This ruling could have far-reaching implications for the future of mining in the country.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Six applicants from the ACC went to court in April to argue that the Xolobeni community must provide consent rather than merely be consulted before a mining licence is issued in their area. The department had announced an 18-month moratorium on mining in the area while it considered the issues.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">In court papers, Mineral Resources Minister Gwede Mantashe said the state was the custodian of the country’s mineral resources and while consultation is important, demanding consent could cripple the country’s ability to use mining to grow and transform the economy.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Judge Annali Basson on Thursday ruled that a community must give full and informed consent before a mining right can be issued.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Where the land is held on a communal basis — as in this matter — the community must be placed in a position to consider the proposed deprivation and be allowed to take a communal decision in terms of their custom and community on whether they consent or not to a proposal to dispose of their rights to their land,” read Basson’s judgment.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">She started with a quote from another judgment on land issues that included comments from a Mr Petros Nkosi:</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">But in everything we do, we must remember that there is only one aim and one solution and that is the land, the soil, our world.”</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The key dispute was the interaction between the Mineral and Petroleum Resources Development Act (MPRDA) and the Interim Protection of Informal Land Rights Act (IPILRA).</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">IPILRA seeks to protect informal land right holders from deprivation and requires consent should their rights be deprived. The MPRDA merely requires the community be consulted but not necessarily give consent for a mining licence to be granted.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Basson said the mining proposed in Xolobeni would amount to a deprivation, effectively expropriation, and the two laws must be read together.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">I am satisfied that, in light of the facts that were placed before the Court and the nature of the mining operations (especially open cast mining operations) contemplated on the applicants’ land, that those operations will interfere substantially in their agricultural activities and general way of life,” she said.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Without free, prior and informed consent, they are at real risk of not only losing their rights in their land, but their very way of being.”</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The court heard arguments from the Bench Marks Foundation, which monitors corporate social responsibility, particularly in mining, and said that customary communities, such those in Xolobeni’s Umgungundlovu area, suffer disproportionately from mining through pollution, the loss of farm and grazing land, and displacement — harm that often outweighs the benefits of mining.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">In the context of this community, a residential plot represents far more than merely a place to live: it is a symbol of social maturity and social dignity,” said Basson.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">In a statement, the ACC welcomed the judgment but said Mantashe was likely to appeal. “This is a vindication of our community’s battle for more than 15 years. We have come a long way.”</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The smoke and mirrors of Mr Gwede Mantashe during the last months, where he has denied that he is against our right to say ‘no’, will then be disclosed to the public for what they are,” the ACC said of a possible appeal from the minister.</span></span></span></p>\r\n\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-106487\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/rebecca-XolobeniGwedeMine.jpg\" alt=\"\" width=\"2500\" height=\"1339\" /> Mineral Resources Minister Gwede Mantashe visits the Palabora Mining Company where a fire broke out, killing six miners, on July 17, 2018 in Phalaborwa, South Africa. (Photo by Gallo Images / Sowetan / Antonio Muchave)</p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Mantashe responded in a video on social media, saying he is still studying the judgment.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">When you are given the right to consent, not the right to be consulted in detail, it means you either say yes or no. If you say no, there’ll be no mining,” he said.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">That is taking away the right to issue mining licenses from the state to the communities and I can tell you that if that is the case there will be no mining,” he continued, also warning of communities making unrealistic demands to mining companies that would dissuade them from opening new operations.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Bench Marks executive director John Capel welcomed the judgment:</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">No longer will mining companies and the Department of Mineral Resources be able to ride roughshod over communities’ wishes by simply getting the approval of tribal authorities in granting mining licences. In many cases, these authorities represent vested interests, and do not correctly reflect the wishes of their communities.”</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Thursday’s judgment follows a Constitutional Court <a href=\"https://www.dailymaverick.co.za/article/2018-10-26-ruling-fundamentally-changes-power-dynamics-as-communities-win-big-in-concourt/#.W9bMZTYHgxI.twitter\">ruling</a> in October that upheld a community’s land rights over the rights to mine the area, another judgment shifting the power balance towards communities rather than government and mining companies. </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u><b>DM</b></u></span></span></span></span></span></p>",

"description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",

The MPRDA merely requires the community be consulted but not necessarily give consent for a mining licence to be granted.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Basson said the mining proposed in Xolobeni would amount to a deprivation, effectively expropriation, and the two laws must be read together.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">I am satisfied that, in light of the facts that were placed before the Court and the nature of the mining operations (especially open cast mining operations) contemplated on the applicants’ land, that those operations will interfere substantially in their agricultural activities and general way of life,” she said.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Without free, prior and informed consent, they are at real risk of not only losing their rights in their land, but their very way of being.”</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The court heard arguments from the Bench Marks Foundation, which monitors corporate social responsibility, particularly in mining, and said that customary communities, such those in Xolobeni’s Umgungundlovu area, suffer disproportionately from mining through pollution, the loss of farm and grazing land, and displacement — harm that often outweighs the benefits of mining.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">In the context of this community, a residential plot represents far more than merely a place to live: it is a symbol of social maturity and social dignity,” said Basson.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">In a statement, the ACC welcomed the judgment but said Mantashe was likely to appeal. “This is a vindication of our community’s battle for more than 15 years. If you say no, there’ll be no mining,” he said.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">That is taking away the right to issue mining licenses from the state to the communities and I can tell you that if that is the case there will be no mining,” he continued, also warning of communities making unrealistic demands to mining companies that would dissuade them from opening new operations.</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Bench Marks executive director John Capel welcomed the judgment:</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\">“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">No longer will mining companies and the Department of Mineral Resources be able to ride roughshod over communities’ wishes by simply getting the approval of tribal authorities in granting mining licences. In many cases, these authorities represent vested interests, and do not correctly reflect the wishes of their communities.”</span></span></span></p>\r\n<p class=\"western\"><span style=\"color: #000000;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Thursday’s judgment follows a Constitutional Court <a href=\"https://www.dailymaverick.co.za/article/2018-10-26-ruling-fundamentally-changes-power-dynamics-as-communities-win-big-in-concourt/#.W9bMZTYHgxI.twitter\">ruling</a> in October that upheld a community’s land rights over the rights to mine the area, another judgment shifting the power balance towards communities rather than government and mining companies. </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u><b>DM</b></u></span></span></span></span></span></p>",
