"contents": "<span style=\"font-weight: 400;\">Paying billions of rands for court cases in which doctors and hospitals are sued for supposed malpractice or botched treatment is “archaic”, says Health Minister Aaron Motsoaledi – and the government is putting its foot down.</span>\r\n\r\n<span style=\"font-weight: 400;\">This comes after a </span><a href=\"https://www.youtube.com/watch?v=bOjbQVReaDQ\"><span style=\"font-weight: 400;\">joint press briefing</span></a><span style=\"font-weight: 400;\"> by the Health Department and the </span><a href=\"https://www.siu.org.za/\"><span style=\"font-weight: 400;\">Special Investigating Unit</span></a><span style=\"font-weight: 400;\"> (SIU) on Saturday </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/Joint-Press-Conference-with-the-SIU-Medico-legal-claims-22-August-2024-1.pdf\"><span style=\"font-weight: 400;\">on the findings</span></a><span style=\"font-weight: 400;\"> from the unit’s </span><a href=\"https://www.gov.za/speeches/special-investigating-unit-investigates-allegations-corruption-and-maladministration-25-jul\"><span style=\"font-weight: 400;\">ongoing probe</span></a><span style=\"font-weight: 400;\"> into 10,679 legal claims against the state’s health departments between 2015 and 2020, amounting to a total of R107-billion. </span>\r\n\r\n<span style=\"font-weight: 400;\">This amount is close to half of what the department’s </span><a href=\"https://docs.google.com/spreadsheets/d/1wfkc5MXXZ0esik5HNHKlXELAHVmpubKHA46vp-ql10k/edit?gid=0#gid=0\"><span style=\"font-weight: 400;\">budget was in those five years</span></a><span style=\"font-weight: 400;\"> – about R215-billion – which should best be used for hiring health workers, buying medicine and running hospitals.</span>\r\n\r\n<span style=\"font-weight: 400;\">The SIU’s work has, so far, saved the department R3-billion. But if dealing with a dispute between doctors and their patients after treatment didn’t always have to end up in court, it might not have been so easy for dodgy lawyers to exploit the system in the first place. </span>\r\n\r\n<span style=\"font-weight: 400;\">An </span><a href=\"https://www.gov.za/sites/default/files/Joint%20Press%20Conference%20with%20the%20SIU%20-%20Medico-legal%20claims%20-%2022%20August%202024.pdf\"><span style=\"font-weight: 400;\">“explosion”</span></a><span style=\"font-weight: 400;\"> in legal cases brought against doctors and hospitals (so-called </span><a href=\"https://www.scielo.org.za/scielo.php?script=sci_arttext&pid=S0256-95742023000400004#:~:text=Medicolegal%20claims%2C%20normally%20meaning%20claims%20based%20on%20instances%20of%20medical%20negligence%20or%20malpractice\"><span style=\"font-weight: 400;\">medico-legal claims</span></a><span style=\"font-weight: 400;\">) occurred since 2015, the Health Department said previously, which led to President Cyril Ramaphosa ordering the SIU to look into possible fraudulent claims two years ago. </span>\r\n\r\n<span style=\"font-weight: 400;\">So far, the </span><a href=\"https://www.gov.za/sites/default/files/Joint%20Press%20Conference%20with%20the%20SIU%20-%20Medico-legal%20claims%20-%2022%20August%202024.pdf\"><span style=\"font-weight: 400;\">investigators have found</span></a><span style=\"font-weight: 400;\"> cases of unscrupulous lawyers obtaining patient records illegally, claims made on behalf of patients without their knowledge, or patients being “tricked” into suing the state.</span>\r\n\r\n<span style=\"font-weight: 400;\">Turning to the court to decide on a medical negligence claim is not necessarily in patients’ best interest, said Motsoaledi. “Because in court, it depends [on] who has fired more bullets or who has fired the first shot that hit. So we want to change that method.”</span>\r\n<h4><b>The silicosis class action</b></h4>\r\n<span style=\"font-weight: 400;\">Something that could yield a better outcome is to opt for mediation – and “we have seen it work”. This was a reference to the </span><a href=\"https://pmg.org.za/files/181024medi_release.pdf\"><span style=\"font-weight: 400;\">out-of-court settlement</span></a><span style=\"font-weight: 400;\"> reached between mineworkers and mining companies in a class action on behalf of workers who had developed silicosis as a result of their labour.</span>\r\n\r\n<a href=\"https://www.nhs.uk/conditions/silicosis/#:~:text=Silicosis%20is%20a%20long%2Dterm,that%20can%20be%20easily%20inhaled.\"><span style=\"font-weight: 400;\">Silicosis</span></a><span style=\"font-weight: 400;\"> is an incurable lung disease caused by breathing in large amounts of dust from grinding or drilling into rocks, </span><a href=\"https://www.cdc.gov/niosh/mining/topics/respiratorydiseases.html\"><span style=\"font-weight: 400;\">such as during mining</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">Mediation is a process in which two opposing sides </span><a href=\"https://www.justice.gov.za/legislation/notices/2014/2014-03-18-gg37448_rg10151_gon183-rules-mc.pdf\"><span style=\"font-weight: 400;\">negotiate a settlement</span></a><span style=\"font-weight: 400;\"> with the help of a qualified independent adviser so that they come to an acceptable agreement together instead of having to go to court. </span>\r\n\r\n<span style=\"font-weight: 400;\">For example, in the silicosis class action, the miners’ representatives and the different mining companies decided to </span><a href=\"https://pmg.org.za/files/181024medi_release.pdf\"><span style=\"font-weight: 400;\">talk to each other rather than present their case to a judge</span></a><span style=\"font-weight: 400;\">. After three years, a settlement was reached that let the miners who developed lung disease as a result of their work get compensation payouts to cover their and their families’ costs from a trust fund set up as part of the settlement. </span>\r\n\r\n<span style=\"font-weight: 400;\">Negotiating the deal meant the case didn’t need to go through the court process, which may not necessarily have ruled in the miners’ favour, and could have meant their losing out on compensation.</span>\r\n\r\n<span style=\"font-weight: 400;\">But mediation is not common in medical disputes – despite </span><a href=\"https://www.saflii.org/images/superiorcourts/Uniform%20Rules%20of%20Court%20%5BF%5D.pdf#page=97\"><span style=\"font-weight: 400;\">a 2020 rule (R41A) </span></a><span style=\"font-weight: 400;\">that is meant to guide legal proceedings in civil matters. It says negotiation must be considered as a way to resolve a dispute first, before the case is taken to court. </span>\r\n\r\n<span style=\"font-weight: 400;\">If a case does end up having to go to trial, the lawyers need to show that their clients had considered mediation but that there were valid reasons that it couldn’t work and the case therefore has to be argued before a judge. </span>\r\n<h4><b>Settling disputes faster</b></h4>\r\n<span style=\"font-weight: 400;\">With R41A, the idea is that fewer cases will end up unnecessarily clogging up the courts, likely bringing down the high costs that come with lawsuits, and get disputes resolved faster.</span>\r\n\r\n<span style=\"font-weight: 400;\">An </span><a href=\"https://www.justice.gov.za/salrc/ipapers/ip33_prj141_Medico-legal.pdf\"><span style=\"font-weight: 400;\">analysis</span></a><span style=\"font-weight: 400;\"> of 19 medical lawsuits by the </span><a href=\"https://www.justice.gov.za/salrc/\"><span style=\"font-weight: 400;\">South African Law Reform Commission</span></a><span style=\"font-weight: 400;\"> (SALRC) found that it took anything from one year and six months to as long as 16 years and one month to get to a judgment. In fact, three-quarters of the cases took longer than five years to draw to a close. </span>\r\n\r\n<span style=\"font-weight: 400;\">Lengthy lawsuits make costs pile up, as applicants need to </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/02587203.2019.1662326.pdf\"><span style=\"font-weight: 400;\">pay</span></a><span style=\"font-weight: 400;\"> for the services of an attorney, travelling to court, submitting documents and hiring expert witnesses (when needed). In </span><a href=\"https://justice.gov.za/salrc/ipapers/ip36-prj142-LegalFees.pdf#page=29\"><span style=\"font-weight: 400;\">most cases</span></a><span style=\"font-weight: 400;\">, lawyers charge an hourly rate for their work, so the more often they have to go to court or the longer a case drags on, the more expensive a case becomes. Sometimes, depending on the outcome of the case, a court can </span><a href=\"https://repository.up.ac.za/bitstream/handle/2263/93404/Bekker_Apportionment_2022.pdf?sequence=1&isAllowed=y\"><span style=\"font-weight: 400;\">make one party cover the legal costs of the other</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, the </span><a href=\"https://www.saflii.org/za/legis/consol_reg/cfaitotcfa538/\"><span style=\"font-weight: 400;\">Contingency Fee Act</span></a><span style=\"font-weight: 400;\"> gives lawyers’ clients the option of not having to pay anything upfront or for many billable hours; instead, if the ruling is in their favour, the lawyer is entitled to </span><a href=\"https://justice.gov.za/legislation/regulations/r2006/CONTINGENCY%20FEES%20ACTfin.pdf\"><span style=\"font-weight: 400;\">up to 25% of the payout</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">Because medical malpractice cases often involve large awards as compensation for a patient’s suffering or loss in quality of life, this is an attractive option for unscrupulous lawyers.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<span style=\"font-weight: 400;\">And, said Motsoaledi, while the cap of 25% exists in theory, “in practice we know that many take more”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The SIU’s </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/Joint-Press-Conference-with-the-SIU-Medico-legal-claims-22-August-2024-1.pdf#page=8\"><span style=\"font-weight: 400;\">investigation</span></a><span style=\"font-weight: 400;\"> found instances of law firms keeping most of the money that the state paid out. For example, for one case in the Eastern Cape the department paid R373-million to a single firm for 22 different claims – but “[the firm] pocketed all the money for themselves”. </span>\r\n<h4><b>‘Creative potential to find solutions’</b></h4>\r\n<span style=\"font-weight: 400;\">Mediation can save time and costs, says Shamal Ramesar, who heads a nonprofit called Mediation in Motion Mediators (MiMM). </span>\r\n\r\n<span style=\"font-weight: 400;\">Advisers can charge only </span><a href=\"https://www.justice.gov.za/legislation/notices/2014/20141031-gg38164-gon854-mediation.pdf\"><span style=\"font-weight: 400;\">up to R6,000 per day</span></a><span style=\"font-weight: 400;\"> as opposed to </span><a href=\"https://justice.gov.za/salrc/ipapers/ip36-prj142-LegalFees.pdf#page=29\"><span style=\"font-weight: 400;\">up to R6, 000 per hour</span></a><span style=\"font-weight: 400;\"> a highly experienced attorney could charge. </span>\r\n\r\n<span style=\"font-weight: 400;\">But the outcome of mediation doesn’t always have to be a financial reward, says Jacques Joubert, an advocate of the high court who also works as a mediator. The idea is to settle the dispute in a way that is the best for both parties, which means “there’s a creative potential to find solutions, such as the hospital or doctor offering further treatment”. </span>\r\n\r\n<span style=\"font-weight: 400;\">To encourage people to choose negotiating a deal outside court as a way to settle medical disputes, </span><a href=\"https://www.mimmediators.org/\"><span style=\"font-weight: 400;\">MiMM</span></a><span style=\"font-weight: 400;\"> has partnered with the </span><a href=\"https://southafricanmedical.org/\"><span style=\"font-weight: 400;\">South African Medical Association</span></a><span style=\"font-weight: 400;\"> to offer doctors and their patients a free meeting should a conflict arise after treatment.</span>\r\n\r\n<span style=\"font-weight: 400;\">MiMM drew up a </span><a href=\"https://sasog.co.za/wp-content/uploads/2019/05/P19Pre-Mediation-eeting-lauseResolution.pdf\"><span style=\"font-weight: 400;\">clause for a pre-mediation meeting</span></a><span style=\"font-weight: 400;\"> that doctors can add to their patient consent forms. If the option for such a meeting is taken up, an appointed mediator will listen to both sides to hear what the conflict is about and then advise on whether it can be solved with mediation rather than going to court. In this both parties can make an informed decision about their course of action.</span>\r\n\r\n<span style=\"font-weight: 400;\">A </span><a href=\"https://assets.publishing.service.gov.uk/media/5a7ebfd6ed915d74e33f22d3/mediation-information-assessment-meetings.pdf\"><span style=\"font-weight: 400;\">study</span></a><span style=\"font-weight: 400;\"> from the UK government shows that attending a pre-mediation meeting helped people dealing with family disputes to try negotiation rather than a lawsuit.</span>\r\n\r\n<span style=\"font-weight: 400;\">Participants were interviewed before and after attending a session with a mediator, who gave them information on the process and also assessed whether it would be a good option for their case. Most of the participants decided to negotiate with their opponents, with clients who knew little about the idea of mediation getting the most benefit from the pre-meeting.</span>\r\n\r\n<span style=\"font-weight: 400;\">Although a part of Rule 41A says that if one of the parties in a dispute refuses mediation and rather opts to take the case to court, they may have to foot the bill for the court application, the stipulation is rarely enforced and there are even </span><a href=\"https://www.justice.gov.za/rules_board/invite/20230516-RB-InviteToComment-URC41A-invite.pdf\"><span style=\"font-weight: 400;\">talks about removing it</span></a><span style=\"font-weight: 400;\"> in special cases. </span>\r\n\r\n<span style=\"font-weight: 400;\">That’s where a pre-mediation meeting clause, like the one doctors have an opportunity for through the mediation pilot project, could come into play. </span>\r\n\r\n<span style=\"font-weight: 400;\">In fact, a </span><a href=\"https://www.justice.gov.za/salrc/dpapers/dp154-prj141-Medico-Legal-Claims.pdf#page=389\"><span style=\"font-weight: 400;\">discussion paper</span></a><span style=\"font-weight: 400;\"> by the SALRC recommends including this type of clause in patient admission forms to help people consider mediation instead of going straight to court, especially in the public sector, where </span><a href=\"https://bhekisisa.org/wp-content/uploads/2024/08/Joint-Press-Conference-with-the-SIU-Medico-legal-claims-22-August-2024-1.pdf\"><span style=\"font-weight: 400;\">negligence claims are high</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Says Ramesar: “You’ve got nothing to lose in this meeting.
