"contents": "<span style=\"font-weight: 400;\">Justice Raymond Zondo has for months been pleading with the government to approve the use of private law firms to defend high court applications aimed at setting aside the State Capture Report.</span>\r\n\r\n<span style=\"font-weight: 400;\">The chairperson of the State Capture Commission is concerned that the State Attorney is not sufficiently capacitated to defend the report.</span>\r\n\r\n<span style=\"font-weight: 400;\">Produced at a cost of more than R1-billion after three years of public hearings, the report stands as a record of large-scale corruption in the public sector. It is the subject of roughly a dozen review applications, all of which are being opposed by the commission.</span>\r\n\r\n<span style=\"font-weight: 400;\">It has emerged, however, that the commission has been left red-faced in some of the matters as it has not been able to file either records or answering affidavits, primarily because it does not have a dedicated team of lawyers.</span>\r\n\r\n<span style=\"font-weight: 400;\">The commission, in response to questions from </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">, says discussions with advocate Doc Mashabane, the director-general of the Department of Justice, the office of the State Attorney as well as Solicitor-General </span><a href=\"https://www.dailymaverick.co.za/article/2020-04-06-new-sheriff-in-town-state-attorney-horror-show-in-for-cleanup-as-acting-solicitor-general-appointed/\"><span style=\"font-weight: 400;\">Fhedzisani Pandelani</span></a><span style=\"font-weight: 400;\"> have come to naught. </span>\r\n\r\n<span style=\"font-weight: 400;\">Even two attempts by Zondo, in his capacity as chairperson of the commission, to get Justice Minister Ronald Lamola to intervene have thus far been unsuccessful. </span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> has now confirmed that this is primarily because the commission is at odds with the government about whether these cases ought to be entrusted to the State Attorney or if they should be farmed out to private law firms. </span>\r\n\r\n<span style=\"font-weight: 400;\">Reviews filed to date include those by former</span> <span style=\"font-weight: 400;\">President Jacob Zuma,</span> <a href=\"https://www.dailymaverick.co.za/article/2022-12-14-former-spy-boss-arthur-fraser-attempts-court-challenge-of-zondo-report/\"><span style=\"font-weight: 400;\">former spy boss Arthur Fraser</span></a><span style=\"font-weight: 400;\">, Cabinet minister Gwede Mantashe, former Eskom acting CEO </span><a href=\"https://www.dailymaverick.co.za/article/2022-12-23-former-eskom-acting-ceo-matshela-koko-set-to-contest-zondo-report-findings-against-him-in-court/\"><span style=\"font-weight: 400;\">Matshela Koko</span></a><span style=\"font-weight: 400;\">, and Lucky Montana, Sfiso Buthelezi and others formerly of the Passenger Rail Agency of SA (Prasa).</span>\r\n\r\n<span style=\"font-weight: 400;\">Regardless of their merits or prospects of success, some of these applications are voluminous and politically charged.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> confirmed details of the tension between the commission and the government after submitting enquiries about delays in the commission’s filing of records and responses in some of the court cases. </span>\r\n\r\n<span style=\"font-weight: 400;\">First the State Attorney, as the government’s attorney of record, told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> that it is coordinating all aspects of the litigation with appointed counsel. </span>\r\n\r\n<span style=\"font-weight: 400;\">But then the commission, in response to questions, said it had engaged the Department of Justice about the need for private law firms to step in after it became clear that the State Attorney did not have the capacity to handle these cases. </span>\r\n\r\n<span style=\"font-weight: 400;\">After what it bills as inordinate delays that undermined and compromised its position, the commission briefed private lawyers to get started on the reviews. Those firms are working at no charge until such time as the government resolves the issue, the commission said. </span>\r\n\r\n<a href=\"https://www.dailymaverick.co.za/screenshot-2023-02-08-at-17-03-54-2/\"><img loading=\"lazy\" class=\"alignnone size-full wp-image-1562047\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2023/02/Screenshot-2023-02-08-at-17.03.54-1.png\" alt=\"\" width=\"720\" height=\"555\" /></a>\r\n\r\n<span style=\"font-weight: 400;\">In its response to </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">, the commission also sets out, in extraordinary detail, its frustration and concern about the situation. </span>\r\n\r\n<span style=\"font-weight: 400;\">It initially asked the State Attorney to represent it as well as commission chair, especially in some of the earlier applications filed.</span>\r\n\r\n<span style=\"font-weight: 400;\">It was then found that the State Attorney had not carried out some of the instructions. Enquiries in August 2022 revealed that the State Attorney’s Johannesburg office did not have the capacity to deal even with its own caseload: “That office revealed that each attorney was handling in the region of 1,000 files or so and they were under severe pressure.”</span>\r\n\r\n<span style=\"font-weight: 400;\">It was then that the commission approached the government in the hope of appointing private lawyers. </span>\r\n\r\n<span style=\"font-weight: 400;\">But, despite it having exerted much pressure on the office of the State Attorney, that of the Solicitor-General and the DG of Justice over the past six months, nothing has come of it. </span>\r\n\r\n<span style=\"font-weight: 400;\">The State Capture Commission sat for more than three years of public hearings and concluded its work with a </span><a href=\"https://www.dailymaverick.co.za/article/2022-06-22-zondo-commission-look-back-highlights/\"><span style=\"font-weight: 400;\">six-part report </span></a><span style=\"font-weight: 400;\">that was handed to President Cyril Ramaphosa between January and June 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">Although the report implicated many individuals and entities, its release, remarkably, did not trigger a flood of review applications. </span>\r\n\r\n<span style=\"font-weight: 400;\">The commission said qualifying parties have 180 days (six months) from the date of the release of the relevant part of the report to institute a review application. </span>\r\n<h4><b>‘Deep disappointment’</b></h4>\r\n<span style=\"font-weight: 400;\">Given the high-stakes nature of some of them, it is crucial for the defence of the report to be consolidated both legally and financially. </span>\r\n\r\n<span style=\"font-weight: 400;\">The commission said being left without lawyers to defend its work and the report would play into the hands of those who wanted to collapse the commission or have the report nullified.</span>\r\n\r\n<span style=\"font-weight: 400;\">In its written response to</span><i><span style=\"font-weight: 400;\"> Daily Maverick</span></i><span style=\"font-weight: 400;\">, the commission quoted Justice Zondo, saying: “It is a matter of deep disappointment that the Commission has been put in this embarrassing position where it has not been able to lodge records in Court because the Government has failed over a number of months to appoint attorneys to represent it. The work of the Commission is very important and should be defended in the interest of the fight against state capture and corruption.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Amanda Vilakazi, Mantashe’s attorney, told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">: “</span><span style=\"font-weight: 400;\">In August last year the State Attorney requested indulgence for filing of the rule 53 record for a period of 2 months, they indicated that the record we are requesting is voluminous and requires time to compile.</span>\r\n\r\n<span style=\"font-weight: 400;\">“It is now February 2023 we still have not received the record, despite numerous requests, we will be filing an application to compel the Commission to file the record of their decision making/recommendation.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The only matters in which the commission has lodged records in</span>\r\n\r\n<span style=\"font-weight: 400;\">court are those involving former President Jacob Zuma and Johannesburg businessperson </span><a href=\"https://www.dailymaverick.co.za/article/2021-02-24-pulling-a-zuma-auswell-tall-trains-mashaba-defies-the-zondo-commission-and-lands-in-hot-water/\"><span style=\"font-weight: 400;\">Auswell Mashaba</span></a><span style=\"font-weight: 400;\">, who was implicated in the Prasa/Swifambo rail scandal.</span>\r\n\r\n<span style=\"font-weight: 400;\">Both cases pre-date the current tension over the use of private lawyers. </span>\r\n\r\n<span style=\"font-weight: 400;\">The commission says the Solicitor-General had undertaken to appoint private lawyers in December and still nothing has been done. </span>\r\n\r\n<span style=\"font-weight: 400;\">This, the commission says, is despite it having explained the urgency as well as how delays are compromising its position in relation to the various review applications.</span>\r\n<h4><b>We’ve got this, says DoJ</b></h4>\r\n<span style=\"font-weight: 400;\">The Department of Justice (DOJ) says it is the custodian of the report, and it therefore has a duty to defend it. It says it has instructed the State Attorney to represent the commission in this regard. All reviews are being opposed, it says. </span>\r\n\r\n<span style=\"font-weight: 400;\">Technically, there is no commission so the management of legal challenges rests with the Department of Justice. The commission’s secretariat operates on a skeleton staff of about 13 people tasked with handling administrative issues, including some aspects of the legal challenges. </span>\r\n\r\n<span style=\"font-weight: 400;\">The State Attorney, it says, will coordinate and manage all aspects of the relevant litigation. But it intends using the institutional knowledge and expertise of some of the Zondo Commission evidence leaders who dealt with the relevant work streams. </span>\r\n\r\n<span style=\"font-weight: 400;\">Reviews filed to date emanate from the commission’s Bosasa, South African Airways, Prasa, Eskom and the State Security Agency work streams.</span>\r\n\r\n<span style=\"font-weight: 400;\">Asked whether there was a need for a special dispensation given that the commission chairperson – cited as a respondent in all the cases filed to date – is now also the country’s Chief Justice, the Department of Justice said: “The situation is not unusual as judges have led other Commissions which were also taken on review, some successfully.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The Judiciary is independent and those involved in the Commission may have to recuse themselves from the adjudication of those matters.” </span><b>DM</b>\r\n\r\n<a href=\"https://www.dailymaverick.co.za/article/2018-11-21-vbs-bank-heist-effs-family-ties-and-moneyed-connections/pauli-vbs-eff-scorpio-logo-for-the-bottom-of-the-story/\" rel=\"attachment wp-att-115556\"><img loading=\"lazy\" class=\"alignnone size-full wp-image-115556\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/PAULI-VBS-EFF-Scorpio-Logo-for-the-bottom-of-the-story.jpg\" alt=\"\" width=\"720\" height=\"333\" /></a>",

He was the first president of South Africa to be born after apartheid, and he played a key role in the transition to democracy. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",

The intelligence links the cartels to the sabotage of Eskom’s power stations and to a programme of political destabilisation which has contributed to the current power crisis.",
