiviraj, Maricha Joubert, Ramahlapi Mokwena and James Ramanjalum (with the rest of the accused, not in frame) stand in the dock in the Specialised Commercial Crimes Court sitting in the Palm Ridge Magistrates’ Court on 8 February 2022. The State believes that Chetty was the mastermind of the scheme to defraud the SAPS through one of his companies, Siyanqoba. </span>\r\n\r\n<span style=\"font-weight: 400;\">The State said Ramanjalum is a former brigadier who was dismissed by the SAPS, but was challenging his dismissal, which stemmed from his participation in the offences referred to. No disciplinary steps had been taken against Ramanjalum.</span>\r\n\r\n<span style=\"font-weight: 400;\">“As of now he is facing charges committed while he was on bail,” said prosecutor Tilas Chabalala.</span>\r\n\r\n<span style=\"font-weight: 400;\">The State further revealed that on 11 June, Makhetha accepted gratification in the form of payment of legal fees to a law firm by Chetty, Khoza or Siyanqoba.</span>\r\n\r\n<span style=\"font-weight: 400;\">The accused are expected back in court on 29 March.</span><b> DM</b>",
