"contents": "<span style=\"font-weight: 400;\">What does the data about medical negligence cases in the public health sector tell us? </span>\r\n\r\n<span style=\"font-weight: 400;\">We analysed </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/Joint-Press-Conference-with-the-SIU-Medico-legal-claims-22-August-2024-1.pdf\"><span style=\"font-weight: 400;\">the numbers released</span></a><span style=\"font-weight: 400;\"> by Health Minister Aaron Motsoaledi and the Special Investigating Unit on 24 August </span><a href=\"https://www.youtube.com/watch?v=bOjbQVReaDQ\"><span style=\"font-weight: 400;\">at a press briefing</span> </a><span style=\"font-weight: 400;\">to make it easier to understand where what kinds of problems occur — from dodgy lawyers and unethical health workers to just plain fishy cases. </span>\r\n\r\n<span style=\"font-weight: 400;\">In 2017, the Special Investigating Unit was called in to look into what was afoot. </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/Joint-Press-Conference-with-the-SIU-Medico-legal-claims-22-August-2024-1.pdf\"><span style=\"font-weight: 400;\">By July 2024</span></a><span style=\"font-weight: 400;\">, they had flagged 2,830 cases out of 10,679 in total as fishy and needing to be investigated. </span>\r\n\r\n<span style=\"font-weight: 400;\">Of these, the ones in the Northern Cape cost, on average, four times more per case than in Gauteng, even though the province’s health budget is far smaller than Gauteng’s.</span>\r\n\r\n<span style=\"font-weight: 400;\">Nearly one in three cases being looked at are from Mpumalanga, with KwaZulu-Natal on its heels. </span>\r\n\r\n<span style=\"font-weight: 400;\">The third spot is a tussle, because although Gauteng’s claims being investigated are about double that of Limpopo, the value of those in the northernmost province is about a billion rand more. </span>\r\n\r\n<span style=\"font-weight: 400;\">But first, some background. </span>\r\n<h4><b>Where things stand now </b></h4>\r\n<span style=\"font-weight: 400;\">By the end of March, provincial health departments faced about R78-billion in medical negligence cases against them, which is </span><a href=\"https://static.pmg.org.za/240911Medico-legal_claims_Presentation_-_SCOPA_SCOA_and_PC_Health.pdf#page=12\"><span style=\"font-weight: 400;\">almost 80% of the combined budget for such departments</span> </a><span style=\"font-weight: 400;\">meant to be used for treating people.</span>\r\n\r\n<span style=\"font-weight: 400;\">About 90% of the total budget that the Treasury allocates to health each year goes towards provincial health departments, as they are the ones that roll out the policies the national department develops.</span>\r\n\r\n<span style=\"font-weight: 400;\">Every financial year these departments started “on the backfoot”, Thabelo Musisinyani, head of the unit that takes care of the health portfolio at the auditor-general’s office, </span><a href=\"https://static.pmg.org.za/240911Medico-legal_claims_Presentation_-_SCOPA_SCOA_and_PC_Health.pdf\"><span style=\"font-weight: 400;\">told Parliament last week</span></a><span style=\"font-weight: 400;\">. This, she says, is made worse because they have to then borrow from future budgets to pay for medical negligence claims from previous years.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a decade, from 2012 to 2022, the amount the government spent on paying out compensation for medical negligence </span><a href=\"https://pmg.org.za/committee-meeting/39408/?utm_campaign=minute-alert&utm_medium=email&utm_source=transactional\"><span style=\"font-weight: 400;\">grew tenfold</span></a><span style=\"font-weight: 400;\"> — from R265-million to R2.6-billion.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2018, claims against the departments sat at R70-billion, which the government </span><a href=\"https://www.dpme.gov.za/keyfocusareas/outcomesSite/MTSF_2019_2024/2019-2024%20MTSF%20Comprehensive%20Document.pdf\"><span style=\"font-weight: 400;\">wanted to come down to below R18-billion by 2024</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">But instead it is now four times higher.</span>\r\n\r\n<span style=\"font-weight: 400;\">These claims aren’t all legit, though. Because dodgy lawyers have found loopholes in the legal system and</span><a href=\"https://static.pmg.org.za/240911Medico-legal_claims_Presentation_-_SCOPA_SCOA_and_PC_Health.pdf#page=12\"> <span style=\"font-weight: 400;\">state hospitals’ recordkeeping is not in order</span></a><span style=\"font-weight: 400;\">, large amounts of money are unnecessarily paid out.</span>\r\n\r\n<span style=\"font-weight: 400;\">The result of rising claims has a crippling ripple effect: more and more of the coming years’ money is used to cover expenses from previous years, leaving less and less to fund services that people need. </span>\r\n\r\n<span style=\"font-weight: 400;\">So, what do the numbers show? </span>\r\n<h4><b>Mpumalanga, KZN, Limpopo and Gauteng</b></h4>\r\n<span style=\"font-weight: 400;\">Mpumalanga has 902 cases under the magnifying glass — nearly a third of the total number being looked at — at a combined value of just over R10-billion.</span>\r\n\r\n<img loading=\"lazy\" class=\"alignnone size-full wp-image-2369547\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/09/636.-19-June-2022-1.jpg\" alt=\"\" width=\"1667\" height=\"1077\" />\r\n\r\n<span style=\"font-weight: 400;\">KwaZulu-Natal is second, with 713 cases to the value of R8.7-billion. Third spot is Gauteng, but only when measured by the number of cases under investigation — about double that of Limpopo. But when it comes to the monetary value of potential payouts of those claims, the cases in the northernmost province are about a billion rand more than in Gauteng. </span>\r\n\r\n<span style=\"font-weight: 400;\">Payouts in medical negligence cases are generally big because they include the cost of </span><a href=\"https://pmg.org.za/files/240911Presentation_on_Medico-Legal_Claims_to_Health_SCOPA_and_Appropriations_-_11_September_2024_-FINAL.pptx\"><span style=\"font-weight: 400;\">future medical care — often in private hospitals, Health Minister Aaron Motsoaledi says</span></a><span style=\"font-weight: 400;\"> — and compensation for possible income the patient would have had if negligent treatment had not disrupted their life. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Special Investigating Unit </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/Joint-Press-Conference-with-the-SIU-Medico-legal-claims-22-August-2024-1.pdf\"><span style=\"font-weight: 400;\">found</span></a><span style=\"font-weight: 400;\"> that some of the fishy claims were from lawyers suing the State for future medical costs even though the patients had already died. </span>\r\n<h4><b>Free State</b></h4>\r\n<span style=\"font-weight: 400;\">In the Free State, one of </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/Joint-Press-Conference-with-the-SIU-Medico-legal-claims-22-August-2024-1.pdf\"><span style=\"font-weight: 400;\">the drivers</span></a><span style=\"font-weight: 400;\"> behind shady claims was stolen medical records, a situation the auditor-general </span><a href=\"https://static.pmg.org.za/240911Medico-legal_claims_Presentation_-_SCOPA_SCOA_and_PC_Health.pdf#page=12\"><span style=\"font-weight: 400;\">had previously flagged as problematic</span></a><span style=\"font-weight: 400;\"> when it found that state hospitals don’t have proper systems to keep track of patient files. </span>\r\n\r\n<span style=\"font-weight: 400;\">This opens opportunities for records to be stolen and sold to unscrupulous lawyers, who know that without the files the State won’t be able to argue these cases. Musisinyani says this is one of the reasons the departments end up losing in court and having to pay. </span>\r\n<h4><b>Northern Cape, Eastern Cape and North West</b></h4>\r\n<img loading=\"lazy\" class=\"alignnone size-full wp-image-2369548\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/09/Proper-2-negligence-1.jpg\" alt=\"\" width=\"1667\" height=\"1077\" />\r\n\r\n<span style=\"font-weight: 400;\">Even though the Northern Cape only has 20 fishy cases being looked at, each costs, on average, R28-million; compare that with the roughly R7-million per case in Gauteng and North West. </span>\r\n\r\n<span style=\"font-weight: 400;\">Moreover, over half the total value of claims in the Northern Cape at the moment comes from </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/09/240904Final_SIU_Medico-Legal_Update_Presentation_-_04_September_2024_-_Final_31.08.2024.pptx\"><span style=\"font-weight: 400;\">only seven cases</span></a><span style=\"font-weight: 400;\">. Four of these had a combined value of R169-million and were submitted by a single lawyer — who, patients say, they never instructed to lodge a malpractice claim. </span>\r\n\r\n<span style=\"font-weight: 400;\">In order to open a case on someone’s behalf, a lawyer needs to be given </span><a href=\"https://www.ncbi.nlm.nih.gov/books/NBK542309/#:~:text=general%20power%20of%20attorney%20may%20be%20a%20person%20or%20an%20organization%2C%20known%20as%20the%20agent%20or%20attorney%2Din%2Dfact%2C%20that%20has%20been%20given%20powers%20to%20act%20on%20another%20person%E2%80%99s%20behalf.\"><span style=\"font-weight: 400;\">power of attorney</span></a><span style=\"font-weight: 400;\">, which means they can act as the person’s legal representative in court. </span>\r\n\r\n<span style=\"font-weight: 400;\">Three other claims in this province — for a total of R129-million — involved </span><a href=\"https://journals.co.za/doi/pdf/10.10520/AJA05872405_151#:~:text=25,circularising%20of%20prospective%20clients%20generally.\"><span style=\"font-weight: 400;\">touting</span></a><span style=\"font-weight: 400;\">, which is when an unscrupulous professional like a lawyer or nurse tries to recruit patients to sue the state by offering them big payouts.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the Eastern Cape, claims flagged for investigation are worth about R19.3-million each. The Special Investigating Unit’s findings showed that close to a third of the claims in the province came from a single law firm and had a total value of R600-million. </span>\r\n\r\n<span style=\"font-weight: 400;\">But their methods were dodgy, because the firm “pocketed” all of the money the state paid out and the </span><a href=\"https://www.youtube.com/watch?v=bOjbQVReaDQ\"><span style=\"font-weight: 400;\">patients “never received a cent of it</span></a><span style=\"font-weight: 400;\">”, Motsoaledi said at the Special Investigating Unit’s press conference in August. </span>\r\n<h4><b>Western Cape</b></h4>\r\n<span style=\"font-weight: 400;\">The unit confirmed that it had received claims data from the Western Cape in August, but said it was still analysing it before it would be able to release findings for that province.</span>\r\n<h4><b>More spend with lower budget</b></h4>\r\n<span style=\"font-weight: 400;\">Of those being investigated, a case in the Northern Cape costs about four times what it does in Gauteng — yet the province gets only about </span><a href=\"https://www.treasury.gov.za/documents/national%20budget/2024/review/Annexure%20W1.pdf#page=13\"><span style=\"font-weight: 400;\">a tenth of what Gauteng does</span></a><span style=\"font-weight: 400;\"> to spend on health. </span>\r\n\r\n<img loading=\"lazy\" class=\"alignnone size-full wp-image-2369549\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/09/Proper-3-negligence.jpg\" alt=\"\" width=\"1667\" height=\"1077\" />\r\n\r\n<span style=\"font-weight: 400;\">That’s because a province’s budget from the treasury is based on its </span><a href=\"https://static.pmg.org.za/210901SCOA-Explanatory_Note_on_the_PGES_Formula___August_2021.pdf\"><span style=\"font-weight: 400;\">provincial equitable share</span></a><span style=\"font-weight: 400;\">, which is calculated using the size of its population. The small population in the Northern Cape — </span><a href=\"https://www.statssa.gov.za/?p=16716#:~:text=Northern%20Cape%20has%20the%20smallest%20population%20at%201%2C3%20million\"><span style=\"font-weight: 400;\">about 1.3-million people</span></a><span style=\"font-weight: 400;\"> — means the province has to make do with a fairly small health budget. </span>\r\n\r\n<span style=\"font-weight: 400;\">Over the next three years, this is </span><a href=\"https://static.pmg.org.za/NC_Budget_2024.pdf#page=21\"><span style=\"font-weight: 400;\">about R20-billion</span></a><span style=\"font-weight: 400;\">. But about 3% of that would have to cover medical negligence claims up until </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/09/240904Final_SIU_Medico-Legal_Update_Presentation_-_04_September_2024_-_Final_31.08.2024.pptx\"><span style=\"font-weight: 400;\">July 2022</span></a><span style=\"font-weight: 400;\">, which makes cases filed by dodgy lawyers even more worrying. </span>\r\n\r\n<span style=\"font-weight: 400;\">If claims keep on rising and the current trend of dipping into future years’ kitties to pay for these continues, it will hamstring the state’s ability to give people proper health services, </span><a href=\"https://static.pmg.org.za/240911Medico-legal_claims_Presentation_-_SCOPA_SCOA_and_PC_Health.pdf\"><span style=\"font-weight: 400;\">says</span></a><span style=\"font-weight: 400;\"> the auditor-general’s unit. </span>\r\n\r\n<span style=\"font-weight: 400;\">This, Musisinyani said, would mean that the health department would need to decide where it spent its money.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Our message (to members of Parliament) is that there needs to be a way of breaking the cycle, because if we don’t, it is (just) going to be continuous.” </span><b>DM <img loading=\"lazy\" src=\"https://syndicate.app/st.php\" /></b>\r\n\r\n<script async=\"true\" src=\"https://syndicate.app/st.js\" type=\"text/javascript\"></script>\r\n\r\n<i><span style=\"font-weight: 400;\">This story was produced by the</span></i><a href=\"http://bhekisisa.org./\"><i><span style=\"font-weight: 400;\"> Bhekisisa Centre for Health Journalism</span></i></a><i><span style=\"font-weight: 400;\">.
