"contents": "<span style=\"font-weight: 400;\">The Western Cape provincial government and the City of Cape Town believe they have a good chance of winning the right to appeal against a Western Cape High Court decision to halt the construction of Amazon Africa’s headquarters at the River Club in Observatory, Cape Town.</span>\r\n\r\n<span style=\"font-weight: 400;\">The application will be heard at the Supreme Court of Appeal (SCA). </span>\r\n\r\n<span style=\"font-weight: 400;\">The Goringhaicona Khoi Khoin Indigenous Traditional Council and the Observatory Civic Association were granted an urgent interdict against the development after the traditional council said they had </span><a href=\"https://www.dailymaverick.co.za/article/2022-01-20-khoisan-group-in-court-battle-to-halt-construction-of-amazon-africa-headquarters/\"><span style=\"font-weight: 400;\">not been meaningfully consulted</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">The city and the province say the development will be beneficial to the area.</span>\r\n\r\n<span style=\"font-weight: 400;\">“These benefits include rehabilitating a portion of the Liesbeek River, creating a high-quality green open space, establishing heritage infrastructure in partnership with First Nations groups, creating more than 5,200 construction jobs and approximately 19,000 employment opportunities [and] establishing public transport infrastructure,” Priya Reddy, the city’s spokesperson told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">She said the development was expected to inject R4.5-billion of direct investment into the economy. </span>\r\n\r\n<span style=\"font-weight: 400;\">“As a result of the interdict, Cape Town has now been deprived of these benefits, to the detriment of its residents,” Reddy said. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.dailymaverick.co.za/article/2022-01-20-khoisan-group-in-court-battle-to-halt-construction-of-amazon-africa-headquarters/\"><span style=\"font-weight: 400;\">urgent interdict</span></a><span style=\"font-weight: 400;\"> left many workers in limbo, a risk the applicants said the developer took knowing that the case was ongoing at the time of construction. </span>\r\n\r\n<span style=\"font-weight: 400;\">Wouter Kriel, the spokesperson for MEC Anton Bredell of the Western Cape’s Environmental Affairs and Development Planning Department, told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> the judgment’s obligation to conclude meaningful consultation “raises matters of particular concern”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Tauriq Jenkins, the high commissioner of the Goringhaicona Khoi Khoin Indigenous Traditional Council, told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> that the argument of concluding meaningful consultation had been unsuccessfully used in the initial application for leave to appeal, which was dismissed with costs by Deputy Judge President Patricia Goliath in the Western Cape High Court in May. </span>\r\n\r\n<span style=\"font-weight: 400;\">“They are now wanting to repeat that argument at the Supreme Court of Appeal, at the expense of public money,” Jenkins said. </span>\r\n\r\n<span style=\"font-weight: 400;\">Liesbeek Leisure Property Trust (LLPT) has been pursuing “</span><a href=\"https://www.dailymaverick.co.za/article/2022-06-23-amazon-africa-headquarters-project-resumes-remedial-work-at-river-club-site-despite-urgent-interdict/\"><span style=\"font-weight: 400;\">remedial work</span></a><span style=\"font-weight: 400;\">” at the development site and said this week that they were proceeding with structural work on the partially constructed first building. </span>\r\n\r\n<span style=\"font-weight: 400;\">“This phase of work will result in 380 construction workers coming back to work and earning an income again, pending the final determination of the applications for leave to appeal the judgment and orders handed down by Western Cape Deputy Judge President Goliath. Those applications [to the SCA] suspend the operation and effect of the judgment and orders,” LLPT said. </span>\r\n\r\n<span style=\"font-weight: 400;\">Kriel said no environmental authorisation was granted to LLPT for remedial work, but the authorisation the development trust had initially been granted required the environmental management of the site. </span>\r\n\r\n<span style=\"font-weight: 400;\">But the Liesbeek Action Campaign contended: “It’s simple: The judge ordered that no further construction can take place on the site until a court has decided on the validity of the environmental and land-use planning authorisation that authorise the development.
